#1 of 2019 VOTING PROCEDURES
Enabling Laws Town Law Article IV §60, §63, §64

Recommended resolution, that voting of the Town Board will be taken by voice vote of ayes and noes, unless a roll call vote is requested by a Council Member. Roll call voting shall be conducted in alphabetical order of each Council Member followed by the Town Supervisor. The Town Clerk or appointed minute taker shall keep a record of the vote of each Council member for each vote.

Enabling Law Town Law Article IV §62

Recommended resolution; that the Town Board 2019 Regular Town Board meeting shall be held on the first Thursday of each month at 6:30pm (except July 2019) at the Town of Rochester Town Hall, 50 Scenic Road, Accord, NY 12404, and directs the Town Clerk to post legal notice of such meeting schedule.

Recommended resolution, that the Town Board meeting to audit the Town’s bills shall be held on the last Thursday of each month at 6:00pm (except October, November, and December 2019) with the Workshop to immediately follow at 7:00pm at the Town of Rochester Town Hall, 50 Scenic Road, Accord, NY 12404, and directs the Town Clerk to post legal notice of such meeting schedule.

#4 of 2019 AUTHORIZATION OF SUPERVISOR TO ADMINISTER DAY-TO-DAY TOWN BUSINESS
Enabling Law Town Law Article III §29(16)

Recommended resolution, that the Town Board hereby authorizes and delegates to the Town Supervisor the powers and duties of day-to-day administration and supervision of all Town and special improvement district facilities and employees consistent with, and in furtherance of, any and all County, State, and Federal laws applicable thereto, and with any and all collective bargaining agreements, local laws, resolutions or policies heretofore or hereafter adopted by this Town Board.

#6 of 2019 DESIGNATION OF TOWN BANKS
Enabling Laws General Municipal Law Article II §10, §11, Town Law Article III §29

Recommended resolution, that Sterling National Bank, Catskill-Hudson National Bank, M & T Bank, Bank of America, and Key Bank Corp., shall be the depositories for Town Funds and that the Supervisor shall be authorized without limit to deposit funds at said financial institutions and other banks and trust companies that meet New York State criteria for such institutions to obtain the most favorable rates and charges available. The Supervisor shall be authorized to open, operate, maintain, and manage any deposit, checking, and investment account(s) at any such institution on behalf of the Town and shall have signing authority over such accounts

#7 of 2019 DESIGNATION OF OFFICIAL NEWSPAPER
Enabling Law Town Law Article IV §64(11)

Recommended resolution, that the Shawangunk Journal, a newspaper regularly published in Ulster County and having a general circulation in this Town and being a newspaper entered as a second-class mail matter, shall be designated as the Town’s official newspaper. Legal notices may also be published in the Daily Freeman or Times Herald Record if the Shawangunk Journal is not available in a timely manner.

#8 of 2019 APPOINTMENT OF TOWN ACCOUNTANTS
Enabling laws Town Law Article VIII §116(8), §123, Article IV §64

Recommended resolution, that the firm of Sickler, Torchia, Allen, & Churchill, C.P.A.’s P.C. shall be appointed as Independent Auditor/Certified Public Accountants for the Town for the fiscal year ending December 31, 2018.

#9 of 2019 APPOINTMENT OF LEGAL ADVISORS
Enabling Law Town Law Article III §20(2)(b)

Recommended resolution, that MaryLou P. Christiana of shall be appointed Attorney for the Town, Attorney for the Planning Board, and Attorney for the Zoning Board of Appeals at an hourly rate of $160.00 to be paid upon monthly itemized invoice and voucher and that the Supervisor shall be authorized to retain additional counsel as necessary and appropriate at applicable contracted rates.

#10 of 2019 PROCUREMENT AND INVESTMENT POLICY
Enabling Law General Municipal Law Article V-A §104-B,

Recommended resolution, that the Procurement and Investment Policies of the Town shall be adopted as amended Jan. 3, 2019, subject at all times to future revision by the Town Board

#11 of 2019 INSURANCE CONTRACT

Recommended resolution, that the Town Board authorizes the Supervisor to sign the insurance contract submitted by Sprague and Killeen for the year 2019, subject to the amounts budgeted therfor.

#12 of 2019 PAYMENT OF ADVANCE CLAIMS
Enabling Law Town Law Article VIII §118

Recommended resolution, that the Town Board authorizes the Town Supervisor to pay claims of public utility services; defined as electric, gas, water, sewer, fuel oil, and telephone services; postage, and freight and express charges, not to exceed $1,000, and to pay monthly credit card claims in advance of submitted audit bills. All such claims shall be presented at the next regular meeting for audit, and the claimant and the officer incurring or approving the same shall be jointly and severally liable for any amount disallowed by the town board.

#13 of 2019 HIGHWAY SUPERINTENDENT PURCHASES
Enabling Law Highway Law Article VII §142(1)(a)

Recommended resolution, that the Town Board authorizes the Highway Superintendent to purchase equipment, tools and other implements to be used for highway maintenance, construction or reconstruction, snow ploughs or other devices for the removal of snow from the highways from moneys appropriated for that purpose, not to exceed $5,000 without prior approval of the Town Board, except in the case of emergency repairs where statutory limits would apply. All such claims shall be presented at the next meeting for audit.

Recommended resolution, that the Town Board authorizes establishment of petty cash funds and that each Department Head shall be responsible for the accounting in accordance with Town Law Article VIII §118.

#15 of 2019 PERSONAL VEHICLE USE
Enabling Law Town Law Article VIII §116(1)

Recommended resolution, that Town vehicles shall be utilized for the conduct of Town business when available, however the Town Board authorizes employees and officials of the Town to utilize personal vehicles in the conduct of Town business with prior authorization from their department head, the Supervisor, or resolution of the Town Board. Such persons shall be eligible for reimbursement at the IRS reimbursement per mile rate for documented use, upon presentation of documentation and audit.

Recommended resolution, that the Town Board establishes the positions listed on the Salary and Wage Schedule for Elected and Appointed Positions for one year, and that the holder of each position shall be paid at the rate specified therein, subject to the amounts budgeted therefor, effective as of January 1, 2019.

Recommended resolution, that the Town Board establishes the hourly wage rates, effective as of January 1, 2019, for Highway Department employees in accordance with the terms and conditions of the collective bargaining agreement negotiated between the Town of Rochester and the International Brotherhood of Electrical Workers Local 363 for the period January 1, 2017-December 31, 2019.

#26 of 2019 TOWN BOARD APPOINTMENTS
Enabling Law Town Law Article III §20(1)(b)

Recommended resolution; The Town Board hereby directs the Town Supervisor to provide notice to the Ulster County Personnel Department of the request to create two Clerk to Justice (PT) positions, effective January 1, 2019.
Such positions shall be funded for 28 hours per week PLUS additional weekly evening court hours as needed, as per the 2019 General Fund budget, and be eligible for any and all applicable benefits as prescribed by the Town of Rochester Compensation and Benefits Manual, as adopted December 1, 2018.

Recommended resolution; Upon advice and consent of Justice Babcock, The Town Board hereby appoints Anne Marie Ogle to serve as the Clerk to Justice Babcock, effective January 1, 2019, as funded per the 2019 Wage and Salary Schedule.

Recommended resolution, that the Town Board authorizes the Recreation Director to make appointments from time to time, upon written notification to the Town Supervisor, in accordance to the adopted Salary and Wage Schedule, contingent on completion of any qualifications or certifications as may be required to fulfill the position. #30 of 2019 RE-ESTABLISHMENT of TOWN CONSTABULARY
Enabling Law Town Law Article III §20(1)(b), Town Law Article III §39, Criminal Procedure Law, §2.20

Recommended resolution;
WHEREAS, the Town of Rochester has had a Constabulary since 1710 which has served the residents of the Town in varied capacities throughout its History; and

WHEREAS, The Town of Rochester established duties of such constabulary with Resolution 90-2014; and

BE IT RESOLVED, that the Town of Rochester does hereby reaffirm the establishment and continuation the powers and duties of a town constable/ peace officer are derived from two sources: Town Law, §39, and Criminal Procedure Law, §2.20 of the State of New York.

BE IT FURTHER RESOLVED, that Town Constables shall have the following duties;
1. Make warrantless arrest pursuant to §140.25 of the Criminal Procedure Law; and
2. Issue appearance tickets pursuant to Subdivision 3 §150.20 of the State of New York, when acting pursuant to their Special duties; and
3. Issue uniform appearance tickets pursuant to Article 27 of the Parks, Recreation and Historic Preservation Law and to issue simplified traffic information pursuant to §100.25 of the Criminal Procedure Law and §207 of the Vehicle and Traffic Law whenever acting pursuant to their special duties; and
4. Issue a uniform navigation summons and/ or complaint pursuant to §19 of the Navigation Law whenever acting pursuant to their special duties; and
5. Issue uniform appearance tickets pursuant Article 71 of the Environmental Conservation Law whenever acting pursuant to their special duties; and

6. Exercise any other power which a particular peace officer is otherwise authorized to exercise by any general, special or local law or charter rule, regulations judgment or order whenever acting pursuant to his or her special duties provided such power is not inconsistent with the provisions of the Penal Law; and
7. At the direction of the Town Supervisor, appear in the Town Justice Court to keep order. This will include monitoring the weapons screening program and the security of the courts; and
8. At the direction of the Town Supervisor or by resolution of the Town Board, provide security for any Town Recreation Department functions or activities; and
9. Make collections pursuant to executions and garnishee executions issued upon judgments rendered in Justice Court; and
10. Serve civil, legal, and criminal papers, including subpoenas or orders on behalf of the Town Supervisor, Town Board, Town Justices, and/or Code Enforcement Officer/Building Inspector; and
11. At the direction of the Town Supervisor or by resolution of the Town Board maintain order at Town meetings and additional Town functions as needed; and
12. At the direction of the Town Highway Superintendent or Town Supervisor, provide traffic control during times of necessity for Town road closure; and
13. Administer the operations of the Eldercare program; and
14. Perform Criminal and Civil investigations; and
15. Shall have the power to issue traffic summonses and complaints for parking, standing, or stopping violations pursuant to the vehicle and traffic law; and
16. Perform any other duties as directed by the Town Supervisor or by resolution of the Town Board as allowed by law; and
BE IT FURTHER RESOLVED, Notwithstanding the above designation of such duties, The Town Supervisor or Town Board, by resolution, shall specifically notify the Chief Constable in writing of any requests for providing constables for any specific duties, services, or patrols. Such notice shall include the dates and timeframes of such request.

#37 of 2019 DELEGATES TO THE NYS ASSOCIATION OF TOWNS ANNUAL MEETING
Enabling Law Town Law Article VIII §116(10)

Recommended resolution, that the Town’s delegate to the Annual Meeting of the New York State Association of Towns shall be the Supervisor. The alternate delegate shall be the Town Clerk. In addition, the following shall also be authorized to attend, two Councilpersons, two Town Justices, one Zoning Board of Appeals member and one Planning Board member or two members from either board. All attendees shall be entitled to reimbursement of reasonable documented necessary and ordinary expenses up to the amount budgeted therefor.

#38 of 2019 ATTENDENCE AT TRAININGS, CONFERENCES, AND MEETINGS
Enabling Law General Municipal Law Article V §77-B

Recommended resolution, that the Town Board authorizes town elected and appointed officials and town employees to attend trainings, conferences, and informational meetings with prior approval from their department head, the Supervisor, or resolution of the Town Board, contingent on verification related costs are budgeted therefor. Registration fees and reasonable documented necessary and ordinary travel expenses shall be reimbursed, subject to Town Board audit.

a) Accepting a Donation
Recommended resolution; The Town Board accepts donations of $75 from the Kerhonkson Accord Jewish Senior Citizens, $50 from Robert Cairo and Deborah Martin, and $35 in cash from various persons.

b) Setting a Public Hearing, Local Law _ of 2019, amending Chapter 53, Animals, of the Code of the Town of Rochester.
Recommended resolution; The Town Board sets a date for public hearing of amendment of Chapter 53, Animals, of the Code of the Town of Rochester to be held following the conclusion of the Audit Meeting scheduled January 31, 2019 at 6pm at the Town of Rochester Town Hall, 50 Scenic Road/PO Box 65, Accord, NY. The public hearing will begin no earlier than 7pm. The Town Clerk is directed to post and distribute notice of the public hearing.

c) 2019 Building and Code Enforcement Office Fees
Recommended resolution; Upon advisement of the Building and Code Enforcement Department, the Town Board establishes the 2019 Fee Schedule, effective Jan. 1, 2019, as presented.

d) 2019 Planning Board and Zoning Board of Appeals Fees
Recommended resolution; The Town Board establishes the 2019 Fee Schedule, effective Jan. 1, 2019, as presented.

e) 2019 Recreation Department Fees
Recommended resolution; Upon advisement of the Recreation Department, the Town Board establishes the 2019 Fee Schedule, effective as presented.

f) 2019 Transfer Station Fees
Recommended resolution; The Town Board of the Town of Rochester establishes 2019 Transfer Station Fees, as follows, effective Jan. 1, 2019

g) Adoption of the Town of Rochester Vehicle and Fuel Usage Policy
Recommended resolution; The Town of Rochester adopts the Vehicle and Fuel Usage Policy, as presented.

h) Town Supervisor/Town Clerk – Request to Apply for a Local Government Records Management Improvement Fund (LGRMIF) Grant
Recommended resolution; The Town Board authorizes the Town Supervisor and the Town Clerk to apply for a Local Government Records Management Improvement Fund Grant (LGRMIF) to secure funding to enter into a contract with InStream, a recognized New York State Industries for the Disabled (NYSID) company, to convert the Code Enforcement and Building Department records from paper records to digital records. The Town is under no obligation to contract with Instream in any way should the grant be not approved.

i) Recreation Department – Request
Recommended resolution; To authorize the Recreation Department to contract with Goldie Goldberg to instruct at weekly line dancing sessions to be held Thursdays at 11am for a fee of $30 per session, and to authorize the Recreation Department to collect a $2.00 per participant fee. This is a Town Recreation Department sponsored event series.

j) Catskill Watershed Corporation – Nomination of Ulster County representative
Recommended resolution; The Town Board authorizes the Supervisor to place into nomination the name of Richard Parete to serve as the Town’s representative to the Board of Directors of the Catskill Watershed Corporation.

k) Request from Wild Earth to Utilize Town Facilities
Recommended resolution; Authorizing the Town Supervisor to enter into an agreement with Wild Earth, 2307 Lucas Turnpike, High Falls, NY 12440 to utilize the Town Park parking area on January 8, 2019 from 12 Noon to 5pm, pursuant to supplying a certificate of insurance naming the town as an insured party.

l) General Code Recodification
Recommended resolution; The Town Board authorizes the Town Supervisor to enter into a contract with General Code, 781 Elmgrove Road, Rochester, NY 14624 in the amount of $13,900 for recodification services, as presented. Payment shall be made with 20% ($2,680) funded in 2018, 50% (6,950) funded in 2019, and 30% ($4,170) funded in 2020.
