Town Board Public Hearing – June 2015

A Public Hearing was held on June 25, 2015 at 5:30pm at the Town of Rochester Town Hall regarding amending Chapter 140-43 of the zoning code.

ABSENT:

Councilman Spano

 

Supervisor Chipman opened the public hearing and Highway Superintendent Kelder led in the Pledge of Allegiance to the Flag.

 

LOCAL LAW # 3-2015 A LOCAL LAW OF THE TOWN OF ROCHESTER AMENDING SECTION 140-43 OF THE CODE OF THE TOWN OF ROCHESTER.

 

BE IT ENACTED BY THE TOWN BOARD OF THE TOWN OF ROCHESTER AS FOLLOWS:

 

SECTION 1.

 

140-43 OF THE CODE OF THE TOWN OF ROCHESTER SHALL BE AMENDED TO READ AS FOLLOWS:

 

140-43 SECTION1. USE OF EXISTING NON-CONFORMING LOTS OF RECORD

 

A.    A principal structure may be erected on any non-conforming lot of record existing at the time this Law is enacted provided no front yard is reduced in size and no side yard is reduced to less than 50% of the requirement for the district in which it is located or 20 feet, whichever is greater, and a sewage disposal system meeting New York State standards, including well and septic isolation distances, can be placed on the lot should public facilities be unavailable.

B.     Accessory structures placed on non-conforming lots of record after the effective date of this law shall comply with Section 140-13 of this Law, Accessory Structures and Uses. This Local Law shall take effect immediately upon filing in the office of the Clerk of the Town of Rochester, the Secretary of State of New York and the New York State Commissioner of Tax and Finance.

 

SECTION 2.

 

This local law shall become effective immediately upon filing with Secretary of State of the State of New York.

Steve Fornal pointed out a grammatical error other than that everything seemed fine.

As a result of Steve Fornal’s comment, the second sentence of 140-43(B) was deleted
It was in the proposed law in error and just repeats what is in Section 2.

A Motion was made by Councilman Drabkin to close the public hearing at 5:35pm.
