Town Board Public Hearing – January 2024

The Town of Rochester Town Board held a public hearing on Proposed Local Law C-2024: amending Chapter 140, zoning to included new chapter entitled §140-32.1, Adult Use Cannabis Related Businesses for 1/11/2024 at 6:30pm at the Harold Lipton Community Center, 15 Tobacco Road, Accord, NY 12404

Supervisor Baden called the public hearing to order and led in the Pledge of Allegiance to the Flag.

PUBLIC COMMENT:

Mead Dewitt: asked if any locations have already been proposed, does the Town plan to have a cap on the amount of retail stores allowed?

Supervisor Baden stated that there is no cap and we have received one application for a micro business that is expected to go at the corner of Lucas Ave and Route 209.

One Resident stated he was the applicant for the micro business and he is looking to sell and Ag product to help with the income of his vegetable farm operation.

C. Purpose:
1. To provide for the placement of adult use cannabis retail dispensaries, adult use on-site cannabis consumption facilities, microbusinesses, and Registered Organization with Dispensing (ROD). Facilities.in appropriate places.
2. To minimize the adverse impacts of adult use cannabis retail dispensaries, adult use on- site cannabis consumption facilities, microbusinesses, and Registered Organization with Dispensing (ROD). Facilities. on residential neighborhoods, schools, and other places where children commonly congregate.
3. To regulate the siting, design, placement, security, safety, hours of operation, monitoring, and modification of adult use cannabis retail dispensaries, adult use on-site cannabis consumption facilities, microbusinesses, and Registered Organization with Dispensing (ROD). Facilities.
What are last sentences in the above sub-paragraphs trying to convey?
Shouldn’t in sub-paragraph C.1 the last sentence to say:
“…. Registered Organization with Dispensing (ROD) facilities in appropriate
places.”? And similarly, the last sentences in sub-paragraphs C.2 and C.3?
Essentially, shouldn’t “dots” after abbreviation (ROD) and word “Facilities” to be
removed and lower case to be used in the word “facilities”?
D. State Approval.
Any adult use cannabis retail dispensaries, adult use on-site cannabis consumption
facilities, microbusinesses, and Registered Organization with Dispensing (ROD).
Facilities.approved pursuant to this local law must be licensed in accordance with
New York State Cannabis Law Article IV, Adult-Use Cannabis.
Make correction identical to C1 – C3?

F4. An adult use cannabis retail dispensary or on-site cannabis consumption
facility shall not be located within a 500-foot radius from the property boundary of
any parcel which has the following use:
Where the distance of 500 ft coming from? It doesn’t appear to be too far from
children-used facilities. Why not 750 or 1000ft?

Town of Rochester Planning Board: Please accept the following comments on behalf of the Town of Rochester Planning Board in regards to Local Law C- Cannabis:
Revise section H # 1&2 to reflect any 12 consecutive hours of operation within a given day. This removes the hours slated as operational and gives the owner the ability to be open any 12 hours of their choice.
Remove Section 2 # 1 all together and remove the definition that goes with it.
Revise Section F # 4 to reflect a 1000foot radius.
