Grant Updates
NY Rising – Alligerville Firehouse, Harold Lipton Community Center:
-Alligerville: all final invoices have been signed and submitted, expected to be 100 % complete by summer. Planning for an open house in March.

BridgeNY – Boice Mill Road Bridge: Bids will go out in the Spring and will be completed by the end of the year.

LGRMIF – Building Dept./Code Enforcement record conversion: the conversion has been complete and hoping to have final paperwork completed in the next couple of months.

HIGHWAY SUPERINTENDENT REPORT:

Supervisor Baden thanked the Highway workers for all their work on recent snow storms.

DEPARTMENT UPDATES/ LIAISON REPORTS:

Councilwoman Enouen: Please don’t be outside too long this weekend.
CEO: the boxes of files have now been filed. Thank you and a great job to Alyssa. For the month of January 11 CO’s, 27 permits, 21 misc permits, 6 municipal searches.
Transfer Station: Eager to do improvements. Trailers have been cleaned out by Justin. Want to prioritize the door issue. Supervisor Baden stated the end of the month the recycling report is due.
Planning Board: we have a new Town Planner David Church. CPL will finish up projects they were working on.
ECC: held their meeting at Rochester 2 firehouse focus was promoting turning your lawn into pollenators. Working on getting a second bench from the plastic bags event. The Board had a quick discussion on quorm.

Supervisor Baden: Constabulary: Supervisor Baden and Town Board Members,
The Constabulary answered 16 direct calls for service and other duties in January of 2023.
These included:
• 12 Neighbor to Neighbor and Quality of Life Complaints
• 4 Resident Traffic Complaints (Whitfield Rd, Rochester Ctr,, Samsonville Rd., Main St. )
• 2 Environmental Complaints, (Whitfield Rd, Rochester Ctr.)
• 4 New Building Department Violations
• 0 New Court Cases Opened
• 9 Court Proceedings Remain Open
• 0 Court Proceedings Closed
Interesting Occurrences:
In January, resident’s complaints have decreased slightly overall. Short term rental properties continue
to generate many complaints, especially on Friday’s and weekends. Mainly they generate complaints
regarding, trespassing, loud noises, road/driveway blockages and household trash dumping. We continue
to work with the building department on those issues. We received a call regarding two individuals
entering a dangerous condemned property. Upon further investigation it turned out to be a charity that
was going to remove furniture and items from the property. Unfortunately, the building is unsafe and
they understood the danger and left without incident. Neighbor to neighbor complaints have increased
slightly this month and all have been defused without further action necessary.
Recreation Dept.: Basketball Program: 180 participants. There was an issue with vandalism outside of building during the basketball timeframe. We met with the Principal of the school and it was agreed to have everyone sign a code of conduct and Mike Smith gave a statement at the program and we are going to work on being better neighbors. We will replace any nets that were damaged. In lieu of Line dancing we have a intro to embroidery class taking place with Carol Metsger. St. Patrick’s Day Luncheon will take place on 3/17/23
Assessor’s office: we are reviewing and approving exemptions as they come in. Joanne has started reaching out to property owners who have not submitted their exemptions. We are reviewing and entering building permit , C of C’s and C of O’s, as the come in. We continue to work on processing, issuing 911 addresses when requested, dealing with many address changes triggered by the Town and County tax bill. We are taking photos, sketching and inspecting new construction, renovations, additions, ect. We are working on placing value on new construction for the upcoming 2023 assessment role. A second notice notifying property owners of the senior exemption was sent via postcard.

Councilman Coleman: ZBA: nothing new to report. Spectrum: The Board will take a pause and aren’t ready to move forward with the increased prices. Looking to the State and County for tips. Fire/EMS: Spoke briefly with the new Chief but he was in a fire call so I will get back in touch shortly. I’ve spoke with Peter Nelson and John Dunning regarding new policies and possible exemptions. EMS: KFAS: thank you for the full coverage! High Falls: I spoke with Joe Vitti and have some feed back to be considered for the contract.

Councilwoman Smiseth: Eldercare: no news is good news. Housing Committee: had our first meeting all went well next meeting is 2/21 6-8pm.

TOWN BOARD MEMBER TIME- OTHER MATTERS:

Councilwoman Smiseth: Happy Black History month.

The Board discussed purchasing of constabulary body armour. In the past the constables purchased their own gear but it’s very expensive. It was agreed to investigate further and looking into grants and state bids as well.

The Board discussed the purchase of the excavator. Supervisor Baden stated that he spoke with Highway Superintedent Frey on the purchase of the excavator and that it’s actually a budget positive because he eliminated vehicles. The Excavator is 20 years old and needs repairs this will allow 2 crews to ditch at the same time.
Councilman Coleman asked that Highway Superintendent attend meetings when he requests things and Councilwoman Enouen Agreed.

Discussion: Supervisor Baden stated that he spoke with Jeff today and budgeted was a 1 one ton dump truck and pickup , he would like to swap for the excavator. This would replace a 20 plus year old machine and saving $ 110-115,000.00.

The Town of Rochester Town Board authorizes purchase of a 2023 New Holland E57C Mini Excavator from Westchester Tractor Inc., 60 International Blvd., Brewster, NY 10509 in the amount of $90,702.27. This purchase is being made utilizing the Sourcewell bid and will be 100% reimbursable from 2023-2024 NYS CHIPS funding.

JOIN THE ULSTER COUNTY HOUSING SMART COMMUNITIES INTERACTIVE:

WHEREAS, the Town of Rochester believes that rising housing and rental costs and a lack of diverse housing opportunities for all community members pose a significant challenge to the members of our community; and

WHEREAS, affordable housing is defined as housing in which the occupant is paying no more than 30% of monthly or annual income for housing costs, including utilities; and

WHEREAS, ensuring there are affordable housing options for all community members is a key responsibility of the elected officials of the Town of Rochester and a critical component of creating a healthy, sustainable, and prosperous community; and

WHEREAS, rising housing and rental costs and a lack of diverse housing opportunities for all community members is in part due to the demand for housing far exceeding the supply of new affordable and workforce housing being developed in the community; and WHEREAS, a long-term commitment by the Town of Rochester to review and approve new affordable and workforce housing projects is a critical strategy for ensuring there are affordable housing options for all community members; and

WHEREAS, working toward housing solutions is a priority for the well-being of the local residents, the economy, and community sustainability; and

WHEREAS, we believe that our response to housing challenges provides us with an opportunity to improve housing opportunities and community wellbeing for all community members, and to build livable, affordable, and housing-smart communities,
IT IS HEREBY RESOLVED that Town of Rochester, in order to meet local housing needs, adopts the following commitments as part of joining the Ulster County Housing Smart Communities Initiative. This commitment includes completing the following six steps:
1) Join the program through adoption of this resolution and begin engaging with the community
2) Designate Councilwoman Charlotte Smiseth as Housing Smart Community coordinator to serve as liaison between Ulster County and the Town
3) Reaffirming the adoption of Resolution 221 of 2022, establishing the Town of Rochester Housing Advisory Committee.
4) Register for participation in the program on the Housing Smart Communities Initiative website
5) Establish a community outreach and educational campaign on the importance of developing a range of housing options
6) Begin implementing a prioritized set of the Housing Smart Actions included in the program

ESTABLISHMENT OF AGRICULTURAL ADVISOR COMMITTEE:

WHEREAS, the Town Board of the Town of Rochester (Town) recognizes the importance of agriculture and agricultural related enterprises as vital to the Town’s economic base and in protecting and preserving the Town’s rural character through the use and management of the Town’s natural resources for farming and farming related enterprises and practices, and

WHEREAS, the Town Board of the Town desires to establish an Agricultural Advisory Committee (“Committee”) for the Town of Rochester to advise the Town Board on issues, whether arising from within the Town or outside of the Town, that impact agriculture and agricultural related enterprises within the Town of Rochester and provide recommendations to the Town Board when appropriate, and

WHEREAS, the Town Board of the Town of Rochester desires the Committee to, in addition to their advisory function, work with the Town Board, the community, and other interested parties, to promote agriculture and agricultural related enterprises that are located within the Town of Rochester, now

THEREFORE BE IT RESOLVED THAT the Town Board of the Town of Rochester establishes an Agricultural Advisory Committee (hereinafter referred to as the “Committee”), which shall serve at the pleasure of the Town Board, and it is further

RESOLVED, The Committee shall consist of the following membership composition:
A. The Committee shall be composed of 7 members appointed by the Town
Board as follows:
1) Members shall be appointed from residents of the Town of Rochester. The Town recognizes that an effective Agricultural Advisory Committee is comprised of members from the agricultural community, including but not limited to: those engaged in agriculture or agricultural related enterprises such from the nursery, crop production, brewery/winery, agritourism, and dairy segments of the industry; those with an interest in small scale agriculture or hobby farming; and those with a background in agriculturally related organizations, industries or technical assistance programs
2) The Town Board may, notwithstanding any inconsistent provision of law, appoint up to two members to the Committee who are between the ages of 16 and 21.
3) The Committee shall designate the Chairperson.

B. The members appointed to the Committee shall serve for a three-year term. Upon
initial formation, 2 members shall serve for a one-year term, 2 members for a two-year term, and 3 members for a three-year term. Each year thereafter, reappointments or new appointments will be for three-year terms.

C. Members shall serve without salary.

RESOLVED, the Town Board of the Town of Rochester designates the following as the duties of the Committee, subject to revision from time to time at the Town Board’s discretion:

1) Review of proposed land use code changes. Whenever a proposed local regulation is presented to the Town Board that may affect agricultural operations or lands within the Town of Rochester shall be referred to the Committee for review. The Committee shall have 30 days to respond with a recommendation(s) for the actions(s).
2) The Planning Board may refer applications that might impact agricultural operations or lands to the Committee for comment. The Committee shall have 30 days to respond with a recommendation(s) for the actions(s).
3) Review land use policies, zoning, and legislation to make recommendations to the Town Board on how to encourage and preserve agriculture.
4) Advise the Town Board and, upon direction from the Town Board, the Ulster County
Agricultural and Farmland Protection Board, in relation to the proposed establishment, modification, continuation or termination of any county agricultural district. The Committee shall present objective advice to the Town Board relating to the desirability of such action, including advice as to the nature of farming and farm resources within any proposed or established area.
5) Complete and periodically update an inventory of parcels included within a certified ag district or being used for agricultural activities.
6) The Committee shall also work with the Town Board, the Rochester community, and other interested parties, to support agriculture and agriculture related enterprises that are located within the Town of Rochester.
7) Perform outreach to owners of agricultural parcels or who are engaged in agricultural activities as defined by Town Code to provide information about federal, state, and local agricultural resources.
8) The Committee shall be subject to Public Officers (PBO) CHAPTER 47, Article 7, Open Meetings Law. Minutes shall be prepared Filed with the Town Clerk.
9) The Committee shall meet as determined necessary, scheduled two weeks in advance and noticed as required by NYS law by the Committee but no less than quarterly.
10) The Committee shall submit to the Town Board an annual report of the activities of the Agricultural Advisory Committee no later than December 31 of each calendar year.

And it is further,
RESOLVED, that upon filing with the Clerk and appointment of members by the Town Board the Committee shall schedule a public meeting within 30-days to establish its rules of procedure and conduct business as deemed appropriate by the Committee members.
