Local Law 8-2022, EEO amendment for change of use
Local Law 8-2022 will allow Adaptive Re-use of an Existing Facility to grant a new use to an approved Economic Enterprise Overlay (EEO) for the parcel located at 2919 and 2921 Lucas Turnpike, Accord NY [SBL 77.1-2-42.131].
Great Blue Heron Properties LLC proposes a new use Portable Sawmill to an existing EEO approved property. A Zoning Change is being pursued by the Applicant. If granted, the applicant will be directed to present application to the Town of Rochester Planning Board for Site Plan review.

B. Special Meetings
Recommended Resolution: The Town of Rochester Town Board sets Special Meetings to be held Thursday October 13, 2022, Tuesday October 18, 2022, and Wednesday October 26, 2022 at _____pm at the Harold Lipton Community Center, 15 Tobacco Road, Accord, NY for the purposes of review of the Tentative 2023 Budget and other business. The Town Clerk is requested to advertise legal notice of the meetings.
C. Authorizing the Supervisor to Sign a Contract
Recommended Resolution:
WHEREAS, in connection with a federal-aid project funded through the New York State
Department of Transportation (“NYSDOT”) identified for the purposes of this contract as Boice
Mill Road over Falls Mill Brook Bridge Replacement (as described in detail in Attachment A
annexed hereto, the “Project”) the Town of Rochester has sought to engage the services of a Consultant/Engineer) to perform the scope of services, described in Attachment B; and
WHEREAS, in accordance with required consultant selection procedures, including
applicable requirements of NYSDOT and/or the Federal Highway Administration (“FHWA”), the
Town of Rochester Having its principal office at 50 Scenic Drive, Accord, New York 12404 has selected HVEA Engineers with its office at 560 Route 52, Beacon, New York 12508 to perform such services in accordance with the requirements of this Contract; and
WHEREAS, Town Supervisor Michael Baden, is authorized to enter this Contract on
behalf of the Town,
NOW, THEREFORE, with this resolution, the parties hereto agree to the contract, as presented.
D. Standard Workday for Retirement Credits
Recommended Resolution:
BE IT RESOLVED, that the Town of Rochester, hereby establishes the following as standard work days for its employees and will report days worked to the New York State and Local Employees’ Retirement System based on the time keeping system or the record of activities maintained and submitted by these members to the clerk of this body:
Town Justice Standard Workday 6 hours/day
E. Retirement Credits
Recommended Resolution:
WHEREAS, the New York State Comptroller is authorized by Sections 34 and 334 of the Retirement and Social Security Law to adopt rules and regulations for reporting the service and salary information for all employees of participating employers in the New York State and Local Employees’ Retirement System (“Retirement System”); and
WHEREAS, Town of Rochester is a participating employer in the Retirement System; and
WHEREAS, the New York State Comptroller has promulgated Regulation 315.4 which imposes certain reporting requirements for elected and appointed officials of participating employers, and requires the governing board of each participating employer to adopt a resolution establishing a standard work day for each elected or appointed official; and
WHEREAS, among the requirements for employers are a more detailed description of a Standard Work Day along with a Town Board resolution establishing and reporting such Standard Work Day, public posting of the Resolution, and submission of the Resolution to the New York State Retirement System; and
WHEREAS, pursuant to Regulation 315.4, in the event that elected or appointed officials do not participate in an employer’s time keeping system, they are required to keep a record of activities (ROA) for a three month period and submit it to the confidential secretary of the Town Supervisor within 180 days of taking office; and
WHEREAS, each of the elected or appointed officials listed in this resolution have kept records of their actual time (ROA) worked in their current position for the required ninety days or taken part in the Ulster County time keeping system; now, therefore,
BE IT RESOLVED, that the Town of Rochester Town Board hereby establishes the following as Standard Work Days for these elected and appointed officials who are not covered by a collective bargaining agreement, and will report the following days worked to the New York State and Local Employees’ Retirement System based on the established time keeping system or the record of activities (ROA) maintained and submitted to the Town Supervisor Confidential Secretary:
Town Justice Renee Albaugh ROA 1/1/2022-3/31/2022 2.62 days per month

Recommended Resolution: Upon recommendation of the Town Supervisor, the Town of Rochester Town Board accepts the Small Employer Benefits Package with enrollment of qualified Town employees/spouses/families in the MVP Liberty Silver 8 Health Plan, effective December 1, 2022 through November 30, 2023, as presented by Marshall and Sterling Group Benefits, and authorizes the Supervisor to sign the agreement.

H. Authorizing the Supervisor to Sign Renewal of MVP Select Care, Inc.- Health Reimbursement Account
Recommended Resolution: Upon recommendation of the Town Supervisor, the Town of Rochester Town Board accepts the Small Employer Benefits Package with enrollment of qualified Town employees/spouses/families in the MVP Select Care, Inc. Health Reimbursement Account, effective December 1, 2022 through November 30, 2023, as presented by Marshall and Sterling Group Benefits, and authorizes the Supervisor to sign the agreement.
Deductible – 80% paid by town (split 40% town – 20% employee – 40% town)
Monthly Fee $2.50 per participant per month
Individual $3900 per year
Double or Family $7800 per year
I. Authorizing the Supervisor to Establish a Flexible Spending Account Health FSA
Recommended Resolution: Upon recommendation of the Town Supervisor, the Town of Rochester Town Board makes offer to employees the opportunity to enroll in the MVP Select Care, Inc. Flexible Spending Account Health FSA in an amount up to $2850 per year with a grace period of 2.5 months after the end of the plan year to utilize all funds, effective December 1, 2022 through November 30, 2023, as presented by Marshall and Sterling Group Benefits, and authorizes the Supervisor to sign the agreement.
$100 increase from current amount allowable by IRS
J. Authorizing the Supervisor to Sign Contract – Renewal of Dental Insurance
Recommended Resolution: Upon recommendation of the Town Supervisor, the Town of Rochester Town Board makes offer to employees the opportunity to enroll in the CDPHP Delta Dental of NY Traditional PPO option, effective December 1, 2022 through November 30, 2023, as presented Marshall and Sterling Group Benefits, with employee to pay 25% of the coverage and the Town of Rochester to pay 75% of coverage, and authorizes the Town Supervisor to sign the agreement..
