The November 26, 2019 Audit/Workshop Meeting at 6:00pm at the Town of Rochester Town Hall.

Audit for abstract 11-2019 was held at 6:00pm.

The Workshop meeting began at 6:35pm

A Motion was made by Councilwoman Haugen-Depuy to approves payment of Abstract 11-2019 in the amount of

General Fund $ 74,908.77
Highway Fund $ 44,709.01
Street Lighting Fund $ 403.42

DISCUSSION:

IT QUOTES:
Go Fast Computers, Cyber guardian, PCA( Professional Computer Associates), Hudson Valley IT Services (was removed from the discussion.)

The Town Board had a lengthy discussion regarding the IT Consultants. The Board members were asked to review the quotes any questions please bring before the Board at the next Town Board meeting.

COMMUNITY COMPOSTING:
The composting 6 month contract ends this weekend at $ 139 per month. The RRA is charging $20 per ton. It was agreed to not renew the contract with Community Composting.
Resolution # 264-2019:
A Motion was made by Supervisor Baden to not renew the contract with Community Compost and authorize the Town Supervisor to purchase 2- 35 gallon containers and that we will utilize the UCRRA services.

PAYMENT OF VACATION TIME REQUEST:
RESOLUTION # 265-2019:

A Motion was made by Councilwoman Fornino;

Whereas, Highway Department employee Jeffrey Frey, is employed in the job title of Working Supervisor; and

Whereas, Jeffrey Frey, being duly elected by the voters of the Town of Rochester, is the Highway Superintendent-elect for the Town of Rochester beginning his elected position on January 1, 2020 and will be offering his resignation as Working Supervisor effective December 31, 2019; and

Whereas, a collective bargaining agreement (CBA) exists in force between the Town of Rochester and the International Brotherhood of Electrical Workers Local 363; and

Whereas section 8.2.4 of said CBA addresses the accumulation of vacation leave credits; and

Whereas, section 8.2.5 of said CBA allows for an annual buy-back of vacation leave credits up to 96 hours per calendar year; and

Whereas Jeffrey Frey has already utilized the buyback of 96 hours of vacation leave credits in 2019, and

Whereas the Town Board has received written request from Jeffrey Frey to utilize section 8.2.5 of said CBA to allow further buyback of 80 vacation credits in 2019; and

Whereas, the Town Board recognizes these vacation leave credits will be made available to Jeffrey Frey upon his resignation on December 31, 2019; and

Therefore, the Town Board authorizes the waiver of section 8.2.5 of the CBA; and further
Authorizes the Supervisor to enact a buyback of 80 hours of vacation credits from Jeffrey Frey immediately.

A Motion was made by Councilwoman Fornino;

Whereas section 8.2.4 of said CBA addresses the accumulation of vacation leave credits; and

Whereas, Jeffrey Frey, at resignation, will have accrued vacation leave credits in excess of the CBA; and

Therefore the Town Board authorizes the Supervisor to make payment for all vacation leave credits upon receipt and execution of resignation.

PAYMENT OF SICK TIME:
Resolution #267-2019:

A Motion was made by Councilwoman Haugen-Depuy;

Whereas, Highway Department employee Jeffrey Frey, is employed in the job title of Working Supervisor; and
Whereas, Jeffrey Frey, being duly elected by the voters of the Town of Rochester, is the Highway Superintendent-elect for the Town of Rochester beginning his elected position on January 1, 2020 and will be offering his resignation as Working Supervisor effective December 31, 2019; and
Whereas, a collective bargaining agreement (CBA) exists in force between the Town of Rochester and the International Brotherhood of Electrical Workers Local 363; and
Whereas section 8.3.8 of said CBA addresses sick leave credits at termination of employment; and
Whereas, Jeffrey Frey was in employment prior to January 1, 2004 and is resigning to take elected office as the Highway Superintendent prior to retirement; and
Therefore the Town Board authorizes the Supervisor to offer the cash out of 25% of Jeffrey Frey’s sick leave credits upon receipt and execution of resignation.
