MINUTES of the January 18th, 2024, Town of Rochester Zoning Board of Appeals, held at 6:00PM at the Harold Lipton Community Center and streamed live via YouTube.

Chair Zurofsky called the meeting to order at 6PM.

The Board Members stood for the Pledge of Allegiance.

The secretary did roll call attendance.

Application # ZBA 2023-07 Applicant/Owner: Henry Hershkowitz Type: AV Representative: Henry Hershkowitz Zoning: R2 Property Location: 14 Bakertown Road & 15 Bakertown Road SBL: 68.2-2-31 & 68.2-2-38.112 DESCRIPTION: Applicant proposes conveyance of +/-.31 acres from 15 Bakertown Road to 14 Bakertown Road. The idea is to take the garage currently on 15 Bakertown Road and add it to 14 Bakertown Road. Setbacks have been met, however each new lot created would need to be a minimum of 2 acres per the TOR Schedule of District Regulations which is not possible in this case. Applicant is requesting an area variance to waive the minimum acreage requirement. Status: Continued Application/ Public Hearing

Chair Zurofsky explained the application. Chair Zurofsky made a motion to list as a type 2 action. Mr. Stephens 2nd notion. Roll Call Vote, Chair Zurofsky, Mr. Fischer, Mr. Stephens, Mr. Haugen, Mr. Davis all said yes. Chair Zurofsky made a motion to open the public hearing. Mr. Fischer 2nd the motion. All in favor 5 yes, 0 no, 0 abstain. No comments from the public. Chair Zurofsky made a motion to close the public hearing. Mr. Fischer 2nd the motion. All in favor 5 yes, 0 no, 0 abstain. The board went through the decision questions. Mr. Haugen made a motion to grant the variance. Mr. Fischer 2nd the motion. All in favor 5 yes, 0 no, 0 abstain.
Application # ZBA 2023-08 Applicant/Owner: Alix Umen Type: AV Representative: Alix Umen/ Marcia McKeel Zoning: AR3 Property Location: 227 Boicemill rd. SBL: 76.1-2-42.200 DESCRIPTION: Applicant proposes a carport, does not meet front yard setback requirement per the Town of Rochester Schedule of District Regulations and would need a 7’ variance. Status: Continued Application/ Public Hearing

SBL: 76.3-3-22.900 DESCRIPTION: Applicant proposes permanently parking recreational vehicle to be used as living space. Status: Continued Application

Chair Zurofsky explained the application and discussed with the applicant. Chair Zurofsky made a motion to set the public hearing for February 15th, 2024. Mr. Fischer 2nd the motion. All in favor 5 yes, 0 no, 0 abstain.

Mr. Davis made a motion to approve the 12-21-23 minutes. Mr. Stephens 2nd the motion. All in favor 5 yes, 0 no, 0 abstain.
