ATTORNEY FOR THE TOWN REPORT:

Attorney Christiana stated that she is still working on the Hoots appeal of the ZBA decisions and sometime in the Spring or Summer the appellate division will give the Town a date for oral agrument, planned training in February for Planning and Zoning, working on a lot of applications before the Planning and Zoning board of Appeals.

TOWN CLERK/ TAX COLLECOT REPORT:

Town Clerk: the month of January 36,493.03 was collected. Tax Collection: $ 5,207,903.83 was collected. The tax warrant to the Supervisor has now been met.

HIGHWAY SUPT. REPORT:

The Highway Dept. has been out a number of times this season, currently getting ready for the upcoming storm. We will discuss the BridgeNY update during the Supervisor’s update.

SUPERVISOR’S UPDATE:

COVID-19 report: 73 % UC residents are vaccinated, 890- active cases with 361 fatalities. In the Town of Rochester we have 36- active cases a total of 8 fatalities.

Grant Updates:

NY Rising – Alligerville Firehouse, Accord Community Center: we are getting closer to closing out and completing this project.

BridgeNY – Boice Mill Road Bridge: will have a meeting next week on the next steps. Going before the UC transportation council. Hoping to have a vendor in the next few months.

LGRMIF – Building Dept./Code Enforcement record conversion: there is a resolution in tonights meeting approving the contract. The criteria has finally been satisfied with NYSID.

Local Champions Followup: Local Champions grant that we received last year that Madeline Russo was able to attend classes and seminars on the Town’s behalf. Supervisor Baden did a follow-up interview a few weeks ago with the people who provided the funding regarding how the process is working. Future funding may become available for other type of projects.

Employee Yearly Evaluations: we’ve talked a number of years of holding these. Our HR liaison can coordinate with our Human Resource Consultant Michael Richardson to get the ball rolling again.

OSI Rail Trail Project: OSI is working on finalizing the funding through the County for rehabilitation to the
O & W Railtrail. Accord/ Kerhonkson upgrades to ditching and trail is to begin in the next few months. OSI will be providing insurance information to the Town and will have Attorney Christiana involved to review everything that needs to be complete. Bob Anderberg from OSI will be attended the meeting for the 16th to discuss it further with the Board.

Insurance coverage for RailTrail Volunteers: Supervisor Baden spoke with the Town Insurance Rep and it was clarified that the Town’s volunteer policy would not cover those working on the rail trail. Other options are being explored for us for when people are working on the trail using equipment and tools. Councilman Coleman asked if the volunteers at the “TORE” are covered and it was verified that indeed they are covered. The issue is liability increases when someone is using a chain saw or maintenance on the trail.

DEPARTMENT UPDATES/ LIASION REPORTS:

Councilman Coleman: EMS/Fire District: I have been in contact with members of both the Fire Co. and KAFAS and in the process of figuring out times when we can get together to discuss ways to coordinate with the Town. I want to highlight the amazing work that these organizations do for the community, I am looking forward to working with them in the future.
Spectrum /Broadband: I’ve reached out to our POC’s there and working to try to get some more information from them about the availability of cable and broadband services in town. I’m still waiting to hear back from them to see if we can get a better understanding of where the current coverage gaps are and working on updating some existing maps that members of our Town have made previously aboust some areas where we know that theres no coverage. I ask that residents that know areas that do not have coverage please reach out to me and let me know . I’ve been reviewing the franchise agreement that is going to be up for renegotiation soon so the more information we have from people about whether or not they have service will help us in the process.

Councilwoman Enouen: Transfer Station: waiting for the purchase of new computer. Many have reached out about false information on the website. After a little investigating, it was discovered that Google had the wrong information not our website. CEO: approximately 10-11 short term rentals have been submitted.
ECC: I have attended the UC Climate Smart Committee meeting. Discussion of Arbor Day tree planting funding.
Watershed park: there have been questions asked regarding the ECC having access to the trail to do work. Former Councilman Hewitt turned the maps over and with this being a project in the process we need to decide what we are going to do moving forward. The ECC also has open vacancies.

Town Clerk Gundberg: HPC: The HPC is looking to do a Historic Barn tour spear headed by Harry Hanson which I thought would be a great idea to incorporate a farmers market at the Town park and information on the 10 Historic Farmsteads and hopefully we can get some of the local farmers involved, maybe have some music and a food truck. They are also looking to promote the Palentown School a little more and look for grants that may help with the restoration of the building. They discussed ideas of preservation rewards to give out at Heritage Day.

Councilman Paddock: Recreation Dept: an upcoming community trip to the Casino scheduled for 2/18/22. Basketball program is running smoothly.Constabulary report: Court is mostly open. The Constabulary answered 19 direct calls for service and other duties in January
of 2022.

Interesting Occurrences:
Happy New Year! In this first month of 2022 we received increased complaints from residents regarding
many issues. Traffic complaints took a significant upturn for both driving and parking issues. Of special
note are complaints regarding abandoned cars. Due to the inclement weather there has been a rise in
road accidents, especially vehicles sliding off the road. Garbage dumping complaints have increased
again. Neighbor to neighbor complaints have increased. There is an ongoing case regarding an alleged
abandoned dog in an outdoor cage with inadequate food, water and shelter. Neighbors have been making
sure it is fed and has water. We are working with our Dog Control Officer and the Ulster County SPCA
to rectify the situation and protect the animal. As always, due to the COVID-19 pandemic and the rise of
its variants, we continue to have limited direct contact with complainants with a proportional increase in
direct phone calls
Councilwoman Smiseth: no housing committee has been created yet starting the ground work for the wording.

TOWN BOARD MEMBER TIME:

Councilwoman Enouen asked what are the protocols for other types of gathering for the Town of Rochester. We have in place the policy regarding the meetings. The Town of Rochester exchange would like to have a meeting with the volunteers.
Supervisor Baden stated that numbers are dropping we can revisit this at the workshop meeting on the 16th and see where to go from there. Currently we still have the exercise classes going with protocols in place.

Councilman Coleman stated there is a concern about ongoing issue with Central Hudson and Nexamp sent out notification that they too will be going to estimated usage. I don’t feel great knowing that there are two companies estimating what my electricity usage is so I understand peoples frustrations. It seems like some people have had luck with going to the New York State Public Service Commission, so if people are trying to resolve issues with Central Hudson and can’t get through to them they may want to try contacting the New York State Public Service Commission I know they were helpful with me working through another issue in the past. And if other people can’t resolve it please reach out to me.

A Motion was made by Councilwoman Smiseth on request by the Building Department, the Town of Rochester Town Board authorizes the Town Supervisor to refund fees to Shlomo Avi-No’am for Building Permit application 21/680, dated 12/03/2021 in the amount of $237.80. The application was withdrawn and no action was taken by the Building Department.

The application has been changed to Major Subdivision and the accompanying fee has been paid in full.

AWARD OF AND AUTHORIZATION TO SIGN A CONTRACT:
Resolution # 104-2022:

A Motion was made by Supervisor Baden that the Town of Rochester Town Board awards a contract to purchase record conversion services for building and code enforcement office records from NYSID.
Instream LLC is a NYSID preferred vendor and is has been preapproved for the contract with the Town. Total pricing $49,969.28. This contract is made as part of the awarded 2021 Local Government Records Management Improvement Fund (LGRMIF) grant. The Town Supervisor is authorized to sign a contract in accordance with service delivery agreement presented and the quote accepted from NYSID in accordance to the terms of the grant award.

Discussion: Attorney Christiana stated that she looked over the contract and it gives a lot of the terms that we want but I doesn’t give everything, I am not satisfied with it as far as completeness for example it will start in February and will continue until completion of the project but we only have until June 30th, so there are things that need to be added in there to match the grant and NYSID quote that they gave us. It’s important to make sure all the terms are in there. There’s a couple holes in this and we don’t want any holes.
Councilman Coleman stated that he agreed had some things that he would like to see in the contract. One was there an estimated completion date? Are there any check points or kind of deliverables where they provide us data or is it just they provide us one big push at the end? Are we handing them all the records at once or we doing that piecemeal.
Supervisor Baden stated its being done in two pickups half now and the other half in 6-8 weeks, returning them all in one swoop. Information will be delivered at one time. Paper records will be returned. The end date is a hard end date do to the terms of the grant and they are aware of that.
Councilman Coleman: so that will be added to contract or statement of work. I think it would be great to have a spot check or be able to see a few scanned documents so they don’t just hand us everything and we notice that this isn’t what we wanted. It says that Instream is adequately insured, I don’t know if we have seen their insurance.
Attorney Christiana agreed with Councilman Coleman’s questions and the fact the contract needs to be more definite and their insurance version may not be as adequate as ours so I would want us to review that as well.
Supervisor Baden stated that much of it is outlined in the initial scope of the project.

Whereas, This purchase is made as part of the awarded 2021 Local Government Records Management Improvement Fund (LGRMIF) grant.
Whereas, LGRMIF grant funding requires the vendor to be M/WBE certified.
Whereas, The original quote was secured in 2019 via a company thought to be eligible and found to be noneligible.
Whereas, Six requests for quotes were emailed to M/WBE compliant vendors found on the NYS list.
Whereas, Intivity is the only vendor who replied with ability to supply the product
Whereas, $7,160 has been appropriated in the 2022 budget.
Therefore, The Town of Rochester Town Board awards a contract to purchase from Intivity, 106 Despatch Dr. Suite 2, East Rochester, NY 14445, specifically
(1) Epson SureColor T5270 Single Roll Edition Printer,
(1) MFP Scanner (LFP) for SureColor T5270 and T5270D Printers SureColor 36 Color MFP Scanner,
(1) labor, setup, accessories, orientation,

APPOINTMENT OF ASSESSOR AIDE:
Resolution # 106-2022:

A Motion was made by Councilman Paddock that the Town of Rochester Town Board appoints Joanne Faerber to the position of Assessor Aide (provisional) at an hourly wage of $17.00 per hour for 35 hours per week, effective February 7, 2022, subject to approval by the Ulster County Personnel Department as meeting the minimum position qualifications.

Discussion: Councilman Coleman asked that the Board establish a policy to clarify any confusion by the process. I was under the impression that the subcommittee would narrow down the candidates but thought the Board would be making the final decision. I think the Board should have the opportunity to review the resumes prior to voting. Councilman Coleman asked that he still receive the resume of the recommendation.

PRESENTATION BY SUPERVISOR:

CIVIC PLUS WEBSITE PROPOSAL:

Supervisor Baden took the Board through the Municipal based website companies proposal. The Board agreed that they would like to see another comparison to match this quote and Board members will send the Supervisor questions or requests that they may have or would like to see in a proposal and Supervisor Baden would put something together by the workshop meeting.

DISCUSSION ITEMS:

Code Enforcement and Building Department 2022 fee schedule – Fire & Safety Inspections:
It was discovered that there is a discrepancy in the State and Town code and Town fee schedule that results in a conflict. Attorney Christiana is going to review it further and bring it before the Board on February 16th.

Planning Board 2022 Fee Schedule:
The Planning Board will discuss it at their meeting and bring it before the Board.
Request for Cliff Road Open Development designation – SBL 68.2-2-12:
The Applicant is looking for a yes or no to move forward with the open development however Attorney Christiana stated that this particular road is very difficult, a Road Maintenance Agreement would be required for the open development. Attorney spoke with the representative on the Road that the Board approved and the Represented more questions that would require a lot of research so they didn’t go any further in the discussion.

Currently Planning Board, ZBA and Town Board meetings are broadcasted on youtube. A resident asked why the HPC and ECC meetings weren’t . Supervisor Baden stated that these were volunteer boards and by having them stream it puts a lot of responsibility on them. Members of the Board agreed that they would like to see as many meetings as possible streamed but also know the difficulty of doing it. The Board agreed to wait until after the 15th to see if the Governors’s Executive order will be extended.

2023 Ambulance Improvement Districts Preparation:
Supervisor Baden stated that the agreement is to attempt by the end of 2022 to go into a Special district. If this was to happen it would be subject to permissive referendum and potentially we would need to go into negotiations with the County on the mapping of the districts. Attorney Christiana is going to start looking into the process and the Board will discuss it further at the workshop meeting.

Local Law – Establishment of Recreation Commission:
The Board agreed to table the discussion until the Workshop meeting.

Local Law – Solid Waste/Littering:
Supervisor Baden stated that there are options as to how we want to present this law. It can be a standalone or combined with our Solid Waste Law.
Some Board members agreed that a standalone may be easier to digest where others thought consolidating could be easier given the fact the Town Code is very long. Members will review the samples and discuss it further at the Workshop meeting.

Local Law – Accessory Dwellings:
Councilwoman Enouen presented the proposed law currently before the Town of Marbletown. The Board will discuss it further at the workshop meeting.

Department Job Duties Descriptions – Councilwoman Enouen:
Councilwoman Enouen would like to do an internal job duties description for employees. We currently have a job description from Ulster County Civil Service that can be a guide. Councilwoman Enouen stated that she would like to start with the Planning Board and ZBA secretary.
Supervisor Baden stated that this would be valuable, it’s not meant to be ultra specific, but a great idea to have generic activity outlined. We also need to run everything by Michael Richardson our Human Resource Consultant.
Councilman Paddock stated that if we decide to have employee evaluations we need to have employee standards and job descriptions will be helpful. People appreciate that.

Food Pantry Community Outreach:
The Food Pantry reached out to the Town to look for ways to find families in need of services and get the information out there. Both the Recreation Department and the Constabulary(elder-care) have been a part of check-ins for our seniors especially during covid. With HIPPA regulations it is difficult to get information on those in need to be a part of a outreach program. Some seniors are reluctant to reach out for services. The Board will continue to look into ways to help with the Community outreach.

Town of Rochester plumbing licensing requirement – Request from resident:
Supervisor Baden stated that he received a letter requesting the Town to look into licensed plumber requirements. Unfortunately the resident had a bad experience with a plumber and reached out to the Town Supervisor. The Board discussed whether there is a need to have a licensed plumbers list in Town like we have with the electrician list. The Board agreed that they are not ignoring the request but do not see the need on the Town level at this point.

Climate Smart Community Program:
We are a climate smart community we just need to establish a call for a committee and we have to figure out what we want that committee to be in terms of number of members, we wanted to make it diverse. So we need to come up with a criteria of number.

Clean Energy Community program – Request from resident:
Resident Judith Karpova brought to the attention of the Town Board a supported program called clean energy community program. Councilwoman Enouen signed up for the training to look further into it. It seemed similar to the climate smart where there will be bench marks of what we can do to transition to things considered clean energy. The main thing with the clean energy program is it’s a gateway to some state funding for municipal energy projects.

Watershed Education Park:
Supervisor Baden stated that there was a misunderstanding with the completion of the phase 2 deadline. He will follow up with that and see if the Board needs to offer a extension. Supervisor Baden stated that the Board needs to decide if they want to move forward with the park or not. We appreciate all the hard work put forth at this time but need to figure out where we are headed.
Councilwoman Enouen suggested a community focus group or event to find out what the public would like to see for our community.
