Supervisor Baden called the meeting to order and led in the pledge of Allegiance to the Flag.
AUDIT OF NOVEMBER 2021 VOUCHERS: was held at 6:00pm

AUTHORIZATION OF PAYMENT:
Resolution # 336 -2021:
A Motion was made by Councilwoman Enouen that the Town of Rochester Town Board authorizes the payment of abstract 11-2021 in the amount of;
General Fund $ 141,412.77
Highway Fund $ 170,680.50
Street Lighting Fund $ 370.05
Escrow Fund $ 4,603.50
Second: Councilman Hewitt
Discussion: the Board removed one invoice in Highway- tickets didn’t match the invoice, $ 0.07 error correction was made.

APPOINTMENT OF COURT CLERK:
Resolution # 337-2021:
A Motion was made by Councilman Hewitt at the request of the Town Justice the Town Board appoints Deborah Goodman at a rate of pay of $17.50 per hour for 28 hours a week plus additional hours for Court sessions effective 12/5/2021.
Second: Councilwoman Haugen-Depuy
Discussion: The Board agreed to send a recommendation for Court clerk training. Attorney Christiana suggested contacting the office of Court Administration to possibly assist with training guides and or classes.

TERMINATION OF CONTRACT BETWEEN ACCORDION VENTURES, LLC:
Resolution # 338-2021:
A Motion was made by Councilwoman Haugen-Depuy;
WHEREAS, the parties to a contract for the sale and purchase of real property with improvements thereon located at 5164 Route 209 Accord, NY 12404( tax map section: 76.2-2-20.200), approved by Resolution # 267-2021 of the Town of Rochester Town Board on September 2, 2021 and executed by Stephen Apkon, as a member of Accordion Ventures, LLC on September 20, 2021 have determined that it is in the best interest of all parties to terminate said contract;
It is hereby agreed between the parties that the contract is hereby terminated and that each party waives any claims against the other with relation to same.
It is further agreed that a copy of facsimile of signature on this termination of contract, delivered by email or other electronic means will be treated as an original of this termination agreement.

Discussion: The Board discussed the approximate cost of what has incurred since signing of the contract. Supervisor Baden stated approximately $ 6,900.00 has been expended but by cancelling now we are saving additional costs to the Town.

Resolution # 339-2021:
A Motion was made by Councilman Hewitt authorizing the Town Clerk and Town Supervisor to notify the Board of Elections of cancellation of 12/7/21 referendum vote.

DISCUSSION:
LETTER REGARDING FIRE INSPECTION:
Supervisor Baden stated that after speaking with CEO and Fire Inspector it was clarified that Chapter 65-11 of Town Code states that fire safety and property maintenance inspections of buildings or structures which contain an area of public assembly shall be performed at least once every 12 months which supersedes the State law.
The Board discussed the idea of waiving the fire inspection fee knowing businesses were not able to open and operate during the pandemic. Supervisor Baden stated that he would talk to the Code Enforcement office to see the number of parcels this would include and report back to the Town Board at the Thursday night meeting.
REQUEST FOR ZONING CHANGE FROM R-5 TO AR-3 69.3-3-16:
Supervisor Baden stated that an amended zoning change application was submitted to the Town Board. The Board reviewed the map. Supervisor Baden stated he researched as far back as Ulster County parcel viewer would allow and can’t see any change as to why this parcel was zoned differently.
The Board will discuss it further at the next Town Board meeting.
REQUEST FOR ECONOMIC ENTERPRISE OVERLAY ZONE DESIGNATION 77.9-1-28,29,31:
Supervisor Baden asked the Board if they had the opportunity to review the packet for the EEO request and if they would like to move forward with the application.
The application is for the redevelopment of 4 existing buildings and 1 new structure located at 2 Towpath Road formally known as the Anderson Mill and Granary.
Supervisor Baden asked if the Board would like to move forward with having the applicant give a presentation.
The Board agreed to December 15th . Supervisor Baden is going to check with the applicant on their availability and report back to the Board at the 12/2/21 Town Board meeting.
UCRRA LETTER:
Supervisor Baden stated that he received a letter from UCRRA regarding the contract with the Town. Currently the Town is being offered another one-year contract. The Board discussed other alternatives with private haulers. Supervisor Baden stated that he would like to have the County elaborate more as to the reasons why we are only given a one-year contract again. The Board will discuss it further when more information is available.
