MINUTES of the November 16th,2023, Town of Rochester Zoning Board of Appeals, held via Zoom for Public Comment and Livestreamed on YouTube.

Chair Zurofsky called the meeting to order at 6 PM.

The Board Members stood for the Pledge of Allegiance.

Chair Zurofsky did roll call attendance.

Member Charlie Fischer

ALSO PRESENT: Attorney Mary Lou, Code Enforcement Officer Will Farrel

APPLICATION REVIEW:

ZBA 2023-06 AV
Friendly Acres Homeowners Association
S/B/L 76.3-3-22.900 – 708 Granite Road

The board requested the attorney, a representative from the code enforcement office, and the applicant attend. Chair Zurofsky explained who was in attendance as well as why. Mr. Farrel explained that the town received a complaint of a tiny home being built in the woods, they went to the sight and discovered it was parked on vacant land and a citation was given due to it being against town code. The board discussed with Mr. Farrel as well as Mary Lou the possible variances the board could grant the applicant so they could keep it there as well as what codes are being violated. Mr. Farrel explained that it would need to be on a slab which means the applicant would need a building permit as well as a zoning permit. Chair Zurofsky discussed with the applicant about what was explained by Mr. Farrel. The board explained that they can amend the application based on the conversation. Chair Zurofsky told the applicants that they will need to submit a new variance application to the code enforcement office.

OTHER MATTERS:

• Review/approval of 2024 Meeting Dates
Member Davis made a motion to adopt the 2024 calendar dates. Member Haugen 2nd the motion. All in favor 4 yes, 0 no, 0 abstain.
• Training hours must be turned in by 12/30/2023.
The board discussed if they need to do more trainings. They agreed to check in with the secretary and find out if they need to do more.
ADJOURNMENT:
Chair Zurofsky made a motion to adjourn at 7:05PM. Member Davis 2nd the motion. All in favor 4 yes, 0 no, 0 abstain.
