Town Board Meeting – December 2017

The December Regular Town Board Meeting was held on December 7, 2017 at 7:00pm at the Town Hall.

PLEDGE:

Deputy Supervisor Drabkin opened the meeting and Councilwoman Chachkin led in the Pledge of Allegiance to the Flag.

APPROVAL OF MINUTES:

A Motion was made by Councilwoman Fornino to approve the 11/9/2017 Public Hearing on the Budget and the 11/9/2017 Regular Town Board Meeting.

APPROVAL OF NEWLY ELECTED OFFICIAL TRAINING:
Resolution # 126-2017

A Motion was made by Councilwoman Chachkin to approve the Association of Towns training for the newly elected officials for 2018 in the amount of $ 800.00.

APPOINTMENT TO THE CONSTABULARY:
Resolution # 127 -2017:

A Motion was made by Councilwoman Chachkin to appoint John Behnke to the constabulary for training.

LEGAL MATTERS:

The Board reviewed Attorney Christiana’s memo and satisfied with the decision.

LIAISON/ COMMITTEE REPORTS:

Councilwoman Chachkin: Planning Board: approved lot line improvement on Route 209. Approved a special use permit for Applestone. They continued a discussion for 2 large scale solar applications one on Berme Rd and one on Pompey’s Cave Rd. A Pre-application permit was discussed on and education facility at Woodstock Farm.
Rich Miller: The Municipal Grant: new figures will be submitted in January for the application process.
Councilwoman Fornino: The Holiday Brunch will take place on 12/9/2017 from 10- 11:30am at the Community Center. Supervisor Chipman would also like to see the Community Center Building named in honor of Harold Lipton.
Councilwoman Haugen-Depuy: the CEO: for the month of November;
Building permits: $ 4,326.25 C/O : $ 720.00 for a total of $ 5,046.25. The year to date total: building permits $ 71,055.85, C/O: $ 10,948.00 for a total of $ 82,003.85

APPROVAL OF BILLS:

A Motion was made by Councilwoman Haugen-Depuy to approve the bills as follows;

General Fund Abstract 11 of 2017 $ 69,682.59
Highway Fund Abstract 11 of 2017 $ 33,287.53
Street lighting $ 371.40

HIGHWAY TIRES SURPLUS BID:
Resolution # 128-2017:

A Motion was made by Councilwoman Haugen-Depuy to authorize the Highway Department to place (8) 12 R22.5 tires & (1) 14R 24 tire on auctions internationals for bidding.

HIGHWAY TRUCK DISCUSSION:

Highway Superintendent Spano asked for authorization to proceed with the ordering of 1 2018 International 7600 SFA 6×4 for $ 144,217.00, 1 2018 International 7500 SFA 4×2 for
$ 112,050.00, Body/ Sanders for $ 99,929.00 and $ 104, 332.00. Financing can be done through KeyBank with a 3.1 % interest rate for 7 to 10 years.

Deputy Supervisor Drabkin stated that he is in favor of the purchases but believes this should be a new Board decision.

Attorney Christiana stated that the Board should review the financing agreement.

HIGHWAY TREE-TRIMMING BID:
Resolution # 129 -2017:

A Motion was made by Councilwoman Chachkin to award the re-bid of Tree-Trimming to LW Tree Service Inc. as per the proposal submitted.

PROPOSITION OF SPECIAL ELECTION:
Resolution # 130-2017:

A Motion was made by Councilwoman Chachkin to approve the following propositions;

Proposition # 1 :
Should the Town of Rochester enter into an option and lease agreement with Borrego Solar Systems, Inc. for land area of 24.11 acres located at 6140 Route 209 Tax map parcel 76.1-3-17 for the purpose of erecting and operating a community solar system. The Initial lease term will be 20 years with the right to extend the term for up to 4 additional 5 year periods. Rental fee will be $ 10,000.00 per mega watt DC per lease year with a 1 % annual increase.
Proposition # 2:
Should the Town of Rochester enter into an option and lease agreement with Borrego Solar Systems, Inc. for an area of land not to exceed 30 acres located off Airport Road Tax map parcel 69.3-2-41.100 for the purpose of erecting and operating a community solar system. The Initial lease term will be 20 years with the right to extend the term for up to 4 additional 5 year periods. Rental fee will be $ 10,000.00 per mega watt DC per lease year with a 1 % annual increase.

Attorney Christiana stated upon approval of the proposition the Board is required to set a date, location, time for the election to be held. The Election must be held between January 29- February 13, 2018.
It was agreed to have the new Board vote on this at the Organizational Meeting.
Town Clerk Gundberg will look into availability dates at the Fire House and if absentee voting is allowed in a special election.

RESCINDING BOARD SUSPENSION OF PLANNING BOARD MEMBER:
Resolution # 131-2017:

A Motion was made by Councilwoman Chachkin to rescind John Dawson’s suspension from the Planning Board.

PUBLIC COMMENT PERIOD:

Richard Miller stated that $ 10,751.00 was received from Paramount Movies for the use of the Constabulary. Movie production will also take place on 12/11/2017 on Route 44/55.

Mike Baden thanked the Board for the approval of the newly elected officials training. He also asked Highway Superintendent to clarify to the Board his intent with the Trucks.

Highway Superintendent Spano stated that he was looking for authorization to move forward with ordering the trucks now because the price and interest rate were based on 2017 approval. If the Board waits until 2018 the rate and pricing will increase.

ORDERING OF THE TRUCKS:
Resolution # 132-2017:

A Motion was made by Councilwoman Chachkin to move forward with the ordering;
1 2018 International 7600 SFA 6×4 for $ 144,217.00
1 2018 International 7500 SFA 4×2 for $ 112,050.00
As long as there is no penalty to the Town if the Board chooses to back out.

Chris Hewitt suggested holding the Special Election on a Tuesday.

One resident asked where the locations of the Community Solar panels would be.

Another resident asked if Borrego was leasing the property?
