MINUTES OF  September 18, 2007 REGULAR MEETING of the Town of Rochester PLANNING BOARD, held at the Town Hall, Accord, NY.
 
Meeting was called to order at 7:00 PM by the Chairman, Steven L. Fornal.

HOMELAND TOWERS, LLC–   c/o Snyder and Snyder, Special Use Permits/ Site Plan Approvals for 100 Airport Road (Property owned by Town of Rochester, Tax Map #69.3-2-37, R-1 District) and Route 209 (Property owned by Town of Rochester, Tax Map #76.1-3-17, R-1 District), for wireless communication facilities consisting of 150’monopole within 3,000 square foot compound on each site   

 

Robert Gaudioso of Snyder and Snyder and Manny Vicente, President of Homeland Towers were present on behalf of the application.

 

Mr. Johannessen was given the floor and noted that he will prepare Part 2 of the EAF after the next review of revised information from Homeland Towers. He also noted that the applicant has indicated that the Visual Addendum w/Visual Representations of tower appearance will be forthcoming in the next week or so. In respect to the Site Visit from September, he requested that the applicant provide DEC stream to be shown on the map. (He noted that this has been included in their latest submittal.) He also requested that they show limit of disturbance, which the applicant agreed to. He noted that the maintenance of the road will have to be developed with the Town Attorney’s assistance as nothing was included in the lease. Existing access will be maintained by town; new by Homeland. The applicant needs to update Boundary Survey to show “wing” that isn’t shown on current map. Grading is to be shown on new maps. Color options: Visuals will show galvanized gray and brown. The compound will be gravel surfaced. He continued and the applicants agreed that the structural drawing will be forwarded to Chazen at building permit stage. The structural Engineering report will be forwarded to Chazen at building permit stage also. Floor plans for actual facility will be at co-location stage with Site Plan review required for each co-location of new antenna. Regarding comment #13– Visual Analysis Methodology has been satisfied. Regarding signage—it will be added to the plan with the co-locators’ signage sized at code specifications. And  the Driveway profile will be at building permit stage.

 

Mr. Ricks questioned setbacks being at only about 41′ and 79′ but the pole is 150′?

The applicants noted that the setback was waived by Town Board.

Mr. Ricks noted that the Town should have that closest property line (Eastern most line)~surveyed.

 

Mr. Gaudioso stated that he will have that checked. DeSantis says sure that line was surveyed but will double check.

Mrs. Carney noted that the profile at the Airport Road site shows 20% grade. The Board can’t waive that. They’ll need to minimize that grade to something less steep.

 

The applicants responded that they will attempt that. These access roads are only to be used once a month, if that.

Mr. Johannessen discussed the potential of lowering the tower 30-35 feet.

 

The applicants noted that they have discussed this with the tech people. That will definitely degrade signal strength and they don’t believe that is what town wants out of this application.

Mr. Tapper questioned if both towers were about the same height?

 

The applicants noted that the Airport Road Tower is at 414′ and the 209 is at 372′.

Mr. Johannessen also mentioned about a grass swale at the Airport Road site to help prevent any runoff of water into landfill site.

Mrs. Carney motioned for an Unlisted Action under SEQRA with an Uncoordinated review. Seconded by Mr. Ullman. No discussion.

The applicants questioned about the neighbors within 1500′ being notified? Also, how many days prior must be published?   

 

The Chairman noted that they would look into this and call Mr. Gaudioso with the information.  

 

Mr. Gaudioso also asked about any state/federal preserves with views. Were Mohonk or  Palisades included in this?  

 

Mr. Johannessen noted that he would be in touch with the applicant regarding this.

Chairman Fornal requested that the applicant submit their waiver request for highway profile at the Route 209 site in writing.

 

ACTION ON MINUTES

Mr. Tapper noted that the August 21, 2007 minutes needed 2 corrections that he had already spoken to the Secretary about.

 

Mrs. Carney made the motion to approve the August 21, 2007 minutes w/changes. Mr. Tapper seconded motion. All in favor.

OTHER MATTERS

 

Mr. Ricks said that he mentioned to the Secretary about an escrow letter for Taroh Holdings misidentifying Dawson at heading.

 

Chairman Fornal motioned to adjourn the meeting. Seconded by Mr. Tapper. All members present in favor.
