Town Board Meeting Minutes – Jun 2015

The June Town Board Meeting was held on June 4, 2015 at 7:00pm at the Town of Rochester Town hall.

Supervisor Chipman opened the meeting and Councilwoman Fornino led in the Pledge of Allegiance to the Flag.

APPROVAL OF MINUTES:

 

A MOTION was made by Councilwoman Chachkin to approve the 5/7/2015 Regular Meeting & the 5/28/2015 Audit / Workshop Meeting

SUPERVISOR’S REPORT:  filed with the Town Clerk

 

SUPERVISOR’S UPDATE:

 

Supervisor Chipman updated the Board on progress made with the RRA. The RRA removed rental fees for recyclable bins. The RRA sent their proposed contract to their attorney for review so the Town’s should be hearing something shortly. The RRA entered into a 5 year contract with Seneca Falls, and the financial debt the RRA has incurred is closer to being paid off which will help with costs as well. As a member of the solid waste commission Supervisor Chipman is working on different solutions other than shipping to Seneca Falls ie: compost facilities.

Councilman Drabkin suggested that Supervisor Chipman review current bills to make sure the C/D fee is covering totals.

 

LEGAL UPDATES:

 

Attorney Christiana is working with CEO Jerry Davis on the Giles Edward Estate.

 

CORRESPONDANCE:

 

Supervisor Chipman received notification from Town of Marbletown that Smiley Brothers is expanding a building and a public hearing was scheduled for 5/27/15.

 

LIAISON REPORTS:

 

Councilwoman Chachkin: HPC: moving forward with plans for Alligerville residents celebrating Alligerville as an historic district. Planning Board: the public hearing for the crested hen farm will resume once sound engineer report is completed. The planning board is waiting on comment or recommendations from the Ulster County planning board on the Accord Train Station special events.

Councilwoman Fornino: the Youth Commission summer celebration is taking place 6/12 at 2:30pm at the Town of Rochester Community Center. Richard Miller is hosting a anti-bullying class for kids at the community center on 6/5/15 at 3pm.

Supervisor thanked the youth commission for decorating the float for the parade and thanked Jessica Knapp for her presentation at the memorial. He reiterated that the Town is looking to work with the Fire Company and Auxillary for next year’s parade and hope to have it end at the Veteran’s park. Councilwoman Fornino, Councilman Spano and Rich Miller are all on board to help with the planning.

Supervisor Chipman: ECC: working on the open space inventory project. Supervisor will discuss more on new business. The Town of Wawarsing and the Town of Rochester are looking to the possibility of submitting a joint application for the DEC program grant.

Assessor’s Office:

Grievance Day was held on 5/29 from 4-8pm. There were 12 property owners who appeared before the board. There were 7 complaints filed and an additional 13 stipulated agreements that were filed where the property owner and Assessor reached an agreement prior to Grievance Day. The Board members will be meeting the first week of June to review the applications and make their determinations.

Data verification Project: starting in June a data verification project of all properties in the Town. The Assessor will start with the residential properties. This project will include an exterior inspection of all properties in the Town from the public right-of-way. Mike will also be taking new photos of all properties. Before the town can complete another revaluation project all properties must be re-inspected within 6 years of the year a reval is completed. It’s projected to have another reval for 2018 or 2019 roll. The last data verification of the Town was done in 2010 prior to the 2011 reval project.

Record Management: a review of old records in the Assessor’s Office to determine what can be destroyed has begun. The Town Clerk will receive a list of old information being destroyed to save in the retention and destruction folder.

Tax Maps: New maps from the County have been received and the office will be working on placing 911 addresses on them to have them completed by early July.

 

 

NEW/OLD BUSINESS:

 

APPOINTMENT OF TEMPORARY MARRIAGE OFFICER:

Resolution #71 -2015:

 

A Motion was made by Councilman Spano to appoint Bethany Alongi-Dennin temporary marriage officer to conduct a ceremony on June 13, 2015 at 43 Denninville Rd Accord, NY 12404.

SURPLUS BID:

Resolution # 72-2015:

 

A Motion was made by Councilman Drabkin to send out to bid Highway equipment: Bridge,

Mower, and 1994 School Bus. Photos of said equipment are available for review at

the Town of Rochester Town Clerk’s Office and on townofrochester.ny.gov. All sealed bids must include a non-collusive bidding certificate and are due no later than July 9, 2015 by 11am at the office of the Town Clerk. The Town Board has the right to reject any and all bids and for the Town Clerk to advertise the same.

PLAYGROUND EQUIPMENT DONATION:

Resolution # 73-2015:

 

A Motion was made by Councilman Drabkin that the Town of Rochester gratefully accept the following equipment: tire swing, tetherball system, a 3 station swing, for placement at the playground located at the Community Center from the Hudson Valley Misfits, Tricia Reed, and rock the rink.

PROPOSED LOCAL LAW #3-2015: AMENDING CHAPTER 140-43 TOWN CODE:

Resolution # 74-2015:

 

A Motion was made by Councilwoman Chachkin that the Town of Rochester schedule a Public

Hearing for 6/25/2015 at 5:30pm at the Town of Rochester Town Hall on Proposed Local Law # 3-2015 amending Chapter 140-43 of the Town of Rochester Zoning Code. Copies of said amendment are available for review at the Town Clerk’s Office & on the Town of Rochester website. Furthermore authorizing the Town Clerk to advertise the same.

CONSTABULARY PROCEDURES:

Resolution # 75-2015:

 

A Motion was made by Councilwoman Fornino that the Town of Rochester procedures for the Town of Rochester Constabulary be implemented as presented.

ZONING REVIEW COMMITTEE:

Resolution # 76-2015:

 

A Motion was made by Councilwoman Chachkin that the Town of Rochester Town Board create the Zoning Law Review Committee to review suggested amendments to the Town of Rochester zoning and subdivision code. Said committee is to include the following members: at least one member of the Town Board, the Planning Board Chair or his/her designee, the ZBA Chair or his/her designee, and the CEO or his designee. This committee will meet as needed to complete tasks designated by the Supervisor and allow for consultation with the Town Attorney.

DISCUSSION:

There was a lengthy discussion whether or not the Town Board should have a committee or not. Current issues still pending are temporary structures, mulch compost facilities and Article 6.

Councilman Drabkin stated he feels that this is wrong. It’s the responsibility of the Town Board to handle the law, and it’s a big mistake to create a standing committee.

 

APPOINTMENT OF TOWN BOARD MEMBERS TO COMMITTEE:

Resolution # 77-2015:

 

A Motion was made by Supervisor Chipman to appoint Councilwoman Chachkin and Supervisor Chipman to serve on the Zoning Law Review Committee.

OPEN SPACE INVENTORY RFP:

Resolution # 78-2015:

 

A Motion  was made by Councilwoman Chachkin to seek sealed proposals for a consultant to perform an open space inventory of the Town of Rochester. Be it further resolved that said RFP be advertised as necessary by the Town Clerk and that all proposals must be received by the Town Clerk no later than 4:00pm on June 29, 2015 subject to confirmation that the RFP request of proposal meets requirements of the DEC grant requirements.

OPEN SPACE GRANT:

Resolution # 79-2015:

 

A Motion  was made by Councilwoman Chachkin that the Town of Rochester submit a joint application with the Town of Wawarsing for a DEC Estuary Program Grant of up to $ 50,000 to be equally shared by both Towns for developing Open Space Plan.
