MINUTES of the December 22, 2022 regular meeting, Town of Rochester Zoning Board of Appeals, held via Zoom for Public Comment and Livestreamed on YouTube.

Chair Zurofsky called the meeting to order at 6PM.

The Board Members stood for the Pledge of Allegiance.

Chair Zurofsky did roll call attendance.

ALSO PRESENT: Michael Coleman, Board Liaison.

APPLICATION REVIEW:

1. ZBA 2022-01 AV (Fence)
Zain Eisenberg
S/B/L 59.15-1-17 – 516 Upper Cherrytown Rd
Applicant seeks a variance for a fence that does not comply with the Town Code’s current fence height requirement.

Mr. Eisenberg states the fence in question was placed 4-5 years prior to the Code Violation Notice written on May 9, 2022. The fence provides privacy for his daughter, who’s bedroom window is shielded by the fence. Further, Eisenberg expresses to cut the fence down to 4 feet would look terrible, and the height of the fence now, 6 feet, provides privacy to Mr. Eisenberg and family. Because of the lot’s shape, the board seeks resourcing to define the lots’ front, back, and side yards. An amended application is requested from Mr. Eisenberg.
The board discusses the following: would the fence produce an undesirable change within the neighborhood, even if the structure is already existing. Are there other options for privacy, that also enhances curb appeal. Is there adverse effect on physical or environmental conditions? Is this a self-created hardship? Motion to table Mr. Eisenberg’s case until the meeting on February 16, 2023. Seconded. 3 Ayes, 0 Nays, 0 Abstentions.

OTHER MATTERS:

– The January meeting will be removed from the calendar. Motion to cancel the meeting on 1/19/23, motion seconded. 3 Ayes, 0 Nays, 0 abstentions.

– All training is up to date.
