Supervisor Baden called the meeting to order and led in the Pledge of Allegiance to the Flag.

2021 ANNUAL UPDATE DOCUMENT:
Supervisor Baden stated that we are 90 % ready, we filed for an extension which is due 5/1/22.

FINANCIAL SYSTEM CONVERSION TO QUICKBOOKS:
Supervisor Baden stated that the transition has gone well, we still have some tweaking to do but we have 4 payrolls completed with ADP.

For the Month of March: $ 42,718.62 was collected by the Town Clerk’s office
Tax Collection for Month of March: $ 346,990.95 was collected of that $ 3,866.04 was penalties.
Unpaid taxes will go out this month.

HIGHWAY SUPT. REPORT:

Supervisor Baden stated that the Highway dept. is currently doing ditch work, Highway Superintendent Frey is awaiting on answers from the state on CHIPS funding.

SUPERVISOR’S UPDATE:

COVID-19 report: 6 cases in the Town of Rochester, County-wide has low numbers, the County is providing a 2nd booster shot for those who chose to get the vaccine.

Grant Updates:

NY Rising – Alligerville Firehouse: progessing nicely, they are working back in the old part of the school house at this time.
NY Rising- Harold Lipton Community Center: in the final stages of signing off with the State
BridgeNY – Boice Mill Road Bridge: Additional DOT paperwork was filed this weekend
LGRMIF – Building Dept./Code Enforcement record conversion: Everything is running smooth.
JCAP – Courthouse bathroom ADA compliance reconstruction: RFP is due 4/14/22.
ARPA Funding: 1st round of reporting is due the federal Gov’t gave clear guidelines on the reporting. Regarding elected official premium pay Attorney Christiana stated that those not entitled to overtime pay would not qualify for the pay through the fair labor standards act and suggested Michael Richardson give a clear explanation of the act.
Granary EEO application: heard back from the applicants and are ready to come before the board at te 4/20 workshop meeting.
Walnut Brook LLC application: Should be ready by May to move forward

Ulster County Updates:
Councilwoman Enouen stated that she attended the March meeting of the Ulster County Recycling Committee where there was a proposal to due a feasibility study to look for a sit for landfill. We meet again at the end of April.
Supervisor Baden : EMS update : subcommittee formed
Final interviews were held for candidates on the County Planner for Housing .

COUNTY LEGISLATURE QUARTERLY UPDATE:

Legislator Hewitt:

I want to thank you all for the support and continued support! The 23 legislators are working well together and working hard on progress to the rail trails. Thanks to our Town Board passing the best value procurement policy and the County is moving towards using that policy as well. I’ve been using our Recreation dept. as a model for youth programs in the area. We have had a strong Youth/ Recreation dept for years. Legislator Hewitt has been appointed to two committees: Economic development planning & Law Enforcement / Public Safety. Legislator Hewitt also is also offering free grant writing for new non-profit funding for County up to $ 25,000 in each category.

DEPT. UPDATES/ LIAISON REPORTS:

Councilman Coleman: Local Emergency services: KAFAS: working on the number of calls , there are 6 EMT’s working on final testing training classes. MFA: responded to 1 call in the Town of Rochester, 2 mutual aid requests. I was loaned a scanner to hear calls in the County so it’s interesting to hear the types of calls received. Fire District: Met with Aaron Santillo, Peter Nelson & Rich Demorest. We discussed the challenges when trying to find homes, They ask that addresses be clearly marked and visible all times of day. Educating residents of potential draft sites around town is another topic of concern. Ponds and local streams need to have clear access for the trucks to get water. We are working on an inventory of where ponds are located.

Councilwoman Enouen:
ZBA: March agenda: area variance for fence and garage. We received a resignation.
Transfer Station: credit cards are now accepted at the transfer station. Thank you to Justin for taking the initiative to learn the credit card process system. We had a new employee start Tuesday.
ECC: had a guest speaker: Community Choice Agrigation. I sent information to the Board to review.

Councilman Paddock:
Recreation dept.: Easter Egg Hunt is scheduled for 4/9/22 rain or shine. Photo’s with the Easter Bunny will take place on 4/13&14. Earth day: 4/23 & 4/30 with a pizza party on the 30th! Sign up for a road. A sports equipment drive will be held on 4/20. Kerhonkson Basket ball program is selecting All-stars at this time.
Constabulary report:
Court remains mostly open. The Constabulary answered 14 direct calls for service and other duties in
March of 2022.
These included:

• 6 Resident Traffic Complaints (Upper Cherrytown Rd, Cherrytown Rd, Whitfield Rd.,
Mettacahonts Rd., Rochester Ctr. Rd and Dug Rd.)
• 3 Environmental Complaints, (Rochester Ctr Rd., Cherrytown Rd., Upper Cherrytown RD.)
• 6 New Building Department Violations
• 2 New Court Cases Opened
• 9 Court Proceedings Remain Open
• 2 Court Proceedings Closed
Interesting Occurrences:
This month we had a large variety of calls for service. These included some unusual ones. There was a
call regarding low level helicopter overflights over residents’ homes. After investigation, this turned out
to be training flights from the base at Stewart Airport. A resident suffered a dog bite. Garbage dumping
complaints are occurring on more roads with more frequency. Complaints regarding speeding and
erratic operation of motor vehicles on several Town roads have increased dramatically this month.
Complaints from residents regarding Short Term Rental properties have risen significantly. We continue
to work with the building department on those issues. Neighbor to neighbor complaints have decreased
slightly and all have been defused without further action necessary. As always, due to the COVID-19
pandemic and the rise of its variants, we continue to have limited direct contact with complainants with a
proportional increase in direct phone calls.

Councilwoman Smiseth:
Housing Committee: a draft resolution is on the agenda for later tonight

Town Clerk Gundberg:

HPC: met on 3/21 and welcomed Bea as new member to the commission. Preservation discussions were made regarding pending sales of Historic properties. Palentown Schoolhouse was a topic of discussion and Wilton was scheduling a meeting there with a professional mason to discuss the foundation of the school. HPC is looking to do a music festival
Ash Tree Arts Festival: 6/4, trees that will be utilized have been marked.
Ag Day: Planning for 7/23 at the Town Park This is a free event for both the vendors and guests rain of shine. The day will be filled promoting local Agricultural businesses in and around the Town of Rochester while learning the Agricultural history of the Town including a Historic Barn Tour, Information session on barn rehabilitation, demos, etc.

Supervisor Baden:
Assessor report: our equalization rate has dropped to 72 %.

Planning Board: we still have applications in the double digits, over the course of 15 months 29 subdivision applications have been submitted, 20 lot line adjustments, 10 Special use/ site plan.
Our building department in a 15 month span 900 building permits were filed.

TOWN BOARD MEMBER TIME:

Councilwoman Enouen stated that she was asked for those reserving the Community Center are they also able to use the audio equipment ?
The Board discussed the idea and agreed this may not be a route they would like to go down. Supervisor Baden stated he will work on updating the agreement form.

PUBLIC COMMENT:

Peter Terasi (hybrid): asked if there is a priority of what projects the order will go in for CHIPs? With the Pine Ridge being sold and a couple other properties in the area is this particular group tax exempt? How will this affect our property value? My concerns are also if our area can handle the traffic , what is it going to do to the infrastructure? This has always been a rural residential area our population is already increasing significantly.

Supervisor Baden stated that nothing is confirmed sold yet. Any property that is non-taxable is reviewed by the Town Assessor to the NYS Law. People shouldn’t make assumptions.

Alan Fidler: Why is there no noise ordinance? I’ve been before the Town Board several times and supplied noise ordinance laws that other Town’s have adopted. In about 3 months the noise will be going and affect our quality of life. Regarding Pine Ridge: the Time’s union: “ Michael Baden does not know who bought the property.” I suggest this Town go to a ward voting system this is to avoid block voting where one group will control our School and Town taxes. You are going to see a lot of lawsuits coming before the planning board.

Bea Haugen-Depuy: I would like to see on the agenda for each meeting show public comment session and I urge a Board member to request that. Regarding the agricultural exemption: State law on filing by March1st.
Zoning Commission: a lot of time and effort was put forth by this committee, they gave great recommendations months ago and nothing happened what is holding it back? If section 140-25 : planned unit development gets passed it will help the Town out a lot.

Marc Grasso: Thank you for taking the time to consider a municipal planner. It is important and a lot of people are interested in the idea.

Written Comments:

Dear Town Board Members:

I have resided in Town of Rochester for almost 25 years and have owned the same property which is in a NYS specified Agricultural District. Over these years the same two farmers have used separate sections of my property to continue their farming practices in return for a reduction in my taxes, indeed, it is the reason for investing in this large parcel and this also serves to permit the continuation of supporting local farming efforts, as specified as an objective in the comprehensive plan, as opposed to transitioning to another development of the property.

I am alarmed that town staff have ignored the continuation of this Ag Exemption when no changes have been made. I was asked to come into to TOR offices to refile with a new staff member, the Assessor was not present, which I did. There was no indication that anything else was needed.

Please explain the grounds for denying this Ag Exemption and provide recourse for restoring the Ag Exemption. It is my intention to continue to allow the existing local farmers to use my property for agricultural purposes.

To the Town Board,

I am curious about a tax exemption in Chapter 128, Section 2 of our town code, for religious and non-profit organizations, which doesn’t seem to be present in other towns in Ulster County. The only town I could find with something similar is Olive, and ours still reads significantly more broadly than theirs. A representative of Marbletown said they don’t have such an exemption because the county already has religious and non-profit exemptions.

I am not an expert in tax codes and could very well be misunderstanding so I’m asking the board to help clarify by answering the following questions:

1) When was this exemption adopted, and why?
2) What was the total amount of claimed exemptions under this provision in the last fiscal year?

If by the next town meeting, the Board is unable to answer the above questions, or if the Board is able to answer the questions and the answers indicate this exceptionally broad exemption to be unnecessary to the well-being of the Town, I urge the Board to propose a resolution to repeal this provision as soon as possible.

AUTHORIZING THE SUPERVISOR TO SIGN AN AGREEMENT:

A Motion was made by Councilman Paddock that the Town of Rochester Town Board authorizes the Town Supervisor to sign a Memorandum of Agreement (MOA) between the Town of Rochester and the County of Ulster
to establish the conditions, roles and responsibilities of the parties in regard to operating a Point of Dispensing (“POD”) for the dispensing of COVID-19 vaccinations to the public, at Harold Lipton Community Center on 4/28, 5/19, 5/26/2021 (“POD Date”).

RESOLUTION OF SUPPORT :
Resolution # 183-2022:

A Motion was made by Councilman Paddock that on request of Scenic Hudson, Inc.The Town of Rochester Town Board adopts a resolution is support of NY-NJ Watershed Protection Act: H.R. 4677 as follows

WHEREAS, New York Congressman Tonko has proposed the NY-NJ Watershed Protection Act, a unique federal investment program to authorize $50 million of federal funds to protect and restore all watersheds, including the Hudson River Watershed, that flow into New York-New Jersey Harbor and

WHEREAS, The Act has unanimous support among the Hudson Valley’s Congressional delegation; and,

WHEREAS, the Act would provide benefits to diverse stakeholders such as the protection of fisheries and wildlife, conservation of natural resources and public and private lands, critical urban greenspaces, ocean and coastal resources, and various opportunities to improve the quality of life for community members throughout the region; and

WHEREAS, the Town of Rochester is part of the most densely populated and economically important regions in the country, the proposed NY-NJ Watershed Act will provide enormous economic and environmental benefits locally, regionally and nationally; and

WHEREAS, watersheds provide drinking water, tourism and outdoor recreation, economic opportunities, as well as sustain fisheries, critical wildlife and provide vital infrastructure from flooding and rising sea levels; and

WHEREAS, the Act would provide matching funds to achieve the goals of New York State Department of Environmental Conservation’s Hudson River Estuary Program, a state program that has greatly benefitted Hudson Valley communities; and,

WHEREAS, the Act would fund shoreline management and restoration within the watersheds,

WHEREAS, as an elected body tasked with protection and safeguarding irreplaceable water-connected resources and nature-based flood hazard mitigation measures that are essential to protect human life and infrastructure; and

WHEREAS, this Act would direct the Secretary of the Interior to enhance collaboration and coordinate restoration activities at all levels of government to protect fish and wildlife habitats, endangered species, improve water quality, increase public access to the estuary, mitigate flood risks, and develop public outreach and educational activities; and

WHEREAS, many residents of the region of the NY-NJ Watershed live in communities lacking environmental justice, where access to and enjoyment of fish, wildlife, clean water, and other natural resources have been impaired or compromised, federal funding is necessary to mitigate these long overdue environmental and social issues; and

WHEREAS, the Town of Rochester would benefit from the Act as it would establish beneficial programs and award grants to help fund valuable restoration projects in our local community; and

WHEREAS, the Town of Rochester is a cornerstone in which its residents depend on and the region relies on for its resources to provide prosperity throughout the state, therefore, Town of Rochester must uphold its duty to protect the community’s access to drinking water and natural resources; and

WHEREAS, the Town of Rochester has an opportunity to be a social and environmental leader of the state, by supporting the NY-NJ Watershed Protection Act, we may lead by example and facilitate much needed change; and

NOW THEREFORE, BE IT RESOLVED, that the Town of Rochester Town Board supports the passing of the NY-NJ Watershed Protection Act.

Code Enforcement and Building Department 2022 fee schedule – Fire & Safety Inspections:
The Board reviewed the the current changes to the building dept. fee schedule.

2022 Ambulance Improvement Districts Preparation:

Supervisor Baden stated that the maps were under construction. The deadline to submit a petition is the 15th. As long as no petition is submitted we can move on to stage two of the process.

Municipal Planner Employee:

The Board discussed the idea of persuing a municipal planner. Supervisor Baden received the job description from Ulster County Civil Service and asked the Board how they felt about moving forward to advertise based on the job description and the salary base.

AUTHORIZE SUPERVISOR TO ADVERTISE FOR POTENTIAL MUNICIPAL PLANNER POSITION:

Broadband Mapping:

Councilman Coleman updated the mapping for areas of coverage, non-coverage, and uncertain area locations for Broadband services. Based on the updates it looks like we have less than 40 residential homes without service. Supervisor Baden stated that we have $ 105,000 put aside from past administration and ARPA monies that can be used but I think we are in better shape than we thought.

SCHEDULE PUBLIC HEARING FOR PROPOSED LOCAL LAW A-2022: MORATORIUM:
Resolution # 187-2022:

A Motion was made by Supervisor Baden to schedule a public hearing on proposed local law A of 2022: Moratorium for April 28, 2022 Immediately following the scheduled 7pm public hearings to be held at the Harold Lipton Community Center, 15 Tobacco Rd and for the Town Clerk to circulate such notice.

AUTHORIZING THE TOWN CLERK TO SEND NOTICE:
Resolution # 188-2022:

A Motion was made by Supervisor Baden for Town Clerk to send referral of proposed local law A to the Ulster County Planning Board, the Town of Rochester Planning Board and any other agencies deemed required by State law.

CLIMATE SMART TASK FORCE:

A Motion was made by Councilwoman Enouen authorizing the Supervisor to put out a call for climate smart task force.

APPOINTMENT TO THE ZONING BOARD OF APPEALS:
Resolution # 190-2022:

A Motion was made by Councilwoman Smiseth to appoint Clayton Haugen to the vacancy on the Zoning Board of Appeals with a term to expire 12/31/2025 effective 4/11/2022.

A Motion was made by Councilwoman Enouen that the Town of Rochester Town Board motions to enter into executive session at 10:22pm for the purposes of discussions regarding proposed, pending or current litigation.

A Motion was made by Councilwoman Smiseth that the Town of Rochester Town Board reconvenes the meeting at 10:45 pm with no monies expended nor motion taken.
