MEETING MINUTES OF Month, Date, Year__ REGULAR MEETING OF Town of Rochester PLANNING BOARD held at 7:00PM at the Harold Lipton Community Center and streamed live via YouTube.
Chair Grasso called the meeting to order at 7:00PM and asked everyone to stand for the Pledge of Allegiance.
Chair Grasso did roll call attendance.

APPLICATION REVIEW:
1. PB 2023-037 LLI New Application Frances and John Nodar
S/B/L 68.3-1-33.120 – 216 City Hall Rd
Parcels are in the R-5 zoning District. Applicant proposes the following: +/-3.25 acres to be conveyed from 68.3-1-33.120 to 68.3-1-33.110. Applicant has met zoning requirements and no physical restrictions apply. Current and previous owners were searched in IQS databases – there was a subdivision of lands filed in 2020 but it has been determined this can proceed at LLI.
The LLI for Mr. and Mrs. Nodar was certified by Mr. Jones and seconded by Mr. Jarvis. The secretary will complete the certification and have it approved; she will also inform the applicant of any necessary materials to complete the map signing portion.

2. PB 2022-02 LLI Continued Application John Rofe
S/B/L 68.2-1-9 – 115 Lang Rd
Parcels are in the R-2 district. Parcel #1 is +/- 4.4 acres, parcel #2 is +/- 2.5 acres. Applicant proposes a LLI combining both parcels to make one parcel of +/- 6.9 acres. Applicant has met zoning requirements and no physical restrictions apply. Ulster County has a recorded subdivision on file from 1978. It does not clearly state whether it was classified as major or minor. After a phone conversation with Mary Lou Christiana on 5-18-2022 it was reviewed and determined that the Lot-Line Improvement classification was appropriate.

The applicant is not currently in the country and therefore cannot present his application. The application is tabled until April when he returns.
3. PB 2022-05 SUP Continued Application Harana Market
S/B/L 76.2-2-49 – 5125 Rt 209
Applicant proposes the following: Market and Fast casual food establishment. Ulster County Board of Health permitting will be required for drinking water. The parcel is +/- 2.6 acres and located in the Business district.
Though the applicant mentions special events, the board will not consider the matter until they receive a new determination from the Code enforcement Office. If the applicant decides to ditch the idea of special events, then the board will review the site plan in further detail to ensure all points and requirements are met to move forward. The applicant is hesitant to proceed their application including special events, so Chair Grasso advises we obtain a CEO determination, then the applicant can choose proceedings from there.
The secretary will supply CPL Engineer, Greg Bohlner with lighting and cut sheets; items on Rt. 209 signage to NYSDOT, John Reilly; and items to Fire Department.
a. PB 2022-06 SUP (Existing) Continued Application Stone House Tavern
S/B/L 69.3-2-24 – 4802 Route 209
Applicant proposes to continue outdoor dining allowed by Executive Order during the COVID-19 Pandemic. Parcel is in the R-2 zoning district.
The applicant proposes permanent bathrooms in place of the previously proposed porta potties, this structure will include two bathrooms, one of which will be ADA compliant, both will have potable cold and hot water, and it will have its own septic system. The structure will utilize the existing filtration system, but a separate septic. The path from the outdoor dining patch and outdoor bathrooms will be ADA compliant.
The applicants are aware Sand Hill Road is private, there will be signs to direct customers down through the main parking lot to exit onto Rt. 209. The application proposes 45 total parking spaces.
The representative and the board discussed the location of the proposed ADA parking. The board remains firm that they will abide by the code and the CEO determination in their decision. The applicant may choose how they would like to proceed.
The secretary will send lighting items and cut sheets to CPL Engineer Greg Bohlner and Site Plans to the Fire Department.
A motion is made to schedule Public Hearing and simultaneously look to the UCPB for review. The motion is seconded.

A public hearing will be scheduled for April 12, 2023. The application will be submitted to the UCPB for review.

Comments from the Planning Board were tabled until next month’s meeting.
– Housekeeping Discussion
Chair Grasso motions to use the same escrow rates listed in the 2022 schedule. And the board grants him permission to adjust these fees based on the intensity of the project. Motion seconded.

The secretary will notify the Town Board of our recommendation to maintain escrow fees the same as last year.
