PLEDGE:
Supervisor Chipman opened the public hearing and Richard Travers led in the pledge of allegiance to the flag.
PUBLIC COMMENT PERIOD:
Supervisor Chipman stated he has received several e-mails from town residents supporting Local Law # 2-2012 and they will be on record.
14 residents spoke out to encourage the Town Board to adopt Local Law # 2-2012. Stating that this law is detrimental to the Town of Rochester’s way of life and continue to reiterate what Hydrofracking means to the residents.
The RDAF (Rochester Defense Against Fracking) feels in addition to the zoning ban, it’s imperative to work on passing a Community Bill of Rights Ordinance.

OPEN TO THE PUBLIC:
One resident spoke against the proposed law.
Mike Baden Chairman of the Planning Board stated this was referred to the Town Board because the way the code was written; any use that was not contemplated in the code is referred to the Town Board, The Town Board is then obligated to hold a public hearing. If the Town Board allows special use permits in the R-1 district then the application would still go the planning board for review of parking, safety & health conditions.
Councilman Cilenti wanted clarification if it is considered commercial use in and residential district.
Councilwoman Archer asked if there are other districts that have special use, or do other districts have the ability to have special events?
Councilman Drabkin stated he spoke with Dennis Doyle Chairman for the Ulster County Planning Board who recommended that we handle special use events per individual permit for events. Association of Towns has samples of laws drafted specifically for these events.

PUBLIC COMMENT PERIOD:
One resident was asking about the protocol on vehicle abandonment. He wanted to know if the town could remove the vehicle and bill the owner or have a lien placed on the home. The resident stated, “We need to force the owner to be responsible” Supervisor Chipman Stated that he would discuss the issue with the CEO.

CORRESPONDENCE RECEIVED:
Supervisor Chipman stated he received several e-mails for Local Law # 2-2012 that will go on record.
LEGAL MATTERS:
Supervisor Chipman stated that the board would discuss a settlement offer later in the evening.
LIAISON REPORTS:
Councilwoman Archer: PB: 7/10 meeting; 2 subdivision applications asked for a 90-day extension. The Evers lane referral from UCPB suggested signs of emergency vehicle parking only on the private 1 car lane road. Residents expressed concerns at the public hearing on the Bed and Breakfast, it was clarified that it would be a 2 room B&B. HPC: no meeting held.
Councilman Cilenti: nothing to report.
Councilman Drabkin:  ZBA: Scraggs appeal was approved. TS: the new freon company is charging $ 7.00 when the previous company the town used was $ 10.00. There are some discrepancies with a volume vs. weight. He encourages the residents to reduce, reuse and recycle!
Councilman Spano: Fire Company: Chairman Bob Garrett has stepped down and Len Bernardo is now Fire Commissioner Chair.
Supervisor Chipman: ECC: most of the meeting was discussing the Local Law # 2-2012: exploration of natural gas. There was a vote of 8-1 in favor of the Town Board passing purposed law. YC: the summer program is in full swing and the kids are enjoying themselves.
FEMA REPORT:
FEMA Disaster 4020 occurred on August 27, 2011
The Town of Rochester had a total of 31 areas affected by Hurricane Irene. The total amount accepted by FEMA for payment to the Town of Rochester is $ 442,500.60. Completed FEMA projects and sent in for payments total is $ 403,396.20. Money received to date is $ 257,068.07. Amount of FEMA projects to be completed $ 39,104.40.
NEW BUSINESS:
INCREASE BUDGET EXPENDITURE:
Resolution # 97-2012:
A Motion was made by Councilman Drabkin to increase budget expenditure line item 5110.4 highway roads general repair to $ 46,926.00. Funding for this money received from FEMA reimbursement due for repairs caused by Hurricane Irene in 2011which were paid out by Highway unallocated fund balance.

A Motion was made by Councilman Cilenti to accept the offer of $ 850,000 in assessed value for Lucky Petroleum.

GEOLOGIST FOR LOCAL LAW # 2-2012:
Resolution # 102-2012:
Councilman Drabkin stated he is in contact with Bob Miller a hydro-geologist and a Town Board member for the Town of Shawangunk and feels that it is essential for the Town Board to ask Mr. Miller to attend a meeting to give insight on the shale in the Town of Rochester. He further stated that Mr. Miller would attend free of charge.

SURPLUS OF BID:
Resolution # 103-2012:
A Motion was made by Councilman Spano to seek sealed bids for surplus equipment. The bids are due on or before 9/14/2012 at 10am at the office of the Town Clerk where they will be opened and read aloud and authorizing the Town Clerk to advertise the same.

DISCUSSION:
Councilman Spano further authorized Supervisor Chipman to look into Auctions International to see the possibilities of posting such items on the website.
DEMOLITION TAX MAP # 60.3-1-11:
Resolution # 104-2012:
A Motion was made by Councilman Cilenti to seek sealed bids for the Demolition of section 60.3- block 1- lot 11 due on or before 8/30/2012 at 10am and further authorizing the Town Clerk to advertise the same.

One resident asked if it was possible that Local Law # 2-2012 be passed by the September Town Board Meeting.
There was a question about the increase in tire fees at the Transfer Station.

A Special Meeting was held on August 9, 2012 at 7:15pm at the Town of Rochester Community Center.

Proposed Local Law # 2-2012: Exploration for or Extraction of Natural Gas and/or Petroleum.
Supervisor Chipman opened the meeting and explained recommendations to the proposed law by the UCPB & the Town of Rochester Planning Board.
The Town of Rochester Planning Board’s recommendation was to add the definition of “Town” to the purposed law and use it frequently.
The Ulster County Planning Board recommends removing the invalidity of permits Section V.  Regulations F.
Attorney Christiana recommends amending Chapter 140 re: Zoning of the Town of Rochester Town Code rather than Local Law format.
Councilman Spano questioned some of the wording in the purposed law. Section G. to control activitieshe stated we should use the word BAN. Attorney Christiana suggested keeping the current language as is because it has upheld elsewhere in court. Councilman Spano further stated in addition the Town Board should include or amend streets and sidewalks of the Town Code banning of hydro fracking vehicles or use of such products on Town Roads.

LOCAL LAW # 2-2012:  AMENDING CHAPTER 140:
Resolution # 107-2012:
A Motion was made by Councilwoman Archer, Seconded by Councilman Cilenti that the Town of Rochester Town Board adopt Local Law #2-2012 amending Chapter 140 of the Code of the Town of Rochester with regard to exploration for or extraction of natural Gas and Petroleum. The reads as follows;
Section 1. ~
This Local Law is adopted and enacted pursuant to the authority and power granted by the Constitution and Laws of the State of New York including without limitation the Municipal Home Rule Law of the State of New York, Articles 2 and 3, and Article 2 of the New York State Statute of Local Governments, and pursuant to the authority of Section 265 of the New York State Town Law.
Section 2.~~~~~~Purpose
A.~~~~~~It is the purpose of this Local Law to promote the protection, order, conduct, safety,  health, and well-being of the residents of the Town of Rochester and the lands that lie within the Town’s borders.
B.~~~~~~It is the purpose of this Local Law to protect and enhance the Town’s physical and visual environment.
C.~~~~~~It is the purpose of this law to respond to the legitimate concerns of the citizens of the Town about the potential for expansion of the Exploration for or Extraction of Natural Gas and/or Petroleum Industry in the Town and about the potential for major portions of the Town and its citizens to be adversely impacted by such Industry.
D.~~~~~~It is the purpose of this Local Law to uphold and implement the Town of Rochester Comprehensive Plan, as currently adopted.
E.~~~~~~The Town Board, in adopting an updated Comprehensive Plan in 2006, established the following vision statement:”
“It seeks to establish a reasonable balance between important goals of the community and the rights of individual property owners so that:
• Growth can take place without compromising the quantity and quality of drinking water available to all Town residents.
• New development is sited and designed to minimize the amount of taxes that must be raised town-wide to provide new facilities and services to support that development.
• Rochester may take advantage of changes in the national and regional economy to build the Town’s economic base by encouraging small business, tourism, arts, agriculture and historic preservation. (NOTE: for the purposes of this Plan, a small business is an enterprise employing 25 or fewer persons.)
• To the greatest extent possible, the Town remains an affordable place to live.
• Development complements and strengthens Rochester’s small town quality and character.
• Growth occurs in a way that minimizes loss of open spaces or scenic views.
F.~~~~~~Further, the Town Board, in adopting by Local Law an update to the Zoning Law in 2009 declared the following:
“It is the legislative intent of this Chapter to provide standards and procedures to guide land use and new development. ~This Law is specifically intended to implement the Town of Rochester Comprehensive Plan, including but not limited to the following objectives:”
A.~~~~~~Directing growth by encouraging concentrations of new residential, non-residential and mixed-use developments in areas that currently are or that can be conveniently served by roads, utilities, schools and other facilities.
B.~~~~~~Directing large-scale or intensive development to areas with adequate infrastructure.
C.~~~~~~Broadening housing opportunities in the Town of Rochester to provide housing for all populations including young families, senior citizens, working families and households, single adults and others.
D.~~~~~~Offering incentives to encourage better site design and use of energy efficient principles in new development projects.
E.~~~~~~Protecting historic resources.
F.~~~~~~Protecting the quantity and quality of the water supply by strengthening measures to prevent groundwater contamination, assuring protection of surface waters, preserving wetlands and encouraging the provision of sewage collection and treatment to hamlets.
G.~~~~~~Protecting important natural resources identified in the Town’s Natural Resources Inventory.
H.~~~~~~Minimizing disturbance to wildlife and vegetation from the effects of new development.
I.~~~~~~Regulating flood plain development.
J.~~~~~~Providing for continued commercial and industrial growth.
K.~~~~~~Allowing for home-based occupations.
L.~~~~~~Preserving productive farmlands as a viable industry resource and means for maintaining open space.
M.~~~~~~Encouraging agri-tourism activities by farms and otherwise promoting and developing agriculture.
N.~~~~~~Protecting the Catskills and the Shawangunk Ridge by limiting clearing and intensity of use so as to maintain existing character.
O.~~~~~~Creating guidelines for new development and its landscaping that maintain a high-quality built environment while preserving and using natural beauty wherever possible.
P.~~~~~~Recognizing historical neighborhoods and preserving small-scale mixed use development patterns in these areas.
Q.~~~~~~Preventing intrusion of incompatible uses in residential areas so as to ensure privacy for residents and their freedom from nuisances.
R.~~~~~~Ensuring signage in Town is both attractive and functional.
S.~~~~~~Reducing traffic congestion and improve the safety of the roads in the Town.
T.~~~~~~Requiring adequate setbacks and off-street parking for both residential and non-residential uses.
U.~~~~~~Encouraging alternatives to strip commercial development, by encouraging new development in hamlet areas and/or concentrated nodes that minimize the road frontage and curb cuts required.
V.~~~~~~Ensuring new construction provides adequate access for emergency services.
W.~~~~~~Encouraging the use of conservation subdivision, planned unit development, transfers of development rights and other flexible techniques for simultaneously preserving open spaces. protecting natural resources and accommodating new development.
X.~~~~~~Protecting the community against unsightly, obtrusive and noisy land uses and operations.
Y.~~~~~~Providing public access to trails and other recreational resources.
G.~~~~~~Further, it is the purpose of this Local Law to control those activities related to the Exploration for or Extraction of Natural Gas and/or Petroleum Industry, which may impact wetlands, lakes, streams, groundwater resources, drinking supplies, public roads, historic landscapes, Agriculture, small town character, and the town’s tourism and recreational- based economy. ~Impacts related to the Exploration for or Extraction of Natural Gas and/or Petroleum Industry that the Town Of Rochester seeks to avoid include, but are not limited to contaminated water supplies, air pollution, traffic congestion, deterioration of roads and bridges, noise, introduction of industrial uses into non-industrial areas, human and animal illness, and incompatible changes to the rural character of the Town.
H.~~~~~~This Local Law is intended to be of general applicability, in conjunction with Chapter 140, Zoning, and is intended to regulate all uses, practices, and methodologies associated with the Exploration for or Extraction of Natural Gas and/or Petroleum Industry, except as provided herein.
Section 3. ~Definitions
~~~~~~~~Section 140 -4 of the Code of the Town of Rochester shall be amended to include the following definitions which shall be inserted alphabetically into that section:
“Natural Gas” shall mean any gaseous substance, either combustible or non-combustible, which is produced in a natural state from the earth and which maintains a gaseous or rarified state at standard temperature and pressure conditions, and/or gaseous components or vapors occurring in or derived from petroleum or other hydrocarbons.
“Natural Gas and/or Petroleum Exploration” shall mean geologic or geophysical activities related to the search for natural gas, petroleum or other subsurface hydrocarbons including prospecting, geophysical and geologic seismic surveying and sampling techniques, which include but are not limited to core or rotary drilling or making an excavation in the search and evaluation of natural gas, petroleum, or other subsurface hydrocarbon deposits.
“Natural Gas and/or Petroleum Exploration and Production Materials” shall mean any solid, semi-solid, liquid, semi-liquid or gaseous material used in the exploration or extraction of natural gas.
“Natural Gas Exploration and/or Petroleum Production Wastes” shall mean any garbage, refuse, cuttings, sludge, flow-back fluids, produced waters or other discarded materials, including solid, liquid, semi-solid, or contained gaseous material that results from or is associated with the exploration, drilling or extraction of natural gas and/or petroleum.
“Natural Gas and/or Petroleum Extraction” shall mean the digging or drilling of a well for the purposes of exploring for, developing or producing natural gas, petroleum or other subsurface hydrocarbons.
“Natural Gas and/or Petroleum Extraction Support Activities” shall mean the construction, use, or maintenance of a storage or staging yard, a water or fluid injection station, a water or fluid gathering station, a natural gas or petroleum storage facility, or a natural gas or petroleum gathering line, venting station, or compressor associated with the exploration or extraction of natural gas or petroleum.
Section 4.~~~~~~~Regulation
~~~~~~~~A new section 140-8A shall be added to the Code of the Town of Rochester to read as follows:
~~~~~~~~140-8A EXPLORATION FOR OR EXTRACTION OF NATURAL GAS AND/OR PETROLEUM
A.~~~~~~ Prohibition against the Exploration for or Extraction of Natural Gas and/or Petroleum.~No land in the Town shall be used: to conduct any exploration for natural gas and/or petroleum; to drill any well for natural gas and/or petroleum; to transfer, store, process or treat natural gas and/or petroleum; or to dispose of natural gas and/or petroleum exploration or production wastes; or to erect any derrick, building, or other structure; or to place any machinery or equipment for any such purposes.
B.~~~~~~Prohibition against the Storage, Treatment and Disposal of Natural Gas and/or Petroleum Exploration and Production Materials. ~No land in the Town shall be used for: the storage, transfer, treatment and/or disposal of natural gas and/or petroleum exploration and production materials.
C.~~~~~~Prohibition against the Storage, Treatment and Disposal of Natural Gas and/or Petroleum Exploration and Production Wastes. ~No land in the Town shall be used for: the storage, transfer, treatment and/or disposal of natural gas and/or petroleum exploration and production wastes.
D.~~~~~~Prohibition against Natural Gas and/or Petroleum Extraction Support Activities. ~No land in the Town shall be used for natural gas and/or petroleum extraction support activities.
E.~~~~~~Bulk Fuel Storage. ~No provision of this Local Law shall be deemed to regulate the use known as “Bulk Fuel Storage” as defined in Chapter 140, Zoning.
F.~~~~~~Invalidity of Permits. ~No permit issued by any local, state or federal agency, commission or board for a use which would violate the prohibitions of this section or of this Local Law shall be deemed valid within the Town.
Section 5.~~~~~~Enforcement
Upon authorization by the Town Board, the Town may institute an action or proceeding in a court of competent jurisdiction, to prevent, restrain, enjoin, correct, or abate any violation of, or to enforce, any provision of this law.
Section 6.~~~~~~Severability
If any part or provision of this local law is judged invalid by any court of competent jurisdiction, such judgment shall be confined in application to the part or provision.
Section 7. ~~~~Effective Date
~~~~~~~~This law shall become effective immediately upon filing in the office of the Secretary of State of the State of New York.

HISTORIC PRESERVATION COMMISSION:
Howard Kagan interviewed for an open position on the HPC. Supervisor Chipman stated the Town Board will vote at the next Town Board meeting .
STREAM STUDY:
Barry Medenbach presented to the Town Board an engineering stream study located at the Main St / Rte 209 intersection to 3,500 feet north on Rte 209. The increase in storms and the intensity of water flow is causing sand and gravel sediment to settle at this particular location causing flooding to Rte 209.  He stated there are grant and other funding available that the Town can look into if this project is pursued.

which the Town of Rochester, Ulster County, New York, is not authorized to expend
money, or if the provisions of law which should have been complied with as of the date
of publication of this notice were not substantially complied with, and an action, suit or
proceeding contesting such validity is commenced within twenty days after the date of
publication of this notice, or such obligations were authorized in violation of the
provisions of the Constitution.
A complete copy of the resolution summarized herewith is available for public
inspection during regular business hours at the Office of the Town Clerk for a period of
twenty days from the date of publication of this Notice.

A RESOLUTION AUTHORIZING THE RECONSTRUCTION OF THE BACK ENTRANCE OF THE TOWN HALL BUILDING, IN AND FOR THE TOWN OF ROCHESTER, ULSTER COUNTY, NEW YORK, WHICH PROJECT HAS A MAXIMUM ESTIMATED COST OF $ 62,088, AND AUTHORIZING THE ISSUANCE OF $ 62,088 BONDS OF SAID TOWN TO PAY THE COST THEREOF.

CONSTABULARY:
Councilman Cilenti stated that the issue of the constabulary will be discussed at the next Town Board meeting.
