MINUTES of the July 15th, 2021 Town of Rochester Zoning Board of Appeals, held via Zoom and Livestreamed on Youtube.

Chair Psaras called the meeting to order at 6:00PM.

Chair Psaras did roll call.

ALSO PRESENT:; Mary Lou Christiana – Town Attorney

Ms. Vinton to participate in the meeting to establish quorum.

APPLICATIONS:

EXISTING APPLICATION:
21/049 AV – John Sturges
Area Variance
442 Tow Path

– Parcel is in the R-2 zoning district
– Parcel is +/- 1.7 acres
– Applicant proposes erection of a single-family residence
– Applicant does not meet the 100’ setback from the high-water mark
– Proposed structure is +/- 70’ away from the high-water mark
– Applicant would need a +/- 30’ variance

Mr. Sturges was present on behalf of the application.
– Revisions made – deck and porch added to map
– Deck will face stream, porch will be screened-in (32’ x 10’)
– Discussion regarding combining the two lots with a lot line adjustment
– Mr. Sturges stated he would like to level the neighboring lot with soil to help with flooding and promote renaturalization
– ZBA included the following revisions that need to be made
o Full dimensions of building included on map
o Check setbacks from the road
o Side yard setback and setback from stream now that deck/porch have been added.

Chair Psaras made the motion to have the Board Secretary schedule the public hearing contingent on receiving appropriate documentation of measurements by 8/5. Seconded by Mr. Wassell.

All in Favor. Motion Carried.

Accepting the regular meeting minutes of, June17th, 2021:

• Mr. Fischer made the motion to accept the meeting minutes of, June 17th, 2021. Mr.Wassell seconded the motion.

• Chair Psaras reminded Board members to submit training records to the ZBA Secretary.
