` 62 Raycliff Dr./SBL: 77.3-3-41/ R-2 District
o Parcel is in the R-2 zoning district
o Parcel is +/- 3.8 acres
o Applicant has erected a 6ft fence on the front yard of the parcel.
o Applicant does not meet the code for the side/front yard’s fence requirement (section 140-13 (H))
o There is currently an open violation as the applicant had previously applied, was denied approval, yet erected the fence regardless.

o Parcel is in the R-5 zoning district
o Parcel is +/- 5.1 acres
o Applicant proposes erection of a garage and does not meet 50ft setback for the side yards; currently only +/- 33ft and +/- 39ft. Applicant would need +/- 11ft and +/-17ft variances.

22/016 – Marc Grasso/CRAM LLC/Honeycomb Hills – CEO Appeal
Beehive Rd., Accord, NY/SBL: 68.3-1-27/R5
• Applicant has requested an appeal of the decision of Major Subdivision dated 12/27/2021
• Parcel is in the R-5 zoning district
• Parcel is +/- 24 acres
• Applicant has proposed the following:
Lot #1 – +/- 5.430
Lot #2 – +/- 5.671
Lot #3 – +/- 7.253
Lot #4 – +/- 5.566
• Based on the proposed site plan dated 12/1/21 it was determined that the “town maintained” roadway ends before 3 of the proposed driveways. A minor subdivision by definition of our code is:

(Section 140-4) SUBDIVISION A.
MINOR SUBDIVISION – A subdivision that does not involve improvements such as roads, recreational amenities or other common facilities and utilities.

With the plan provided as well as the definition above I determined this a Major Subdivision by reason of road improvements.
• Please note that during a meeting with the Attorney for the Town as well as the Planning Board Chairperson on 1/4/22 @ 2:00pm it was reviewed, researched, and agreed upon that the decision for Major Subdivision was appropriate.
