The Regular Town Board Meeting was held on April 5, 2018 at 7:00pm at the Town of Rochester Town Hall.

CORRESPONDENCE REPORT:
County Executive is working to assist local municipalities with short term rentals.

The ceremony at the Community Center naming it the Harold Lipton Community Center was a great turn out with a reception to follow. A big thank you to Ashley Sweeney, Rita Harkins and Bethany Dennin from the Recreation Department for putting it all together. They put photos together from the beginning when the construction began of the community center to the grand opening. Thank you to the buildings and grounds crew for painting the front of the building it looks great!

April 2, 2018 Agriculture business workshop meeting was held with approximately 50 attendees. Several compliments were made.

April 18, 2018 6pm at the Kerhonkson Firehouse the Town of Rochester, Town of Wawarsing and Ulster County are holding an open community forum to help identify revitalization targets and strategies that could bring new funding and financing incentives to the hamlet of Kerhonkson.

Community Solar Projects: Borrego Solar would like to hold the vendor fair after they are finished with the Town Planning Board, hoping for May. The fair is to hire preferably vendors within our area for tree clearing, fencing, etc.

Supervisor Baden announced that Assembly Bill 9059 & Senate Bill 7509 discussed last month in regards to state land was removed from the State budget which is great news.

SUPERVISOR’S REPORT: Filed with the Town Clerk

PRESENTATIONS:

Mike Dunham Assessor for the Town of Rochester gave a presentation for a cyclical re-assessment plan. By doing this not only will equalization rates be back up to 100% from 93.5% but the Town will receive $ 22,000 from the State doing so. In order for the State to accept the project and the level of Assessment the Town would have to adopt the 6 year plan the Assessor has proposed and would have to complete a data verification of all properties. The Plan will begin in 2019 and be completed by 2023. The only cost to the Town is postage, paper and envelopes.

Tim Guinee member of the Climate Reality Project of the Hudson Valley & Catskill Chapter presented to the Town Board the 100% Committed Campaign. Signing the pledge means the Town is joining a global movement to become powered by 100 % renewable electricity by 2030 and working with the charter to build support for real climate solutions.

Councilwoman Haugen-Depuy asked what the cost is to the Town?
Mr. Guinee stated the Town would have a savings and it would cost nothing.
Councilwoman Haugen-Depuy stated that there has to be some cost to the Town, whether it is changing wires, lighting, etc.. In the long run there has to be a cost. Nobody give nothing for nothing.
Supervisor Baden stated there is no cost of commitment of financial obligation to the Town. By signing the pledge we could receive additional points on grants.
Councilwoman Haugen-Depuy stated, “we don’t need a pledge to do the right thing, I believe the people of the Town are smart enough to fundamentally do the right without being a part of the Charter.”

LIAISON REPORTS:
Councilwoman Fornino: The Youth Commission: The St. Patrick’s Day Luncheon was a huge success, over 120 people were in attendance. The Easter Egg Hunt was held on 3/24/18. There was a great showing for the Harold Lipton Ceremony. Earthday cleanup will be held on April 14 & April 21. Call the Youth Department to sign up a road.
Councilwoman Haugen-Depuy: Building Department: For the month of March a total of
$ 4,210.65 was collected for building permits, $ 1,410.00 was received for Certificate of Occupancy for a total of $ 5,620.65.

PUBLIC COMMENT:

Len Bernardo spoke in regards to the public hearing on the solar array coming from the perspective of two issues. 1: process; “we have a new Board member who has missed any public comment that was directed at this Board. Can Supervisor Baden direct town council to see if we need to not pick up where we started at the public hearings with the Planning Board but to bring it back here to this Board so the new member could have heard the comments from the public directly.”
Attorney Christiana stated the answer is no.

Len Bernardo stated, 2: “the most important issue is what is going on at the Planning Board public hearing regarding the solar array. We have issues regarding children’s health, educational issues where children are not able to learn correctly because of being exposed to the solar array like this. The Planning Board members themselves recently went to the site and they didn’t realize how close 80 ft. was. If anyone of you have children the answer should be no! It affects health, pregnancy and we need to stop it. And I urge the Board to make a friendly amendment to the Planning Board that it is ok to vote no, and the Board needs to give them the power to vote no.”

100% COMMITTED CAMPAIGN:
Resolution #113 -2018:

A Motion was made by Councilwoman Haugen-Depuy authorizing the Supervisor to enter into an agreement with The Climate Reality Project Hudson Valley & Catskills Chapter for the 100% Committed Campaign.

Discussion: Councilwoman Haugen-Depuy stated she doesn’t want to make the pledge. She believes this Town is smart enough to do it without pledging to anyone, and have enough common sense to do so.
Supervisor Baden stated it’s not a matter of being smart enough, there is no downside to signing the pledge. By signing the pledge it raises eligibility of grants, 1 or 2 points can be a difference of thousands of dollars.

Resolution #114- 2018:

A Motion was made by Councilman Drabkin to adopt the Cyclical Re-assessment Plan and 2019 Revaluation Schedule, as presented by the T/Rochester Assessor; and to authorize the Assessor to complete a data verification of all town properties; and to provide funding for postage and mailing in the 2019 budget; and to authorize the Supervisor to sign and submit the Plan for Cyclical Reassessments to the NYS Office of Real Property Tax Services and the Assessor is directed to report to the Town Board the completion on an annual basis.

A Motion was made by Councilman Drabkin to appoint Ronald Lapp Jr. to the Board of Assessment Review to fill a vacancy for a term to end Sept. 30, 2020.

AUTHORIZING SUPERVISOR TO ENTER IN CONTRACT ON BEHALF OF THE TOWN:
Resolution # 120 -2018:

A Motion was made by Councilman Drabkin to authorize the Supervisor to enter into a contract with Sickler, Torcia, Allen, & Churchill, CPA’s, PC payable at an hourly rate for the services as presented with the total not to exceed $3500 and to reimburse travel expenses from their office to the T/Rochester Town Hall at the current IRS mileage rate of $.545 per mile.
1. Review the Town of Rochester bill payment and voucher system as is done currently and offer suggestions and procedures to implement as how to improve the efficiency, legal, and accounting principles of the current process.
2. Review the bookkeeping practices currently employed by the Town of Rochester and offer suggestions and procedures to implement as how to improve the efficiency, legal, and accounting principles of the current process.

Discussion: Councilwoman Haugen-Depuy stated that the State requires books to be done in certain codes, entities. This to a review process of making sure we have proper book keeping and everything is handled in the proper manner.
Supervisor Baden stated that we don’t have an audit of our books done. The firm will go through our records, this is a baby step process of practices, procedures, and they have a good understanding of our record keeping.

REQUESTING NYSDOT SPEED STUDY ( KYSERIKE RD):
Resolution # 121-2018:

A Motion was made by Councilman Drabkin to request the New York State Department of Transportation to conduct a speed study in the vicinity of the Rondout Valley High School to establish a lower maximum school zone speed limit,

WHEREAS, the public health, safety, and welfare would be served by the establishment of a school zone with a lower maximum speed limit in the vicinity of the Rondout High School, along Kyserike Road, Town of Rochester, Ulster County, New York; and,

WHEREAS, Ulster County, in the interest of the public health, safety, and welfare, has expressed interest to install and maintain upgraded School Zone Speed Limit Signage; and,

WHEREAS, the Town requests the establishment of a Lower Maximum School Zone speed Limit of 35 miles per hour, in the vicinity of the Rondout High School, along Kyserike Road, Town of Rochester, Ulster County, New York ; and,

WHEREAS, the Rondout School District is in support of efforts to improve roadway safety near their facility and specifically supports a request from the establishment of a reduced speed school zone; and therefore,

BE IT RESOLVED, that the Town of Rochester, pursuant to Vehicle and Traffic Law Section 1622 hereby requests the New York State Department of Transportation and the Ulster County Commissioner of Highways to install a reduced maximum speed limit, as a school zone, in the vicinity of the Rondout High School, along Kyserike Road, Town of Rochester, Ulster County, New York; and,

BE IT FURTHER RESOLVED, that the Town Board hereby directs the Town Supervisor to take whatever steps that are reasonably necessary to carry out this resolution, and directs the Town Clerk to send a certifies resolution to the Ulster County Commissioner of Public works.

A Motion was made by Councilwoman Haugen-Depuy to increase the rate paid to Sheila Brown for custodian services at the Community Center, Highway Dept., and Justice Court to $14.00 per hour effective April 1, 2018.

AUTHORIZATION TO ADVERTISE FOR ABRASIVE SCREENED SAND:
Resolution # 124 -2018:

A Motion was made by Councilman Drabkin to authorize the Town Clerk to advertise a request for bids for abrasive screened sand. Sealed bids shall be received by mail or in person on or before 5/2/2018 at 11:00am in the office of the Town of Rochester Clerk PO Box 65 Accord, New York 12404 where they will be opened and read aloud. A non-collusion form must be included. The Town Board has the right to reject any and all bids.
Specifications: The sand shall be hard with 100% passing 3/8″ screen, not more than 25% passing #50 mesh and not more than 4% passing #200 mesh and must be readily usable in spreading equipment. Sand is to be made available for pickup by trucks designated by authorized entities and operated by authorized personnel.
Bid prices shall be priced per ton only, variations will not be accepted. Bids shall be guaranteed valid for a period of 1 year from award date of bid. The bidder’s attention is called to the fact that if scales are not available at plant site, the bidder must state conversion factor-weight per cubic yard on bid conversion sheet.

Resolution # 125 -2018:

A Motion was made by Councilwoman Haugen-Depuy to authorize the Town Clerk to advertise a request quotes from vendors to provide tree trimming services. Each option shall be a separate quote. Sealed quotes shall be received by mail or in person on or before 5/2/2018 at 11:05am in the office of the Town of Rochester Clerk PO Box 65 Accord, New York 12404 where they will be opened and read aloud. A non-collusion form must be included. The Town Board has the right to reject any and all quotes.

NATURAL HERITAGE PLAN:
Resolution: 129-2018:

Whereas, in 2015, the Town of Rochester was awarded a $10,000 grant by the New York State Department of Conservation Hudson River Estuary Program with contract #T305367; and
Whereas, The Town of Rochester Town Board issued a Request for Proposal to seek sealed bids for a consultant to perform an Open Space Inventory with resolution #78-2015 on June 4, 2015; and
Whereas, The Town of Rochester Town Clerk posted advertisement seeking Request for Proposal for the first phase of the Open Space Plan on June 5, 2015; and
Whereas, The Town of Rochester Town Board issued an extension to the Request for Proposal seeking sealed bids for a consultant to perform an Open Space Inventory with resolution #82-2015 on June 25, 2015; and
Whereas, The Town of Rochester Town Clerk posted advertisement of an extension of Request for Proposal for the first phase of the Open Space Plan on June 26, 2015; and
Whereas, The Town of Rochester Town Board approved proposal by John Mickelson of Ecological & Geospatial Service to conduct the Open Space Inventory in accordance with agreement in their proposal with resolution #99-2015 on August 6, 2015; and
Whereas, Mr. Mickelson and a group of volunteers conducted a series of meetings resulting in the document Town of Rochester Open Space Inventory, dated January 2016; and
Whereas, the document Town of Rochester Open Space Inventory, dated January 2016 has never been adopted by the Town; and
Whereas, The NYS Dept. of Environmental Conservation Hudson River Estuary Program reissued a grant opportunity on May 22, 2015 for Local Stewardship Planning; and
Whereas, The Town of Rochester Town Board adopted resolution #79-2015 on June 4, 2015 to submit application for such grant requesting funding of $50,000 to conduct a joint Open Space Plan Project with the Town of Wawarsing; and
Whereas, the Towns of Rochester and Wawarsing Town Boards obtained a 2015 Hudson River Estuary Grant from the New York State Department of Environmental Conservation in the amount of $ 50,000.00 for Rochester and Wawarsing to conduct a collaborative Open Space Plan in accordance with the dictates of the grant agreement; and
Whereas, said grant called for the formation of an advisory board comprised of representatives of both Rochester and Wawarsing; and
Whereas, the grant required that 20 per cent matching funds be provided by the Grant Recipient (Rochester) under the Grant Agreement; and
Whereas, Wawarsing reimbursed Rochester for fifty percent of said payments, upon audit of same and total matching funds did not exceed Ten Thousand Dollars with each Town paying no more than five thousand toward same; and
Whereas, the Town of Rochester Town issued a Request for Proposals for a consultant to produce Open Space Plans for the Towns of Wawarsing and Rochester; and
Whereas, The Towns of Rochester and Wawarsing established a joint advisory board consisting of one Town Official, one member of the ECC, and one member of the public, from each Town, for a total of six-member advisory board with resolution #87-2016 on May 5, 2016; and
Whereas, the Town of Rochester contracted with Church and Mickelson Consultants for the sum of $48,500 for services to produce an agreed upon set of deliverables pursuant to this grant with resolution #88-2016; and
Whereas, such contract called for a target completion date of March 31, 2017; and
Whereas, the advisory committee was established consisting of Carl Chipman, Supervisor, Laura Finestone, Environmental Conservation Commission, and Rick Jones, Planning Board from Rochester and Terry Houck, Town Board, Jack Grifo, Environmental Conservation Commission, and Jorge Gomes, Parks and Recreation Committee from Wawarsing; and
Whereas, the Town of Rochester received payment of $5,000 from the Town of Wawarsing in April 2017
Whereas, the advisory committee met with the consultants and other Town Boards, Commissions, and Committees as well as Laura Heady from the NYS DEC for a period of 18 months; and
Whereas, The Town of Rochester work builds on the 2006 draft natural resource inventory (Chazen) and the 2016 open space inventory of the town.
Whereas, This Town Natural Heritage Plan is written to directly support two key documents, the 2006 Town of Rochester Comprehensive Plan and the 2007 Ulster County Open Space Plan; and
Whereas, the Hudson River Estuary grant expired October 31, 2017 with the possibility of extension upon written request to the grant manager; and
Whereas, on January 5, 2018, the Town of Rochester Town Board adopted resolution #45-2018, authorizing the Supervisor to request an 8-month extension of the grant until June 30, 2018; and
Whereas, such extension has been granted; and
Whereas, such same resolution extended the contract and authorized the payment of the remaining grant amount of $11,500 to Church and Mickelson Consultants upon receipt of billing pursuant to Section 2 of the contract; and
Whereas, a first draft version of the Town of Rochester Natural Heritage Plan was presented to the Town of Rochester Town Board dated January 12, 2018; and
Whereas, at the Town Board meeting on January 25, 2018 the consultants presented said first draft to the Board and public with a presentation and question and answer session; and
Whereas, The Town of Rochester Plan lists the following components; Town-wide Water quality and flood management, Protection of the Rondout Creek, Agriculture and Heritage Farm Protection, Catskill Shawangunk Greenway Corridor and Colony Farm,
O & W Rail Trail Project, Biodiversity Protection, and Scenic Viewsheds & Gateways; and
Whereas, on March 13, 2018 a joint public meeting of the Town of Wawarsing and Rochester Town Boards was advertised and convened, and the plans were presented to the Boards and the public with a question and answer session; and
Whereas, the advisory committee and consultants took the comments and questions and has prepared a revision to the first draft dated April 2, 2018; and
Whereas, such draft was presented to the Town Supervisor for distribution to the Town of Rochester Town Board; and
Whereas, the consulting team provided a Part 1 Environmental Assessment Form (EAF) of the NYS Quality Review Act (SEQRA) which was completed by the Supervisor; and
Therefore, the Town Board of the Town of Rochester desires to adopt the Open Space Inventory dated January 2016, and the Natural Heritage Plan dated April 2, 2018 as addendums to the Town of Rochester Comprehensive Plan;

Discussion: Councilwoman Haugen-Depuy asked where this will be added to the comprehensive plan.
Supervisor Baden stated this is an addendum to the comprehensive plan, by approving the motion we are moving to the next step to hold the public hearing, it’s not finalized.
Councilman Drabkin stated that he was not informed that this was going to be a part of the comprehensive plan.
Supervisor Baden stated in the grant it states that it was to be part of the comprehensive plan and the Board has been 100% in agreement with moving forward with the Natural Heritage Plan the past 2 years, and I will not apply for anymore grants with the estuary if the Board doesn’t want to continue further.
Councilwoman Fornino stated that she will listen to the people and do right by them.

AUTHORIZING THE TOWN CLERK TO ADVERTISE FOR PUBLIC HEARING:
Resolution # 130-2018:

A Motion was made by Councilwoman Haugen-Depuy to authorize the Town Clerk to post notice of a public hearing to be held at 7:00PM on May 3, 2018 at the Town of Rochester Town Hall; and
Further, directs the Town Clerk to circulate notice of this hearing to any and all agencies as required by law; and
Further, directs the Town Clerk to circulate a copy of such plans to the Town of Rochester Planning Board, Ulster County Planning Board, and NYS Ag & Markets as is required by law.

ECONOMIC OVERLAY ZONE:

Supervisor Baden asked the Board if they had time to review the proposed law. This is coming about in reaction to a request for a specific property located on Lucas Ave. with a 12,000 square foot building to allow a use that is not designated in that area. The request is for an AR-3 zone, which would be fine in this location but not in all AR-3 zones. This particular use is not defined in any of the Towns zoning district so Attorney Christiana suggested the Economic Overlay zone.
Councilman Drabkin asked when getting a use variance does the applicant have to prove that you can’t use the property for anything allowed in the zone? Is it possible to change the law?
Attorney Christiana stated no because it is a New York State law and only approximately 1% of applicants would qualify. Even if the Town Board approves the Overlay the application would still have to go before the Planning Board.
Councilwoman Haugen-Depuy asked if the applicants have started the use variance.
Supervisor Baden stated that they can’t because it’s not allowed.

AUTHORIZATION TO HOLD PUBLIC HEARING ON AMENDMENT TO CHAPTER 140: ZONING( ECONOMIC OVERLAY ZONE)
Resolution # 132-2018:

A Motion was made by Councilman Drabkin to authorize the Town Clerk to post notice of a public hearing on May 3, 2018 at the Town Hall immediately following the 7pm public hearing on the Comprehensive plan addendum ; and
Further, direct the Town Clerk to circulate notice of this hearing to any and all agencies as required by law.

PILOT AGREEMENT WITH FOORDEMOOR-CYPRESS CREEK SOLAR:

Supervisor Baden stated under NYS law entities are given a 15 year exemption from taxes. Taxes still exist for land but not the increased value of improvement of property. NYS allows the Town to enter into a PILOT agreement. Cypress creek gave a proposal to the Town and The Town Assessor reviewed the proposed payment agreement and said it was reasonable. The value would be equivalent to a million dollar home.
Attorney Christiana recommends some wording changed to the agreement and the final product will be available next month.

EXECUTIVE SESSION:

A Motion was made by Councilwoman Fornino to enter into executive session at 8:46pm for the purpose of a specific employee of the highway department regarding training, specific employee of the Constabulary regarding attendance and request Chief Miller to attend regarding constabulary issue, and contract for services with the Kerhonkson / Accord First Aid Squad.
