ZBA Minutes August 11, 2009

Minutes of August 11, 2009 of the Town of Rochester Zoning Board of Appeals, held at the Town Hall, Accord, NY.

 

Meeting was called to order at 7:00 PM by Chairman, Brian Drabkin.

Chairman Drabkin noted that the Alternate would sit on the Board in place of Ms. Knudsen, Board Member, who was absent.

 

ACTION ON MINUTES

 

Board Member, Mr. Kingston, motioned to accept the June 9, 2009 minutes. Seconded by Board Member Kawalchuk.  All members present, in favor.

 

NEW APPLICATION PRESENTATION
ROBERT HULL–    AV for side yard setback for 2 car garage, 485 Stony Kill Road, Accord, Tax Map # 76.4-3-57, R-1 District

 

Mr. & Mrs. Hull were present on behalf of their application. They presented letters from bounding owners, David and Edith Short, Ronald and Lisa Hull, and Chris Cilenti, all in favor of the variance, all noting that it would be a nice addition to the property. Applicants noted that they were requesting a 20’ Area Variance on their side yard setback to construct a garage. They presented photos to the Board explaining that their septic system and leach field are next to their house and this is one reason they need to build the garage where they are proposing. The Leech field drains in the back and down below it is very wet in general. He staked out where the garage would be on the property. They weren’t proposing to attach the garage to the house- they have a basement garage under their home and if they attached it, this would prevent them from utilizing the basement garage.

 

Mr. Kingston questioned how many cars the applicants had.

 

Mr. Hull noted that they have 5 cars—they have 3 grown boys who drive and need storage.

 

Chairman Drabkin noted that they need a variance to build this garage—it doesn’t matter why they want to build it.

 

Mr. Kingston noted that he understood, but he was just curious.

Mr. Hull showed a rendering of how the garage would look.

 

Vice Chairperson, Haugen De Puy questioned if they were putting electric in the garage?

 

Mr. Hull noted that in the future they would, but not now.

 

Mr. Kingston noted that it would need to be inspected by a Fire Underwriter.

 

Chairman Drabkin questioned if anyone would motion for a Public Hearing?

 

Vice Chairperson, Haugen De Puy motioned to schedule a Public Hearing on September 8, 2009. Seconded by Board Member Kawalchuk. No discussion.

Chairman Drabkin noted that the Applicants needed to turn in their application by the 13th of August.

 

Mr. Kingston noted that he would like to do a site visit.

 

Mr. Hull noted that he would be home by 1:30PM everyday for anyone who wanted to stop by.

 

Chairman Drabkin questioned if anyone would motion for adjournment?

 

Board Member Kingston motioned to adjourn the meeting seconded by Board Member Kawalchuk. No discussion. All members present, in favor.
