RESOLUTION OF THE ACCORD FIRE DISTRICT
TO PURCHASE A 3000 GALLON PIERCE TANKER
WHEREAS, the Accord Fire District Board of Fire Commissioners
(“Board”) believes that it would be in the best in interests of the
residents of the fire district to purchase a new 3000 Gallon Tanker, and
affiliated equipment;
WHEREAS, Pursuant to General Municipal Law §103(16) the Accord Fire
District is authorized, notwithstanding the provisions of subdivisions
one and two, to purchase fire apparatus, materials, equipment and
supplies through the use of a contract let by a political subdivision of
any State if the contract was let to the lowest responsible bidder and
involved a competitive bidding process.
WHEREAS, the Board has resolved to purchase a vehicle from a competitive
bidding company pursuant to the above law.
WHEREAS, sufficient reserve funds have been saved to purchase the Tanker
and appurtenant equipment, which currently reside in a capital reserve
fund for vehicle and equipment purchases;
WHEREAS, spending reserve funds requires the resolution to be subject to
permissive referendum;
NOW THEREFORE, upon motion made, seconded and discussion held, and
subject to permissive referendum, the fire commissioners of the fire
district RESOLVE as follows:
1. The Fire District has determined that the bid from the
competitive bidding vender is authorized by GML §103(16) to meet the
needs of the Fire District;
2. The district shall purchase a 3000 Gallon Pierce Tanker,
utilizing funds from the vehicle and equipment capital reserve fund;
3. Up to $520,000 may be withdrawn from the vehicle and equipment
reserve fund for the payment for the 3000 Gallon Tanker and affiliated
equipment. The withdrawal may be taken in one or more amounts;
4. No funds may be withdrawn until the passage of thirty days from
the date of the publication of the abstract of this resolution;
5. The Secretary is hereby directed to place an abstract of the
resolution in the newspaper having general circulation in this district
within ten days of the adoption of this resolution;
6. The Secretary is hereby directed to send the abstract of the
resolution to the Town Clerk for placement upon the town’s sign board
and website immediately, which must remain there for at least 15 days;
This resolution was approved by a majority of the Commissioners, on the
9th day of March, 2022.

PLEASE TAKE NOTICE, that by resolution dated March 9, 2022, the Accord
Fire District has approved a resolution, subject to permissive
referendum, to withdraw up to $520,000 from the vehicle and equipment
capital reserve fund for the purchase of a new 3000 Gallon Tanker. Any
person desiring to contest this resolution shall file an appropriate
petition with the Secretary of the Fire District within 30 days of the
above date.
