Supervisor Baden called the meeting to order and led in the Pledge of Alligence to the Flag.

PUBLIC COMMENT: nothing to report

ATTORNEY FOR THE TOWN:

Attorney Christiana would like to discuss possible litigation in executive session.

HIGHWAY SUPERINTENDENT REPORT:

Supervisor Baden stated the CHIPS funding, extreme weather and PAVENY numbers are better than expected. We will be fully funded and added the 15 % withheld from 2020 combine total of $ 531,277.84. We will discuss the 284 agreement later on in the meeting.

SUPERVISOR’S REPORT:

Has not been filed with the Clerk yet. We are in training mode with a new employee. Big thank you to Kareen as she is returning to her old job.

SUPERVISOR’S UPDATE/ CORRESPONDENCE REPORT:

Monthly Correspondence : parts have been emailed to the Board Supervisor Baden will get the remaining correspondences out to you all.

Assessor report: Tentative Assessment Roll: I have completed and filed the tentative assessment roll. A copy is available in the Assessor’s Office. The roll will also be available on the county web-site and accessed thru the Town website. I have posted a list of all assessments in a spreadsheet on the Town website.

Grievance Day: is scheduled for Thursday May 27 from 4-8pm. The Board will be meeting via zoom.
Change in assessment: the total assessed value of the Town in increased 1.3 % from 2020 to 2021 due to new construction.

COVID-19 report – Vaccination Site: the numbers are down in the Town of Rochester. Supervisor Baden believes 17 cases in the Town. The Vaccination site was successful with 84 walk ups. Ulster County is almost at 75% vaccinated and working on how to reach out to the remaining 25%. There has been conversation of home visits to those that cannot get out. Thank you to the Recreation Dept answering calls and notifying people of the vaccine.

NY Rising – Alligerville Firehouse update: contract is signed

Veteran’s Park: thank you to Rick Jones and members of the Highway Dept. for assisting in the planting of the 3 red maples at the Veterans Park.

Memorial Day Parade/Veterans Park Ceremony: Parade will kick off at 12pm at the Accord Fire house and finish with a ceremony at the Veterans Park at 2:00pm.

Summer Recreation Program: registration will begin in early June for 2 sessions. The first session will run the weeks of July 5, 12,19th. The second session will run August 2,9,16th. We will be limited to 30 kids per session.

DEPARTMENT UPDATES/ LIAISON REPORTS:

Councilman Paddock: Constabulary: Court is partially open. The Constabulary answered 21 direct calls for service and other duties in Apri lof 2021.

• 3 Resident Traffic Complaints (Queens’s Highway, Towpath Rd. and Whitfield Rd.)
• 2 Environmental Complaints, (Rochester Center Rd. and Route 209.)
•16 Building Department Violations•0 New Court Cases Opened*
•27 Court Proceedings Remain Open*
• 0 Court Proceedings Closed*(Due to COVID-19 Court Closures, Latest Numbers are Unavailable) Interesting Occurrences: During this month, t respasses on residents’ properties are up significantly. Complaints regarding garbage being dumped on residents’ properties and on several local roads are still ongoing and have increased. Neighbor to neighbor complaints have increased again this month with all of them beingdefused successfully and without further incident. Due to the COVID-19 pandemic, we continue to have limited direct contact with complainants with a proportional increase in direct phone calls.
Recreation dept.: they have been very busy lately with Earthday, summer program, heritage day and the mothers day packets. Many thanks to Rita for her years of service she will be retiring at the end of the month.
Councilwoman Haugen-Depuy: Court: is up and operating they are still playing catch up but processing quickly. They are also working on building dept. violations as well.
Councilwoman Enouen: nothing to report on the ZBA.
Transfer station: new signs are installed at the transfer station. We will be transitioning to the digital payment system next week and we have a new staff member that started this week. Welcome Justin!
Councilman Hewitt: We will discuss during resolutions some of the topics with the ECC.
Supervisor Baden: HPC: 6/5/21: Ash tree arts festival on the rail trail. Various artists will put there talents to work creating art work out of dead ash tree stumps. People are encouraged to walk the trail and see what these artists can do. Planning Board: the have a busy agenda 10-12 items per meeting. There are a number of subdivision projects going on as well. The Clerk’s office and the Code Enforcement office have been helping fill the gaps with no have a secretary at this time.

CREATION OF AN EMPLOYEE POSITION:
Resolutiuon # 166-2021:

A Motion was made by Supervisor Baden that upon written notice from the Ulster County Personnel Office dated April 23, 2021 of Order and Determination #11425, approving the Town of Rochester request of change to the Deputy Town Clerk position from Civil Service designation as a 0.250 part-time position to a 1.000 full-time position, the Town Board establishes the position of Deputy Town Clerk, part-time effective May 9, 2021. The position will be compensated at $15.50 per hour. The position will be funded for up to 28 hours per week. Budget Code A14101.01.014.xxx, 3rd Deputy Town Clerk, shall be established and funded in the amount of $15,000. Budget Code A19904.01.000.00, Contingency, shall be reduced by $15,000 to fund the new position.

ADDITIONAL DUTIES OF 3RD DEPUTY TOWN CLERK:
Resolution # 167-2021:

A Motion was made by Supervisor Baden that pursuant to NYS Town Law, Article 3, Section 30 (10)(a), the Town Board establishes the duties of the 3rd Deputy Town Clerk to include assistance to the Building Department/Code Enforcement Office, as required. The Town Board further delegates the Town Clerk to establish other duties for the position and to determine the employee’s schedule in consultation with the Town Supervisor and the Code Enforcement Officer.

TOWN CLERK TO MAKE APPOINTMENT OF 3RD DEPUTY TOWN CLERK:

Town Clerk Gundberg appoints Courtney Coffey to serve as 3rd Deputy Town Clerk for 28 hours a week at a rate of pay of $ 15.50 per hour.

SETTING HOURLY WAGE AND HOURS FOR AN EMPLOYEE POSITION:
Resolution # 168-2021:

A Motion was made by Supervisor Baden that the Town Board amends the Wage and Salary Schedule of 2021 to change the position of Confidential Secretary/Bookkeeper to be funded at $20.00 per hour for 40 hours per week. The stipend for “Purchasing” is removed with this employee change.

The board discussed when the rate of pay would begin.

AMEND RESOLUTION # 168-2021:

A Motion was made by Supervisor Baden that the Town Board amends the Wage and Salary Schedule of 2021 to change the position of Confidential Secretary/Bookkeeper to be funded at $20.00 per hour for 40 hours per week. The stipend for “Purchasing” is removed with this employee change.

Supervisor Baden appoints Timothy Hurley to the position of confidential secretary/ bookkeeper.

AUTHORIZATION TO WORK ADDITIONAL HOURS:
Resolution # 169-2021:

A Motion was made by Councilwoman Enouen that the Town Board authorizes Christina Ferrara to work an additional 5 hours per week until May 31, 2021 in addition to normal work hours as 1st Deputy Clerk to assist the Assessor and will be compensated at the regular rate of pay. The Town Board further authorizes the employee to assist the Assessor on Grievance Day, May 27, 2021.

AUTHORIZING USE OF TOWN HIGHWAYS:
Resolution # 170-2021:

A Motion was made by Councilman Paddock that the Town of Rochester Town Board authorizes the Town Supervisor to sign the proposed agreement authorizing the use of certain Town roadways for the charity bike ride event “The Ride for Mental Health” to be held June 19, 2021 and June 20, 2021 upon presentation of a Certificate of Liability Insurance certificate naming the Town of Rochester as an additional insured party.

2021-2023 ABRASIVE SAND BID:
Resolution # 171-2021:

A Motion was made by Councilwoman Haugen-Depuy that the Town Board requests the Town Clerk post advertisement seeking sealed bids for abrasive screened sand for winter road use. Specifications of bids are available at the Town Clerk Office and on www.townofrochester.ny.gov. Bids are due on or before Wednesday June 2, 2021 at 11:00am at the office of the Town of Rochester Clerk, PO Box 65 / 50 Scenic Road, Accord, New York 12404 where they will be opened and read aloud. A non-collusion form and certified testing results shall be included as a part of the bid package. The Town Board has the right to reject any and all bids.

SPECIFICATIONS:

1. The sand shall be hard with 100% passing 3/8″ screen, not more than 15% passing #50 mesh and not more than 4% passing #200 mesh and must be readily usable in spreading equipment.
2. Certified testing results shall be submitted as a part of the bid package.
3. Bid prices shall be priced per ton; variations will not be accepted.
4. The bidder’s attention is called to the fact that if scales are not available at plant site, the bidder must state conversion factor-weight per cubic yard on bid conversion sheet.
5. Sand is to be made available for pickup by trucks designated by Town of Rochester authorized entities and operated by authorized personnel.
6. Bids shall be guaranteed valid for a period of 2 years from July 1, 2021 through June 30, 2023.

AUTHORIZATION TO AMEND THE 2021 FLEXIBLE SPENDING ACCOUNT- FSA: (Resolution 221-2020)

A Motion was made by Councilwoman Enouen that the Town Board makes offer to employees the opportunity to enroll in the MVP Select Care, Inc. Flexible Spending Account Health FSA in an amount up to $2750 per year with a grace period of 2.5 months after the end of the plan year to utilize all funds, effective December 1, 2020 through November 30, 2021, as presented by Marshall and Sterling Group Benefits, and authorizes the Supervisor to sign the agreement.

A Motion was made by Councilwoman Enouen and seconded by Councilman Paddock to amend the following:

The Town Board amends resolution 221-2020 due to MVP FSA changes per Consolidated Appropriations Act (CAA)/American Rescue Plan (ARPA) to allow the following
1. Election Changes – Employees shall be allowed to revoke their current FSA elections, make new, increase, or decrease. The enrollment period shall be for a period of May 10, 2021 through June 11, 2021.
2. 12-Month Extended Grace Period – This changes the current 2.5 month grace period to 12 months for the 2021 Medical FSA

SETTING A SPECIAL WORKSHOP MEETING:
Resolution # 173-2021:

A Motion was made by Supervisor Baden that the Town Board sets a special workshop meeting for Thursday May 13, 2021 at 5:00pm via videoconference for the purposes of the Bard College graduate student presentation of the Climate Smart Communities Gap Analysis project and requests the Town Clerk post legal notice. The Town Board will further invite the members of the Environmental Conservation Commission to attend.

Discussion: Supervisor Baden stated that he picked this date because this was part of a graduate program to work with municipalites to do analysis of documents, renewed and geared towards climate smart.

Resolution # 175-2021:

A Motion was made by Councilman Paddock that the town Board accepts a donation of “excellent condition” used playground equipment donated by Accord resident Connor Lawrence. Mr. Lawrence is employed by a playground equipment installer and he will coordinate delivery with the Town Supervisor and also consult on the installation and assembly of the equipment.

AUTHORIZING WORK ON TOWN PROPERTY:
Resolution # 176-2021:

A Motion was made by Councilman Hewitt that the Town Board authorizes volunteers Councilman Hewitt, members of the ECC, and members of the public to Identify and remove invasive species including multiflora rose, barberry, and Japanese knotweed, abiding by NYS DEC recommendations, for the Town property located at 6140 US Highway Route 209. There is to be no cost incurred by the Town.

Discussion: Councilwoman Haugen-Depuy asked if there are a copy of DEC regulations. I have concerns of disturbances to the streams. What are the requirements for removing land near streams? What was the responses from the bounding owners?
Councilman Hewitt: some residents didn’t get the letter in time and were told where they can view the presentation. Some residents attended the presentation and showed interest and gave positive feedback. I never heard of DEC regulations regarding removal of invasive species. The volunteers will not be near the stream.
Councilwoman Enouen stated that there are general guidelines regarding the buffer of the stream.
The Board agreed to amend the resolution to include the following;

A Motion was made by Councilwoman Haugen-Depuy that the Town Board approves the expenditure of $ 489,536.02in highway monies for the primary work and general repairs of 111 miles of Town highways, in accordance with Section 284 of the Highway Law, and authorizes signature of the agreement. The expenditures have been verified as being budgeted Highway Fund amounts for 2021 by the Supervisor.

A Motion was made by Councilwoman Enouen that the Town Board sets a continuation of the public hearing for Local Law 2-2021, Amendment to Chapter 140, Zoning, to be held Wednesday May 26, 2021 at 6:00pm by video and teleconference in accordance with the Governor’s Executive Order 202.1 and successors, and requests the Town Clerk post notice of the hearing. The public hearing will be immediately followed by the May Workshop meeting.

A Motion was made by Councilwoman Haugen-Depuy that the Town Board sets public hearing for Local Law 3-2021, Amendment to Chapter 132, Vehicles and Traffic, to be held Thursday June 3, 2021 at 6:30pm by video and teleconference in accordance with the Governor’s Executive Order 202.1 and successors, and requests the Town Clerk post notice of the hearing. The public hearing will be immediately followed by the June Regular meeting.

Discussion: after a brief discussion the Board agreed to send notice to people located on the road.

A Motion was made by Councilwoman Haugen-Depuy that the Town Board sets public hearing for Local Law 3-2021, Amendment to Chapter 132, Vehicles and Traffic, to be held Thursday June 3, 2021 at 6:30pm by video and teleconference in accordance with the Governor’s Executive Order 202.1 and successors, DIRECTS Supervisor Baden to coordinate to send letters to people on the roads and requests the Town Clerk post notice of the hearing. The public hearing will be immediately followed by the June Regular meeting.

CLIMAT SMART COMMUNITY TASK FORCE:
Resolution # 180-2021:

A Motion was made by Councilwoman Enouen and Seconded by Councilman Hewitt;

Whereas the Town of Rochester passed the Climate Smart Communities Pledge Resolution on December 03, 2020; and

Whereas the Town of Rochester recognizes the impact climate change can have on the economy, human health, and natural resources; and

Whereas the Town of Rochester seeks to take actions that will improve its resilience to the impacts of climate change, reduce its energy consumption, and transition to renewable energy; and

Whereas the NY State Climate Smart Communities program lists the creation of a Climate Smart Communities Task Force as a mandatory step in the program;

Now therefore be it hereby resolved, that the Town Board of Rochester hereby creates the Climate Smart Communities Task Force to be known locally as the Town of Rochester Climate Smart Communities Task Force; and

Be it further resolved that the Climate Smart Communities Task Force shall consist of at least 5 but no more than 11 voting members of the community and municipal government, including the Climate Smart Communities Task Force Coordinator and one Town liaison (either elected official or staff); and

Be it further resolved that the Town Board will appoint members of the Climate Smart Communities Task Force with input from the Climate Smart Communities Task Force Coordinator; and

Be it further resolved that the Town Board recognizes that the Climate Smart Communities Task Force itself will be more resilient when a broad and diverse group comprise the membership of the Climate Smart Communities Task Force, that could include, but is not limited to members engaged in agriculture, members with long standing history in the town, members who own businesses, members with a knowledge of climate science, members with disaster relief experience, members with knowledge of the history and natural resources of the town, and members with a knowledge of town codes and laws; and

Be it further resolved that the Climate Smart Communities Task Force shall provide the Town Board with information about establishing and implementing Climate Smart initiatives, to propose new ideas to the Town Board, to identify funding sources for projects and paybacks from investments, and to manage climate-related projects, and the engage the community for input, education, and the sharing of ideas; and

Be it further resolved that the Climate Smart Communities Task Force shall meet at least twice a year; and

Be it further resolved, that the voting members of the Climate Smart Communities Task Force shall serve at the pleasure of the Town of Rochester Town Board.

The question of the adoption of the foregoing Resolution was duly put to a vote which resulted as follows:

AMERICAN TOWER CORP. LEASE:

Supervisor Baden asked the Board what they want to do moving forward. It was agreed to discuss it further at the workshop meeting.

MARBLETOWN RESCUE SQUAD:

Attorney Christiana reviewed the contract. One question she did have was we are paying $ 5,000.00 a year for 101 homes and Accord/ Kerhonkson is serving the remaining properties and receive $ 22,000.00 and volunteers. Attorney Christiana stated she will look into the numbers more.
Regarding the New Paltz regional ambulance looking for letter of support to expand considerably it was agreed to have Supervisor Baden reach out to Accord/ Kerhonkson to discuss their thoughts.
Councilman Hewitt: it will be hard to have a per home cost because the ambulance services all types of car and vehicle accidents, hikers, etc.
Councilwoman Enouen stated that we relying heavily on our volunteers.
Supervisor Baden stated that he wants to keep it fair and eqitable. We do contract with KAFAS the fuel, plow, salt and sand the parking lot which helps the organization a lot.

AUTHORIZE SUPERVISOR BADEN TO DISCUSS WITH KAFAS:

Supervisor Baden stated that he would like to advertise on indeed the open position of secretary to the Planning Board and Zoning Board of appeals . The Board agreed to send the Planning Chair and ZBA chair resumes for those who apply and send recommendations to the Town Board to interview with a smaller pool of applicants.

A Motion was made by Councilwoman Enouen authorizing the Supervisor to circulate notice on indeed for the Planning Board and Zoning Board of appeals secretary with the cost not to exceed $ 150.00.

CODE ENFORCEMENT STAFFING:

Supervisor Baden stated that in order to hire a full time position the Board would have to pick someone that is on the current list. Jerry Davis approached Supervisor Baden with a suggested 20 hour a week clerk.
Councilwoman Enouen stated , “ my initial thought was someone with expertise, I’m interested in who they have in mind.”
Councilman Hewitt stated he would like the Board to follow Jerry’s led.

EXECUTIVE SESSION:

A Motion was made by Councilwoman Enouen to enter into executive session at 9:32pm regarding the following;
1. Proposed acquisition of particular property
2. Potential employment of a particular position
3. Potential litigation
