Recommended Resolution:
Whereas the Town of Rochester, Ulster County, is desirous of providing and/or to arrange for ambulance services to its residents and the Town desires that such service have sufficiently trained and skilled emergency medical technicians serving on its ambulances available to serve persons situated in the Town.

Whereas the town has prepared a map, plan and report that is in such detail as is acceptable to the town board; and

Whereas the map, plan and report have been filed in the office of the town clerk pursuant to Section 209-c of the Town Law in advance of the adoption of this resolution; and

Whereas the town board has adopted an order and entered the same in the minutes of its proceedings reciting a description of the boundaries of the proposed ambulance district sufficient to identify the lands included therein as in a deed of conveyance, the improvements proposed, the maximum estimated amount proposed to be expended annually for the improvement, and the cost of the district to the typical property, and the fact that a map, plan and report describing the same are on file in the town clerk’s office for public inspection and specifying the time when and place where said board will meet and hold a public hearing to hear all persons interested in the subject thereof, concerning the same; and

Whereas a copy of such order has been published at least once in the official paper of the Town of Rochester, the first publication thereof which was not less than ten (10) nor more than twenty (20) days before the date set therein for the hearing had preceding this resolution; and

Whereas a copy of the order was posted on the signboard of the town maintained pursuant to subdivision six of section thirty of this chapter, not less than ten (10) nor more than twenty (20) days before the day designated for the hearing since had on this issue; and

Whereas a public hearing was held on the 7th day of July 2022 at 6:30 pm at the Harold Lipton Community Center with a street address of 15 Tobacco Road, Accord, NY 12404: and

Whereas the board has determined that the notice of hearing was published and posted as required by law, and is otherwise sufficient; and

Whereas the board has determined that all of the property and property owners within the proposed district are benefited by the proposed district; and

Whereas the board has determined that all of the property and property owners benefited are included within the limits of the proposed district; and

Whereas the board has determined that the establishment of an ambulance district. A description is as follows:

The area within the Town of Rochester identified by Ulster County Emergency Services as the boundaries of the Kerhonkson-Accord First Aid Squad (KAFAS) coverage area; and

It is hereby resolved that subject to permissive referendum, that the Town of Rochester establish an ambulance district for the benefit of all of the property and property owners in the proposed ambulance district; and

It is further resolved that such ambulance district shall include and be limited to the territory described above, being the entire limits of the Town.

It is further resolved that such ambulance district shall become effective immediately after approval of the voters or thereafter as may be required by law or in case no petition is successfully filed, after the time to petition for a referendum has expired.

It is hereby ordered that, the clerk of the Town of Rochester shall file this resolution in the office of the Clerk of the Town and make such resolution available for public inspection.

It is further ordered that, the clerk of the Town of Rochester shall cause to be prepared and have available for distribution proper forms for a petition seeking a public referendum and shall distribute a supply to any person requesting the same.

It is further ordered that, if, after the expiration of the time for filing a petition requesting that the matter be submitted to a referendum of the property owners of the proposed ambulance district, no such petition has been filed with the town clerk, the town clerk is directed to file a certificate stating such fact in the office of the county clerk.

It is further ordered that, upon the filing of such a certificate in the office of the Ulster County Clerk, the Board shall adopt a final order establishing the ambulance district.
E. Adoption of a Special District – Marbletown First Aid Unit Ambulance District
Recommended Resolution:

Whereas the board has determined that all of the property and property owners within the proposed district are benefited by the proposed district; and

Whereas the board has determined that all of the property and property owners benefited are included within the limits of the proposed district; and

Whereas the board has determined that the establishment of an ambulance district. A description is as follows:

F. Action on Minutes
Recommended Resolution: The Town of Rochester Town Board accepts the minutes of the May 25 Audit Meeting, May 25 Public Hearing, May 25 Special Meeting, June 2 Public Hearing, June 2 Business Meeting, June 15 Workshop Meeting, June 30 Audit Meeting, June 30 Public Hearing, and June 30 Special Meeting.

G. Amendment to Resolution xx-2022
Recommended Resolution: The Town of Rochester Town Board amends resolution xx-2022, approving abstract 6-2022. The General Fund approved amount is changed from $113,013.65 to $113,010.76.

H. Acceptance of Donation
Recommended Resolution: The Town of Rochester Town Board accepts donation of $86.74 from St. Pauly Textile.

I. Acceptance of Donations
Recommended Resolution: The Town of Rochester Town Board accepts donations of $250 from Gary Palmer and $100 from Pam and Charles Stocking for the Youth Summer Program.

J. Change in Meeting Date
Recommended Resolution: The Town of Rochester Town Board changes the August 2022 Regular Business Meeting from Thursday August 4, 2022 to Tuesday August 2, 2022 at 6:30pm at the Harold Lipton Community Center due to a potential quorum issue. The Town Clwrk is requested to post legal notice of the meeting date change.


K. Scheduling a Special Meeting
Recommended Resolution: The Town of Rochester Town Board schedules a special meeting on Sunday, July 24, 2022 at 1:00 pm at the Harold Lipton Community Center for the purposes of holding an informational presentation with a question and answer session. The Town Clerk is requested to post legal notice of the meeting.
The information session will cover general information on the process of passing zoning changes and an overview of the zoning change recommendations the Town Board is currently considering during the six-month moratorium. There will be an opportunity after the presentation for the public to ask questions.

L. Appointment of Environmental Conservation Commission Chairperson
Recommended Resolution: The Town of Rochester Town Board appoints John Messerschmidt as Chairperson of the Environmental Conservation Commission, effective immediately. The Town Clerk is requested to notify of the Oath of Office requirement.

M. Authorizing Recreation Commission Classes
Recommended Resolution: The Town of Rochester Town Board authorizes the expenditure of up to $400 of Recreation Dept funds for supplies for 2@ youth and 2@ adult paint classes for July and August.

N. Authorizing Electrical Inspector Addition
Recommended Resolution: on request by the Building Department, the Town of Rochester Town Board authorizes the addition of Albert J. Sardina, Port Jervis Electric, Inc. to the list of Town of Rochester approved 3rd party electrical inspectors.

O. Authorizing a Professional Services Agreement
Recommended Resolution:The Town of Rochester Town Board authorizes the Supervisor to enter intop a Professional Services agreement between Ulster County and the Town of Rochester for administerong funding provided by the New York State Office of Children and Family Services for youth recreational programs operated by the Towns and City in Ulster County.

P. Authorizing a Contract
Recommended Resolution:The Town of Rochester Town Board authorizes the Supervisor to initiate a contract with Peak Engineering, PLLC based on the proposal received for services provided to the Town during the review processes of the Granary Project (Economic Enterprise Overlay District Application) located at 2,4 & 8 Towpath Road. Peak Engineering, PLLC to supply specific review as to the completeness of the overall application and technical aspects (water, wastewater, stormwater, etc.) of the Environmental Assessment Form (EAF) in accordance with the State Environmental Quality Review Act (SEQR). This contract is subject to Attorney for the Town signoff on contract terms.


Q. Authorizing Advertisement of Sealed Bids
Recommended Resolution:The Town of Rochester Town Board authorizes the Supervisor to advertise seeking sealed bids for radio equipment monthly rental and airtime leasing for the Town of Rochester Highway Department, subject to the following specifications. Sealed bids shall be received by mail or in person due on or before August 1, 2022 at 3pm at Town of Rochester Town Clerk, 50 Scenic Road, PO Box 65, Accord, NY 12404. No emailed bids will be accepted. Bid must include a non-collusion bidding statement, or will be rejected.
The bid notice to be advertised on the NYS Contract Reporter website by the Supervisor.
The Town Clerk to post legal notice of advertisement.

A total cost for the 60 months should be made as part of the proposal. Priciing should be for a 60 month duration, invoicable monthly, including any setup, maintenance, or pricing escalation costs.

Models indicated are the current system in use by the Town. Specific models of equipment proposed must be included in proposal submittals. Alternatives which are certified comparable or better to the Motorola make and model may be proposed.
