MINUTES of the October 19th, 2023, Town of Rochester Zoning Board of Appeals, held via Zoom for Public Comment and Livestreamed on YouTube.

Chair Zurofsky called the meeting to order at 6:00 PM.

The Board Members stood for the Pledge of Allegiance.

The secretary did roll call attendance.

APPLICATION REVIEW:

Continued Applications:

ZBA 2023-03 AV- Richard and Rachel Quenemoen
S/B/L 69.1-1-13 – 258 Whitfield Rd
Applicant has proposed a 24’ x 24’ garage within the 40’ require setback. Applicant is requesting a 28’ area variance. Parcel is +/- 1 acre.

Chair Zurofsky went over the application. The board went through the questions for a decision and discussed the wording of their decision.

Chair Zurofsky made a motion to grant a 10’ variance. Member Stephens 2nd the motion. All in favor 5 yes, 0 no, 0 abstain.

New Applications:

ZBA 2023-07 AV- Henry Hershkowitz
S/B/L 68.2-2-31 & 68.2-2-38.112 – 14 Bakertown Road & 15 Bakertown Road
Applicant has proposed ‘carve’ the garage portion of the property off the 15 Bakertown Road deed and add it to 14 Bakertown Road.

The applicant explained their need for a variance as well as the constraints of the properties. The board discussed the driveway concerns for access to the garage as well as to the house. The board requested that the applicant get more measurements to show distance from the garage to the driveway as well as to all edges of the property.

Member Fischer made a motion to approve the 8/17/23 minutes. Member Stephens 2nd the motion. All in favor 5 yes, 0 no, 0 abstain.
Member Davis made a motion to approve the 9/21/23 minutes. Member Haugen 2nd the motion. All in favor 5 yes, 0 no, 0 abstain.

Other Discussions-
The board discussed the issues with the Friendly Acres Homeowners Association application. Chair Zurofsky discussed the boards options with the attorney prior to the meeting. The board agreed that they need to request for code enforcement and the applicant to attend the next meeting.
