MINUTES of the December 21st, 2023, Town of Rochester Zoning Board of Appeals, held at 6:00PM at the Harold Lipton Community Center and streamed live via YouTube.
Chair Zurofsky called the meeting to order at 6:00 PM.
The Board Members stood for the Pledge of Allegiance.
Secretary Wilhelm did roll call attendance.

ZBA 2023-07 AV- Henry Hershkowitz
S/B/L 68.2-2-31 & 68.2-2-38.112 – 14 Bakertown Road & 15 Bakertown Road
Applicant proposes conveyance of +/-.31 acres from 15 Bakertown Road to 14 Bakertown Road. The idea is to take the garage currently on 15 Bakertown Road and add it to 14 Bakertown Road. Setbacks have been met, however each new lot created would need to be a minimum of 2 acres per the TOR Schedule of District Regulations which is not possible in this case. Applicant is requesting an area variance to waive the minimum acreage requirement.
Chair Zurofsky explained the application. Chair Zurofsky made a motion to set public hearing for January 18th, 2024, meeting. Mr. Fischer 2nd the motion. All in favor, 5 yes, 0 no, 0 abstain.
New Applications:
ZBA 2023-08 AV – Alix Umen S/B/L 76.1-2-42.200 – 227 Boicemill rd.
Applicant proposes a carport, does not meet front yard setback requirement per the Town of Rochester Schedule of District Regulations and would need an 8’ variance.
The applicant’s representative explained the need for a variance. The board discussed with the applicant’s representative the need for more measurements and a sketch plan showing those measurements. Chair Zurofsky made a motion to set public hearing for the January 18th, 2024, meeting. Mr. Fischer 2nd the motion. All in favor, 5 yes, 0 no, 0 abstain.
OTHER MATTERS:
Mr. Stephens made a motion to open the meeting to speak with Mr. Sturges. Chair Zurofsky 2nd. All in favor, 5 yes, 0 no, 0 abstain.
Mr. Sturges thought he had submitted an application to the zoning board of appeals for a fence but he had not, he had only submitted to the building department. Secretary Wilhelm will check with the building department to see if his application will be coming in front of the Zoning Board or not.

Mr. Davis made a motion to approve the 11/16/2023 meeting minutes. Chair Zurofsky 2nd the motion. All in favor, 4 yes, 0 no, Mr. Stephens abstained.
