The Regular Town Board Meeting was held on September 6, 2018 at 7:22pm at the Town of Rochester Town Hall.

ATTORNEY for the TOWN UPDATE

LIAISON REPORTS:

Councilwoman Fornino: Youth Commission: 9/11/18 the after school program begins. 9/11: leading healthy lives class, an informative class on a healthy life style. Registration for Basketball: 9/20, 9/26, 10/1 & 10/10 from 6-7:30pm at the Kerhonkson Elementary school. Rondout Valley Lions Club Fall Festival: 9/22 from 10-4pm at the Accord Town Park. This festival is to benefit the guiding eyes for the blind. 9/23: Towpath Run/ Walk for literacy- 6K at 9:00am. 9/13 the start of line dancing. 10/6: Heritage day at the accord firehouse 10-3pm.

Councilwoman Haugen-Depuy: Total Building Permits: $ 4,962.15, C/O: $ 1,050.00 for a total of $ 6,012.15 for the month of August.

Accord Firehouse: 9/11 memorial at 8pm.

Supervisor Baden: FRIENDS annual meeting 9/14/18 at the Rochester Reformed Church topic of discussion is development of electric power.

SUPERVISOR’S UPDATE:

FARMLAND IMPLEMENTATION GRANT:
A grant application was submitted by Scenic Hudson to the NYS Department of Agriculture and Markets for the purchase of development rights on the lands owned by the Kelder and Grace Families.

CAMP RAV TOV:
The camp is closed for the summer. Thank you to the constables for assisting with the parking issue. The sewage is the Town’s biggest concern. Aside from the smell the potential for water contamination to the resident’s drinking water is worrisome. The Town will continue to monitor the situation. Supervisor Baden and Councilwoman Haugen-Depuy are meeting with the Rabbi on 9/7 at the Town Hall.

BUDGET REQUESTS:
Budget requests are out to departments. The process is being done differently this year showing a more realistic budget. Supervisor Baden is looking to schedule budget hearings come October.

PUBLIC COMMENT:

One Resident asked for clarification on the solar law found on the Town website regarding the net metering system. She also asked how a religious group can be tax exempt if they are generating a business. In regards to Camp Rav Tov there is still water in the drainage and it hasn’t rained in weeks, who will be financial responsible if there is water contamination with neigh boring wells?

Councilwoman Haugen-Depuy stated possibly a PILOT agreement can be put in place. She agreed to discuss it further with the Town Assessor.

Brit Baker stated he has heard such great things about our Town of Rochester Summer Program!

DISCUSSION

PROPOSED ESTABLISHMENT OF AN OPEN DEVELOPMENT ZONE:
Pursuant to NYS Town Law §280-a: SBL68.2-2-12: Cliff Road.
Resolution # 284-2018:

A Motion was made by Councilman Drabkin at the recommendation of Town Council to deny the open development application with the ability to revisit at another time if the applicant can prove to have legal rights over Cliff Road.

PURCHASE OF NEW COURTHOUSE BUILDING DOOR:
Chief Miller received two estimates;
1. Home Depot $ 1,751.64
2. Door Jamb $ 2,923.00

Resolution # 285-2018:

A Motion was made by Councilman Drabkin to approve the purchase of doors from Home Depot for the new courthouse building with the amount not to exceed $ 1,000.00

Discussion: Supervisor Baden stated between the approved $ 1,000.00 and the approximate
$ 500 left over from the building grant can pay for the door expense.

BOARD OF ASSESSMENT REVIEW POSITION:
Resolution # 286-2018:

A Motion was made by Councilman Drabkin to reappoint Martha Tardibouno to the Board of Assessment review with a term to expire 9/30/2023.

AUTHORIZATION FOR SUPERVISOR TO NEGOTIATE POSSIBLE LAND SWAP/EASEMENT DEJAGER LANE:
Resolution # 287-2018:

A Motion was made by Councilwoman Haugen-Depuy to authorize Supervisor Baden to negotiate with homeowner on possible land swap or easement to property located on De Jager Lane.

Discussion: In regards to an offer made by Elbert and Wilma De Jager for the purchase of Town owned land on De Jager Lane the Town Board would like to negotiate a land swap.

RESOLUTIONS

APPOINTMENT OF RECREATION AIDE: ( PT)
Resolution # 288-2018:

A Motion was made by Councilman Drabkin upon advisement of the Recreation Director, appoint Lisa Babcock and Amanda Rion to the positions of Recreation Aide (PT) subject to completion of a Town background check, filling two vacancies at a rate of pay of $11.22 per hour, effective September 9, 2018.

APPOINTMENT OF HEAVY MACHINERY EQUIPMENT OPERATOR ( HMEO) (FT):
Resolution # 289-2018:

A Motion was made by Councilman Drabkin upon advice and consent of the Highway Superintendent, appoint Leonard A. Krom to the position of HMEO (FT), filling a vacancy, at a rate of $23.99 per hour, effective October 28, 2018.

A Motion was made by Councilman Drabkin to appoint Jennifer McKenzie to the position of Highway Superintendent Secretary (PT), filling a vacancy, for 30 hours per week at a rate of $16.00 per hour, effective on or before September 23, 2018, as available.

AMENDMENT OF THE WAGE AND SALARY SCHEDULE:

A Motion was made by Councilwoman Haugen-Depuy authorizing the Supervisor to amend the Wage and Salary Schedule to reflect the 3 previous motions, as adopted pursuant to resolution #16 of 2018 and amended with resolutions #99 of 2018, #119 of 2018, #162 of 2018, #224 of 2018, #254 of 2018, and #256 of 2018.

SCHEDULE AND ADVERTISE FOR SPECIAL MEETING:
Resolution # 292-2018

A Motion was made by Councilman Drabkin to schedule a special meeting of the Town Board to be held Monday September 24, 2018 at 6:30pm at Town Hall, 50 Scenic Road, Accord, NY for the purpose of meeting with the Town human resources consultant and directs the Town Clerk to post and circulate notice of such.

APPOINTMENT TO THE HISTORIC PRESERVATION COMMISSION:
Resolution # 293-2018

A Motion was made by Councilman Drabkin to appoint Wilton Duckworth and Jens Verhaegh to serve on the Historic Preservation Commission with terms to expire December 31, 2020 and directs the Town Clerk to notify him of his obligation of oath of office.

AUTHORIZING HIGHWAY SUPERINTENDENT TO EXECUTE A CONTRACT:
Resolution # 294-2018:

A Motion was made by Councilman Drabkin upon recommendation of the Highway Superintendent, The Town Board accepts a NY State Bid quote in the amount of $5,995.00 from Hudson River Truck and Trailer, 12 Commerce Street Ext., Poughkeepsie, NY 12603, as presented, and authorizes the Superintendent of Highways to execute a contract, for the purchase of a one new Fisher 9 foot 4 ½ yard stainless dual motor sander with screens and long chute, installed with auger and spinner controls.

A Motion was made by Councilman Drabkin pursuant to Municipal Home Rule, the Town Board hereby sets a date for the public hearing of Local Law #6 of 2018 – Amending Chapter 128 -17, Taxation – Disability Exemption Levels as authorized by Real Property Tax Law 459-C, to be held Thursday October 4, 2018 at 7:00pm at Town of Rochester Town Hall, 50 Scenic Road, Accord, NY and directs the Town Clerk to post and circulate legal notice. A copy of such Local Law shall be made available in the Town Clerk office, Assessor office, and posted on the Town website.

A Motion was made by Councilman Drabkin pursuant to Municipal Home Rule, the Town Board hereby sets a date for the public hearing of Local Law #7 of 2018 – Amending Chapter 128 – 9, Taxation – Senior Citizen Exemption Laws as authorized by Real Property Tax Law 467, to be held Thursday October 4, 2018, immediately following the public hearing of Local Law #6 of 2018, which will be held Thursday October 4, 2018 at 7:00pm at Town of Rochester Town Hall, 50 Scenic Road, Accord, NY and directs the Town Clerk to post and circulate legal notice. A copy of such Local Law shall be made available in the Town Clerk office, Assessor office, and posted on the Town website.
