Whereas the Town of Rochester, Ulster County, is desirous of providing and/or to arrange for ambulance services to its residents and the Town desires that such service have sufficiently trained and skilled emergency medical technicians serving on its ambulances available to serve persons situated in the Town.
Whereas the town has prepared a map, plan and report that is in such detail as is acceptable to the town board; and
Whereas the map, plan and report have been filed in the office of the town clerk pursuant to Section 209-c of the Town Law in advance of the adoption of this resolution; and
Whereas the town board has adopted an order and entered the same in the minutes of its proceedings reciting a description of the boundaries of the proposed ambulance district sufficient to identify the lands included therein as in a deed of conveyance, the improvements proposed, the maximum estimated amount proposed to be expended annually for the improvement, and the cost of the district to the typical property, and the fact that a map, plan and report describing the same are on file in the town clerk’s office for public inspection and specifying the time when and place where said board will meet and hold a public hearing to hear all persons interested in the subject thereof, concerning the same; and
Whereas a copy of such order has been published at least once in the official paper of the Town of Rochester, the first publication thereof which was not less than ten (10) nor more than twenty (20) days before the date set therein for the hearing had preceding this resolution; and
Whereas a copy of the order was posted on the signboard of the town maintained pursuant to subdivision six of section thirty of this chapter, not less than ten (10) nor more than twenty (20) days before the day designated for the hearing since had on this issue; and
Whereas a public hearing was held on the 7th day of July 2022 at 6:30 pm at the Harold Lipton Community Center with a street address of 15 Tobacco Road, Accord, NY 12404: and
Whereas the board has determined that the notice of hearing was published and posted as required by law, and is otherwise sufficient; and
Whereas the Town Board adopted a SEQRA determination of an Unlisted Action and further determined a Negative Declaration; and
Whereas the board has determined that all of the property and property owners within the proposed district are benefited by the proposed district; and
Whereas the board has determined that all of the property and property owners benefited are included within the limits of the proposed district; and
Whereas the board has determined that the establishment of an ambulance district. A description is as follows:
The area within the Town of Rochester identified by Ulster County Emergency Services as the boundaries of the Kerhonkson-Accord First Aid Squad (KAFAS) coverage area; and
It is hereby resolved that subject to permissive referendum, that the Town of Rochester establish an ambulance district for the benefit of all of the property and property owners in the proposed ambulance district; and
It is further resolved that such ambulance district shall include and be limited to the territory described above, being the entire limits of the District.
It is further resolved that such ambulance district shall become effective January 1, 2023 after approval of the voters or thereafter as may be required by law or in case no petition is successfully filed, after the time to petition for a referendum has expired.
It is hereby ordered that, the clerk of the Town of Rochester shall file this resolution in the office of the Clerk of the Town and make such resolution available for public inspection.
It is further ordered that, if, after the expiration of the time for filing a petition requesting that the matter be submitted to a referendum of the property owners of the proposed ambulance district, no such petition has been filed with the town clerk, the town clerk is directed to file a certificate stating such fact in the office of the Ulster County Clerk.
It is further ordered that, upon the filing of such a certificate in the office of the Ulster County Clerk, the Board shall adopt a final order establishing the ambulance district.

DEPARTMENT UPDATES AND LIASION REPORTS:
Councilman Coleman: Fire District: just purchased a new truck that holds 3,000 gallons of water.Marbletown rescue squad: 96 % response rate, KAFAS: 92% response rate. Both are excited about forming the ambulance district. Spectrum: working on figuring out what roads in town are without service. The contract is up in 2023.

Interesting Occurrences:
This month continued to be busy with many of calls for service. These again included increased numbers
of complaints regarding traffic volume, speeds and erratic operation of vehicles on town roads. Short
Term Rental properties again continue to generate complaints including trespassing, loud noises,
road/driveway blockages and garbage dumping. We continue to work with the building department on
those issues. Assisted by the Ulster County Mobile Mental Health Unit we relocated a homeless individual
to a safer location and confirmed he was receiving the help he needed. We rescued two dogs that were
running free on Mettacahonts road. The owner was located and they were escorted home safely. At the
“Deep Hole” swimming hole we had several helpful folks assist us with locating the drivers of many cars
parked on the adjacent roadway. Several times, on different days the parking alongside the area has
become extremely crowded with vehicles parked unsafely along the roadway and in the Fire department
draft area. Neighbor to neighbor complaints have increased this month and all have been defused
without further action necessary.
Recreation dept:Summer Program to begin July 11th. Summer Program highlight of our year; Legislator Chris Hewitt uses our Summer program model as an example of what other Towns might want to consider. Look for the Rec Dept. at Farm & Barn Day July 23rd 11-3pm at the Town Park. Hosted by the Friends of Historic Rochester and HPC. Join for a day filled with vendors, music, food and historical information and a scheduled historic farmstead bus tour starting at 1pm sign up at torfriendsorg@gmail.com. Adult exercise classes and line dancing are on going call the recreation dept. to sign up.
Councilwoman Enouen:ZBA: June 16th meeting one on going application was before the Board. Transfer Station is hiring. TORE: the space is looking nice great job by our volunteers. ECC: held their meeting in the park and going to their third Thursday nature series beginning July 21st: topic nature with urban areas.
Councilwoman Smiseth:Eldercare Program: new forms will be circulated. Housing Committee: advertising for members have gone out.
Supervisor Baden:Changes have been made in the Planning and ZBA depts.
Rick Jones stepped down as Chair to the Planning Board
Bruce Psaras stepped down from the ZBA and was appointed Chair to the Planning Board
Sam Zurofsky didn’t have the time for the Planning Board and switched over to the ZBA and voted Chair.
Assessor Office: Grievance Day was held 5/26/22. Town Assessor Baracca put 20 million in assessed value on the tax roll. Our equalization rate dropped from 100% to 72 %. BOAR report has been submitted.
TOWN BOARD MEMBER TIME:
Councilman Coleman: I am against adding public comment to workshop meetings, workshop is for work and I understand people want to be part of the process but public comment should be at the monthly meeting.
PUBLIC COMMENT:
Bea Haugen-Depuy: if workshop meetings were for workshop and not for voting for the the public needs to know and may have some input on then I would believe that is true. But you do much more than your workshop meetings. You’re voting! For example you have Mike Baden as project manager for the bridge and my point is if you’re not making decisions and those meetings I would say yes no comment would be necessary but you are making decisions that’s why I feel there should be public comments at these meetings. Bridge on Boice Mill at conmpletion I think the bridge should be named: “ Dunn Falls Bridge” in memory of Herman “ Stubby” Dunn.
ZBA & Planning Board: why isn’t any of the Board members asking members on those boards before new chairs are put on and why aren’t their any vice chairs anymore? You took it upon yourself. The ZBA should be naming their Chair and Planning Board should be naming their chair themselves not the Town Board,unless the law has changed.
Richard Demorest: the sign for the deep hole is missing. I support the naming of the BoiceMill road bridge the Dunn Falls Bridge.
