The Town of Rochester Town Board held public hearing on proposed local law CC-2023: A Local Law amending Chapter 140, Zoning, § 140-29, Wireless Telecommunications Facilities at 6:00pm at the Harold Lipton Community Center, 15 Tobacco Road Accord, NY 12404.

PUBLIC COMMENT:

Zorian Pinsky:

a) What zones it would be allowed at? Should be clarified for the hearing.
I, with a special use permit in zones: B, NR, AB3, R5.

b) Change word Yard to Area to avoid an assumption that it could be large.

c) If there is an area size limit for the storage of material, why not limit size of the area for the equipment?

d) limit type of equipment, not their weight. How would an inspector know the weight without having specification of the equipment?

e) An invitation to creating equipment junk yard. See how it would look if type of equipment and its quantities aren’t specified.

f) Potential source of noise issues, if an owner would try to do a home repair of an engine, for example, or some component that would require engine to run.

g) potential source of fire if fire hazard materials are stored. Specify a related restriction.

h) As a maximum, allow only indoor storage of non-flammable parts and materials.
i) Equipment wise, allow only lawncare equipment and small tracks, unless zones are I and B.

j) As the law is written now, it is a potential source of neighbor’s dispute.
