The Town Board Meeting was held on June 4, 2009 at 7:00pm at the Town Hall.

Supervisor Chipman opened the meeting and Ed Lamon led the Pledge of Allegiance to the Flag.

CORRESPONDENCE RECEIVED:
Supervisor Chipman read a letter from Wilma DeJager on behalf of the Rochester Food Pantry regarding the number of people they help. There is a 71.4% increase since last year. They do a wonderful job providing food to residents and neighbors, and asked the Town for their continued support.
SUPERVISORS UPDATE:
Supervisor Chipman said he will meet with Barry Medenbach, Engineer and Eric Eck on 6/9/09 at 10:00am regarding the FEMA project.
LITTER SURVEY:
Supervisor Chipman received a letter from the County stating that the Town of Rochester is one of five towns that has been chosen (after completing a survey) for a County road clean up.
LEGAL MATTERS:
Attorney Christiana met with Assessor Stokes and also met with a representative for Tri State Capital Group, Inc. re: their Notice Of Petition.
TRI STATE LITIGATION:
RESOLUTION #77-2009
A Motion was made by Councilwoman Archer that the Town Board accept the offer of Tri State Capital Croup, Inc. to settle the lawsuit. It was agreed that the assessment for 2008, 2009 and 2010 will be $454,000.00.

LIAISON/COMMITTEE REPORTS:
The Councilpersons gave a synopsis of the meetings they attended.
Councilwoman Archer on behalf of Councilman Spano reported that wood and pellet stoves installed increased from 24 to 54 permits.
WOOD/PELLET STOVE PERMIT FEES WAIVED:
RESOLUTION #78-2009
A Motion was made by Councilwoman Archer that the Town Board continue to waive the permit fees on wood and pellet stoves until 4/30/2010.

A Motion was made by Councilwoman Michailescu that the Town hire John
Capello for the SEQR review for the proposed ???? at $225.00per hour.

PUBLIC HEARING SCHEDULED FOR PROPOSED FLOOD DAMAGE PREVENTION LOCAL LAW:
RESOLUTION #81-2009
A Motion was made by Councilwoman Archer that a Public Hearing be held on 7/2/09at 7:00pm at the Town Hall re: proposed Local Law/Flood Damage Prevention, with the Town Board Meeting immediately following, and further authorizing the Town Clerk to advertise same.

PUBLIC COMMENT:
Highway Superintendent Kelder explained the reason Town Trucks were on Franklin Lane and why sand mines, etc have not be locked. He agreed to look into securing the sites.
Supervisor Chipman will meet with Rest Alarms re: a camera being set up on Town property.
A resident asked if the proposed Flood Damage Local Law will replace the current Flood law. He was told yes.
