Town Board Special Meeting #2 – April 2022

The Town of Rochester Town Board held a Special Meeting on April 28, 2022 at 7:47pm at the Harold Lipton Community Center 15 Tobacco Road, Accord, NY

Supervisor Baden called the meeting to order.

ACCEPTANCE OF AGENDA:
Resolution # 205-2022:

A Motion was made by Councilwoman Enouen that the Town Board accepts the agenda, as prepared by the Town Supervisor with the addition of discussion request from Open Space Institute regarding the O & W rail trail.

SEQRA FOR LOCAL LAW 2-2022: AMENDING THE ZONING MAP:

Councilwoman Smiseth- recused

The Board reviewed part 2 & 3 of the Environmental assessment form and determined it to be a type 1 SEQR status with an “A” determination.

RESOLUTION # 206-2022:

A Motion was made by Councilwoman Enouen declared this project will have no significant adverse impacts on the environment, and , therefore, an environmental impact statement need not be prepared. According, this negative declaration is issued.

ADOPTION OF LOCAL LAW # 2-2022: AMENDING THE ZONING MAP:
Resolution # 207-2022:

A Motion was made by Councilman Paddock to adopt Local Law # 2-2022: Amending the zoning map as presented.

Town of Rochester Planning Board comments:

Supervisor Baden stated that the previous proposed Local Law # 3-2022: Recreation Commission will now be proposed local law # 1-2022.

SEQRA FOR LOCAL LAW # 1-2022:

The Board reviewed part 1, 2 & 3 of the Environmental assessment form and determined , based on the information and analysis above, and any supporting documentation. That the proposed action will not result in any significant adverse environmental impacts.

Resolution # 208-2022:

A Motion was made by Councilwoman Enouen declared this project will have no significant adverse impacts on the environment, and , therefore, an environmental impact statement need not be prepared. According, this negative declaration is issued.

ADOPTION OF LOCAL LAW # 1-2022:
Resolution # 209-2022:

A Motion was made by Supervisor Baden that the Town Board adopt local law # 1-2022: establishing Recreation Commission with the amendment of changing the name to read Adult, Senior and Youth Commission.

AMEND THE MOTION:

A Motion was made by Councilwoman Smiseth to amend the proposed resolution naming the Commission:
Senior, Youth, & Recreation Commission.

ADOPTION OF LOCAL LAW # 1-2022:
Resolution # 210 -2022:

A Motion was made by Councilwoman Smiseth that the Town Board adopt local law # 1-2022: establishing Senior, Youth , & Recreation Commission

ACCORD SPEEDWAY WAIVER REQUEST:

Supervisor Baden stated that 2 additional comments were submitted to the Town Clerk for the record. He spoke with the vendor looking to rent the speedway facility and they would supply additional insurance to the Town and willing to pay for the use of the constables to assist in the traffic.

Councilwoman Enouen and Councilman Coleman both reiterated that the level of noise was also a concern and both are sympathetic to those that it affects.

Supervisor Baden stated that he would like to help the business. The track was closed from October of 2019- May of 2021 and even though a lot of businesses have been impacted this particular business was deeply impacted. We allowed for the waiver last year and would like to see it approved for this year to help the Speedway.The Board was in full agreement that they wanted to help the business.

Councilman Coleman suggested possibly shuttling from the municipal lot to help alleviate some of the traffic concerns as well.

APPROVAL OF RACE TRACK WAIVER:
Resolution # 211 -2022:

A Motion was made by Supervisor Baden to approve the waiver with the condition that Garden Motor Sports provide additional insurance to the Town and contract to pay for the use of the Town Constables.

ANNUAL UPDATE DOCUMENT:

Supervisor Baden presented to the Board the AUD.

ANNUAL UPDATE DOCUMENT:
Resolution # 212-2022:

A Motion was made by Councilman Paddock that the Town Board authorizes the Supervisor to file the Annual Update Document (AUD), as prepared by Sickler, Torcia, Allen and Churchill on behalf of the Town.

OPEN SPACE INSTITUTE: O & W RAIL TRAIL:

OSI provided the Town with Insurance, a time frame of projected project and a letter of request asking the Town Board grant OSI and GSI access to the rail trail.

AUTHORIZING THE SUPERVISOR TO SEND LETTER:
Resolution # 213-2022:

A Motion was made by Supervisor Baden that the Town Board authorize the Supervisor to send letter granting Open Space Institute and it’s consultant Greenman-Pederson, Inc. to access the O & W rail trail property owned by the Town of Rochester for the purpose to assess engineering and the physical inventory.
