The Board discussed repairing structures as opposed to starting over.
Councilman Hewitt stated he was looking forward to this presentation and thanked the gentlemen for their work.

COALITION OF WATERSHED TOWNS:
Rick Coombe, Chairman, Coalition of Watershed Towns https://coalitionofwatershedtowns.org/

Mr. Coombe explained the purpose of the coalition is to protect the Towns legally. These dues help pay the attorney costs to protect our water from the City. The total of the Town dues asked is $750.00. The part of the Town that is in the coalition is located in Yeagerville.
Councilman Hewitt stated that he is in support of the membership.
Supervisor Baden stated that we would owe for 2020 and 2021. Somehow last years dues fell through the cracks.
Councilwoman Enouen stated she is in support of the 2020 & 2021 membership dues.

Assessor report: New Construction: The Assessor has started to review the status of open building permits. The Assessor will be inspecting properties and updating the records and assessments as necessary. All properties are assessed as of their status as of March 1, 2021. Exemptions renewal applications deadline was March 1. Mike Dunham thanked Kate, Chrissy and Tina for helping the office during the end of the month taking applications and helped property owners when the office was not opened.
COVID-19 report: numbers are down significantly. Ulster County Community College is a new site locations for vaccines.
UCTC Request for Planning Projects update: at the February meeting the Route 44/55 cooridor with the Town of Gardiner was approved. The management of study at the intersection of route 209/ Boice Mill Rd is included, O & W trail signage was accepted. The Boice Mill Road bridge cost exceeds the funding available we are going to try to resolve in State and Federal funding.
NY Rising – Alligerville Firehouse update
IT update: 3 computers stations have been replaced. We have 8 more on order. This will replace the Assessors office and CEO office computers, 2 Recreation Dept. and 1 in Planning and Zoning.

DEPARTMENT UPDATES/ LIAISON REPORTS:

Councilwoman Enouen: we still have 79 stone ridge library memberships available.
Transfer Station: Working with Jeff on implementing a safety vest policy, working with Harry on a sorting table like they do at the Town of Wawarsing. Would like to discuss it as a whole at the workshop meeting. I noticed the sign at the park is worn would like to see us get a new sign for there as well.
Councilman Paddock: bags to benches is going well. St. Patrick’s day meals to go on 3/17/21. Sign up for your time slot for pick ups.
Constabulary report: Court is partially open. The Constabulary answered 8 direct calls for service and other duties in February of 2021.These included:•5 Neighbor to Neighbor and Quality of Life Complaints• 2 Resident Traffic Complaints (Towpath Rd. and Whitfield Rd.)• 2 Environmental Complaints, (Rock Hill Rd.and Queens Hwy.)• 2 Building Department Violations• 0 New Court Cases Opened*• 27 Court Proceedings Remain Open*• 0 Court Proceedings Closed* (Due to COVID-19 Court Closures, Latest Numbers are Unavailable)Interesting Occurrences: During thismonth, complaints regarding trespasseson residents’ properties are down again. Complaints regarding junk cars on properties are on the rise. Complaints regarding garbage being dumped on privateproperties and on several local roads are still on going. Neighbor to neighbor complaints have increased this month with all of them being defused successfully and without further incident. Many are on going and could be resolved in the next month. Due to the COVID-19 pandemic, we continue to have limited direct contact with complainants with a proportional increase in direct phone calls.
Councilwoman Haugen-Depuy: gave the court presentation in comparison to the NYS comptroller reports. Councilwoman Enouen discovered the May/ June issue of the State not billing the Town for their portion of fines and Kareen has been in contact with the State and waiting on an answer. In the meantime the Town is going to send a cover letter showing what the Courts has paid.
Councilman Hewitt: the ECC is doing great work, great attendance, the engaging with the guest speakers have worked out great . The last zoom had 55 people in attendance. April’s meeting will be about the watershed education park. May guest speaker Laura Chavez Silverman: Introduction to foraging, June: Speaker Judith Karpova: energy efficiency and July: John Thompson :Invasive insects.
The Recreation Department and the ECC will be hosting Earth Day this year!
Supervisor Baden stated that Bard College has a environmental studies program where they chose 2 municipalities to review existing plans at zero cost to the Town. The Town of Ulster and Rochester were selected.
HPC: working on publizing the Rail Trail history in the Town of Rochester. Member Deb Medenbach wants to work with local artists on painting stumps along the trail. These would be stumps from trees that needed to be cut.

TOWN BOARD MEMBER TIME:

Councilman Paddock stated the presentation of the building conditions survey was detailed and we got our monies worth. It was a nice presentation.
Supervisor Baden stated the Town has addressed some of the issues since the time of the survey.

Economic Enterprise Overlay review – Walnut Brook:
The EEO gateway meeting is scheduled for 3/5/21 at 2:00pm.
Supervisor Baden stated that Rick Jones correspondence letter discussing the application addresses some interesting points.
Attorney Christiana stated this is a good gateway meeting even for the Planning Board

American Tower Corporation Lease – request to consider a proposal
Supervisor Baden asked the Board to review the proposal and they can discuss it further at the workshop meeting.

A Motion was made by Supervisor Baden that the Town Board has received request from Accord Speedway for 1 additional racing date and 1 additional rain date and amends a portion of resolution 248-2020 to state:
“The Town Board further accepts the racing schedule as presented for 37 38 actual racing dates and 27 28 potential rain dates. Dates listed as rain dates may be utilized only to replace a rained out approved event date.” so as to allow racing on May 11, 2021 with a rainout date of May 12, 2021.

A Motion was made by Councilwoman Haugen-Depuy that the Town Board authorize the Town Supervisor to send a copy of the audit of the Justice Court records for the fiscal year ending December 31, 2020 to the State of New York Unified Court System with a cover letter from the Town Supervisor.

AUTHORIZING A CONTRACT: ALERT ALARM AND SECURITY:
Resolution # 120-2021:

A Motion was made by Supervisor Baden;

WHEREAS, the Town of Rochester Town Board has received recommendation by the Town insurance carrier a fire and smoke alarm system for the Town of Rochester Town Hall is needed and necessary; and

WHEREAS, The Town of Rochester is seeking a fully designed, installed, and continuing monitoring services for a smoke and fire alarm system at 50 Scenic Road, Accord, NY 12404 for the Highway Garage and the Town Hall; and

WHEREAS, The Highway Garage should utilize Rate of Rise sensors and he Town Hall should utilize Smoke and Carbon Monoxide detectors; and

WHEREAS, the project was formally bid in accordance with municipal requirements, and publicly advertised on January 11, 2021 on the NYS Contract Reporter and in the January 14, 2021 Shawangunk Journal newspaper; and

WHEREAS, respondents were to return bid responses no later than Wednesday, February 3, 2021, at 2:00 PM and

WHEREAS, respondents were required to submit a combined priced bid for design of the system, Installation of the system, and monitoring of the system; and

WHEREAS, Six (6) bids were received ranging from a low bid of $16,471.00 to a high bid of $36,141.06; and

WHEREAS, the lowest responsible bidder for services is Alert Alarm and Security, 27 Commercial Dr. West, Johnson, City, NY, in the amount of $15,967.00 for design and installation and $504.00 for annual monitoring; and

WHEREAS, The Town Board resolved to accept the lowest responsible bid on February 25, 2021 with resolution 105-2021; and

THEREFORE, The Town Board authorizes the Supervisor to sign acceptance of the terms of proposal.

A Motion was made by Supervisor Baden;

Whereas, The Town of Rochester Town Board desires to amend the Code of the Town of Rochester, Chapter 17, Ethics to allow for an alternate member; and

THEREFORE, the Town Board adopts Local Law 1 of 2021, Amendment of Chapter 17, Ethics and requests the Town Clerk file the Local Law with the Department of State.

Amending Chapter 17, Ethics, of the Code of the Town of RochesterAmending Local Law 5 of 2004, as amended by Local Law 1 of 2005, as amended by Local Law 2-2008.

This local law also repealed former Ch. 17, Ethics, adopted as follows:
Art. I, Code of Ethics, 9-3-1970 by L.L. No. 2-1970; Art.II, Board of Ethics, 9-3-1970 by L.L. No. 3-1970.
Be it enacted by the Town Board of the Town of Rochester as follows:

Section 1. Pursuant to, and in accordance with, the provisions of the New York State Municipal Home Rule Law and the NYS General Municipal Law, Article 18, §808, the Town of Rochester Town Board amends Chapter 17, Ethics, of the Code of the Town of Rochester as follows.§ 17-2 Definitions. , shall be amended to add the following definition: ALTERNATE MEMBER An individual appointed by the Town Board to serve when a regular member is unable to participate on amatter before the Ethics Board as provided herein.

Section 2. Pursuant to, and in accordance with, the provisions of the New York State Municipal Home Rule Law and the NYS General Municipal Law, Article 18, §808, the Town of Rochester Town Board amends Chapter 17, Ethics, of the Code of the Town of Rochester as follows.Article II, Board of Ethics, § 17-8 Establishment; membership. shall be deleted in its entirety and replaced as follows: § 17-8 Establishment; membership. A. There shall be a Board of Ethics consisting of five members to be appointed by a majority of the Town Board, who shall serve without compensation and at the pleasure of the Town Board. A majority of such members shall be persons other than officers or employees of the Town of Rochester, except that at least one member shall be an elected or appointed officer or employee of the Town of Rochester. B. Ethics Board members shall reside in the Town and shall not hold an office in any political organization.
C. Members shall serve for a term of five years. Consecutive service shall not exceed two full terms. When a vacancy occurs, it shall be filled within 60 days for the unexpired portion of the term. However, members shall serve until their successors have been appointed. D.Alternate Member. 1)The Town of Rochester Town Board shall appoint an Alternate Member to the Ethics Committee 2)Alternate members shall be appointed by the Town Board, or other duly authorized appointing authority, for a term of three year(s).3)The Chairperson shall designate the alternate member to substitute for a regular member for any matter or period of time (1) such regular member is recused due to conflict of interest; (2) such regular member has or will have extended absence from the Board of two or more months; or (3) to establish a quorum for a specific meeting. When so designated, the alternate member shall remain in place for all subsequent review of any specific matters until such time as the matters is decided and shall possess all the powers of a regular member of the Board. The Chairperson shall make such designation by verbal statement indicating which regular member is being substituted for and shall direct such designation be made in the minutes of each meeting the alternate is substituted.4)The Alternate Member shall not take part in any deliberation of any matter unless designated to substitute by the Chairperson.

Section 3. SeverabilityIf any part or provision of this local law is judged invalid by any court of competent jurisdiction, such judgment shall be confined in application to the part or provision directly on which judgment shall have been rendered and shall not affect or impair the validity of the remainder of this Law or the application thereof to other persons or circumstances. The Town hereby declares that it would have enacted the remainder of this Law even without such part or provision or application.

Section 4. Effective Date This local law shall become effective immediately upon the filing in the office of the New York Secretary of State pursuant to Section 27 of the Municipal Home Rule.

LOCAL LAW 3 OF 2021: SETTING A PUBLIC HEARING AMENDMENT TO CHAPTER 125: SUBDIVISION:
Resolution # 124-2021:

A Motion was made by Supervisor Baden;

Whereas, The Town of Rochester Town Board desires to amend the Code of the Town of Rochester, Chapter 125, Subdivision to correct a discrepancy between a definition and code text; and

Whereas, The Supervisor has completed a Part 1 assessment for the action and the Town of Rochester Town Board classifies this action as a Type 1 action with the Town of Rochester being designated lead agency for the purposes of the State Environmental Quality Review Act; and

THEREFORE, the Town Board requests the Town Clerk circulate referral of the Local Law to the Town of Rochester Planning Board and the Ulster County Planning Board and requests the Town Clerk post and advertise legal notice of a public hearing for Local Law 3 of 2021, Amendment of Chapter 125, Subdivision to be held April 8, 2021 at 6:30pm, to be held either in person at the Harold Lipton Community Center or via videoconference in compliance with the Governor’s Executive Order 202.1 and successors.

Discussion:
Councilwoman Haugen-Depuy asked if this was something that was picked up by General Code?
Supervisor Baden stated no, it was found by the Planning Board. It’s a misclarifications, silly mistake in writing thatbpeople have to jump through hoops for a minor subdivision.
Attorney Christiana stated that she recommends the change.
