Town Board Meeting – July 2017

The July Town Board meeting was held on July 6th, 2017 at 7:00pm at the Town of Rochester Town Hall.

ABSENT:

Town Clerk Gundberg Councilwomen Fornino

PLEDGE:

Supervisor Chipman opened the meeting and Laurence DeWitt led in the Pledge of Allegiance to the Flag.

PUBLIC COMMENT:

Supervisor Chipman opened the meeting for public comment.

Alice Gray stated that there was an abundant amount of traffic and litter on the roadway by Rav Tav Camp. She stated that the people were very disrespectful due to the littering and pulling into neighboring properties.

Supervisor Chipman noted that he had already assigned the Town of Rochester Police Constabulary to look into it.

Mrs. Countryman stated to the Board that she had spoken with Carl few months prior about an unauthorized business that has been operating.

Supervisor Chipman noted that he had not had the chance to speak with Mr. Davis, the Code Enforcement Officer about the business and would get on it.

APPROVAL OF MINUTES:

A Motion was made by Councilwomen Chachkin to approve the June 1st, 2017, June 14th, 2017 and June 29th, 2017 minutes.

SUPERVISOR’S REPORT:

Supervisor Chipman stated that the report had been handed in.

SUPERVISOR’S UPDATE:

Supervisor Chipman spoke about the illegal dumping on Van Tyne Road in the Town of Rochester. He stated that his largest concern was that all the debris that had been dumped would be cleaned up from the land. He noted that the case was in front of the Town of Rochester Court and that he himself had spoken with the District Attorney’s office about the situation in regards to the property being cleaned up. He also stated that the health and safety of the people in the Town are the most important.

LEGAL UPDATE:

Attorney Christiana updated the Board that they are very close with finishing up the surveys for the property on DeWitt Road. She stated that after the surveys are finished the Town will negotiate a price to purchase the piece of property that the Highway Department needs. Attorney Christiana stated that the Highway Superintendent had told her they are scheduled to start paving in August. She noted that there was a possibility that the Town Board might need to have a special meeting so that the Highway Department can get the whole project done timely.

COMMITTEE REPORTS:

Councilwoman Chachkin stated that the Planning Board met on June 12th and had a public hearing for Project Cat application to have a kennel/cat shelter with a residential use on Lucas Avenue. She stated people spoke for both in support and opposition. Councilwoman Chachkin added that the Planning Board kept the public hearing open for written correspondence until June 23rd at 4:00pm. She also stated that the Planning Board scheduled a public hearing for a 3 lot subdivision on Hill Road. The Planning Board also discussed an amended application for LH Equine on 44/55 which proposed to replace an indoor riding arena with an outdoor ring with adding boarding and training. She added that the Planning Board also held two pre-application meetings. Councilwoman Chachkin stated that the Planning Board had met on Friday, June 30th for a special meeting to respond to the Town Boards request to seek lead agency.

Councilwoman Haugen-DePuy reported that the Building Department had brought in $4,429 in permit fees and certificates, $840 in inspection fees for a total of $5,269.90 for the month of June.

Councilman Drabik had nothing to report.

Supervisor Chipman stated that with the Data Verification project that there are 3,200 parcels that need to be collected. He noted that the assessor has done 2,185 parcels already. He added that the final roll had been completed and would be available for review in the Assessor’s office.

BORREGO SOLAR LEASE:
Resolution #86-2017:
Attorney Christiana read the SEQRA for the Town Board.

A Motion was made by Councilman Drabkin to adopt a negative declaration under SEQRA.

Resolution # 87-2017:

A Motion was made by Councilman Drabkin to approve the Borrego Solar Lease.

HIGHWAY RADIO CONTRACT:
Resolution #88-2017:

Attorney Christiana stated that since the contract is over $10,000 for the service it would have to be put out for bid. She stated that the current contract doesn’t end until August 31st, 2017 so there was time. She recommended putting out the bid with the specs and to advertise accordingly by August, 3rd, 2017 at 10:00am.

A Motion was made by Councilman Drabkin set the contract for bid.

ZRC RECOMMENDATIONS- SET PUBLIC HEARING:
Resolution # 89-2017:

Councilwoman Haugen-DePuy asked if the Board was looking to set the public hearing for the Air B & B’s as well as all of the amendments. She asked because she was wondering if it was dividing it up and taking the Air B & B’s as its own.

Councilman Drabkin stated that he thinks what Councilwoman Haugen-DePuy recommended would be a good idea because if the Board had a public hearing for all of the amendments and the Air B & B’s it would be too much.

Attorney Christiana stated that how they did the public hearing was completely up to the Town Board.

Supervisor Chipman stated that he would take it all on as one thing and if someone has something wrong with it then you can change it.

Attorney Christiana stated that if it was to be split up the Board would have to go through the public hearing process twice.

Councilwoman Haugen-DePuy stated that the only new law for the public hearing would be the Air B & B’s and the rest were amendments to already existing laws.

Supervisor Chipman asked the Board if they would want to set two public hearing dates.

Attorney Christiana stated that she believed all of the Air B & B laws was included with 26-A, even in the definitions the ZRC referred to 26-A so the Board could hold the public hearing with the Air B & B part taken out and give a new notice in the morning after the meeting to post on the website or the Board could listen to it all at one public hearing and then decide what they want to do and that the Board could always take the Air B & B part out later on.

A Motion was made by Councilwoman Chachkin to set a public hearing for August 3rd 2017 at 7:00pm and to authorize the Town Clerk to forward the proposed law and the legal notice to the Ulster County Planning Board, the Town of Rochester Planning Board and to the surrounding municipalities and the appropriate agencies.

VOLUNTEER APPRECIATION PICNIC:

Supervisor Chipman suggested having the volunteer appreciation picnic in August. He added that he would also like to recognize Shane Ricks for his 29 years of service on the Planning Board and present him with a plague at that time.

Councilwoman Chachkin asked if September would be a better time because so many people will be on vacations.

Supervisor Chipman stated that he would think the second week in September would work.

Councilwoman Chachkin suggested having an encore and presenting Shane Ricks with something at the Town Board meeting as well as the Volunteer Appreciation Picnic.

Councilman Drabkin stated that he believed that the plague should be given to Shane Ricks at the September Town Board meeting.
