2011 February Town Board Minutes

The Town Board Meeting was held on February 3, 2011 at 7:00 pm at the Town Hall.

 

PRESENT:

PLEDGE:
Supervisor Chipman opened the meeting and Ulster County Legislator Terry Bernardo led the Pledge of Allegiance to the Flag.

 

The Board wished Councilman Cilenti a Happy Birthday!

 

PUBLIC COMMENT PERIOD:

 

One resident had a complaint about the snow on Lower Granite Rd and Stonykill Rd. Highway Superintendent Wayne Kelder clarified some of the reasons why the road is narrow, but stated that he will take a look at the situation. He also stated that it is unlawful to push snow on to the highway, it creates a hazard and the homeowners can be fined.

 

APPROVAL OF MINUTES:

 

A Motion was made by Councilman Cilenti to approve the minutes of the 1/06/2011 Organizational meeting, the 1/06/2011 Regular Town Board meeting and the 1/27/2011 Audit workshop meeting.

PRESENTATION:

 

County Legislator Terry Bernardo gave a presentation update of the year 2010, and what is projected for 2011. Some highlights for 2010 were; 0 % increase in the Ulster County property tax levy for 2011. She spoke of the success for the speed limit change on Kyserike Rd. and the distribution of nursing home beds. More information can be made available at

 

SUPERVISOR’S REPORT:  Filed with the Town Clerk

 

SUPERVISOR’S UPDATE:

 

Supervisor Chipman stated he received the audit report from Central Hudson. Once the fixtures and bulbs are changed an approximate savings of $2,700.00 per year in electricity for the Town Hall.

 

Tom Frey, Executive Director of New York State Association of Assessors sent an e-mail discussing the possible cut in funding state aid for training, and Revals.

LIAISON REPORTS:

 

Councilwoman Archer: ECC: no meeting held. She spoke of the successful showing of Gasland at the Accord Firehouse with 60 + people in attendance.
Councilman Cilenti: Hwy: Thanked the Highway Department for the excellent job completed during January. Assessor’s Office: first week of March impact notices will be sent to each homeowner.
Councilwoman Michailescu: YC: Community Valentines Luncheon will be held on 2/11/11 from 11:30-1pm at the Community Center. The Youth Commission will be honoring Mary Lee for the dedicated years of service to the Town of Rochester Youth Commission. HPC: 10 blue stone benches have been ordered for the Veteran’s Park and a review of the Landscaping is currently being worked on.
Councilman Spano: CEO:  waiting of Attorney Christiana for the status of the open furnace law. On 2/5/2011 at 5pm a Spaghetti dinner will be held for Joe Luma, a Town Resident who fell ill November of 2010.

 

Supervisor Chipman stated Councilman Spano is now Liaison to the Town Court and Councilwoman Archer is Liaison to the Friends of Historic Rochester.
 
NEW BUSINESS:

 

Resolution # 29-2011:

 

A Motion was made by Councilman Cilenti and Seconded by Supervisor Chipman that,

 

BE IT RESOLVED that the interview requirement for appointment to a board or commission be waived at the option of the applicant for reappointment to a board or commission when there are more openings than applicants for a seat on a board or commission applied for.

 

DISCUSSION:

 

Councilwoman Michailescu felt that there would be a level of unfairness for new applicants compared to those reapplying.

Resolution #30-2011

 

A Motion was made by Councilwoman Michailescu that Pamela Stocking, Sue Bruck and Timothy Bruck all be appointed to the Youth Commission with terms to expire 12/31/2013.

A Motion was made by Councilman Cilenti that Martha Roberge be appointed to the Board of Ethics with a term to expire 12/31/2015

A Motion was made by Councilwoman Archer that Ethan Roland and John Messerschmidt be appointed to the Environmental Conservation Commission with terms to expire 12/31/2013

Resolution #33-2011

 

A Motion was made by Councilman Cilenti that Frederick O’Donnell be appointed to the Planning Board with a term to expire 12/31/2017.

A Motion was made by Councilman Spano that Bill Collier be appointed to the Historic Preservation Commission, the term to expire 12/31/2013.

A Motion was made by Councilwoman Archer that John Dawson be appointed alternate to the Zoning Board of Appeals with a term to expire 12/31/2012.

DISCUSSION:

 

Councilwoman Archer on behalf of the Town Board wanted to thank Mary Jane Knudsen for her 20 + years of service to the Zoning Board of Appeals. Councilwoman Michailescu felt The Board was not appreciative of the long-term commitment of Ms. Knudsen.

 

YOUTH COMMISSION:

 

Resolution # 38-2011

 

A Motion was made by Councilwoman Michailescu that Jessica Knapp be appointed to serve as Chairman and Pam Stocking to serve as Vice Chairman of the Youth Commission.

A Motion was made by Supervisor Chipman that Alice Cross be appointed to serve as Chairman and Maggie Dulka to serve as Vice Chairman of the HPC.

Resolution # 41-2011

 

A Motion was made by Supervisor Chipman that Brian Drabkin be appointed to serve as Chairman and Beatrice Haugan- DePuy to serve as Vice Chairman of the ZBA

A Motion was made by Supervisor Chipman that Laura Finestone be appointed to serve as Chairman and Judith Karpova to serve as Vice Chairman of the ECC.

BOARD OF ASSESSMENT REVIEW:

 

Resolution #43-2011

 

A Motion was made by Councilwoman Archer that Alan Levine be appointed to serve as Chairman and Zali Win to serve as Vice Chairman the Board of Assessment Review.

PUBLIC COMMENT PERIOD:

 

Diana Puglisi- Cilenti thanked The Board for her reappointment to the Historic Preservation Commission, along with the resolution for the interview process.

 

Highway Superintendent Wayne Kelder announced that he is filing with the Town Clerk an Order Directing The Discontinuance of Former Highway known as GLF Rd.

 

EXECUTIVE SESSION:

 

A Motion was made by Councilman Cilenti to enter into executive session at 8:20pm to discuss a legal matter and a personnel matter.

A Motion was made by Councilman Cilenti to reconvene the meeting at 8:30 pm stating no action was taken nor monies expended.

The Audit/Workshop Meeting was held on February 24, 2011 at 7:00pm at the Town Hall.

BOARD AND COMMISSION INTERVIEWS:

 

Two interviews were held for vacancies on the Environmental Conservation Commission and the Historic Preservation Commission.
ACCORD FARMERS MARKET:

 

Representatives of the Accord Farmers Market Group gave a presentation on the possibility of holding a Farmers Market at the Town Park between the months of June to October.

A Motion was made by Councilman Cilenti and seconded by Councilwoman Archer to rescind previous motion # 42-2011.

 

A Motion was made by Councilwoman Archer that Laura Finestone be appointed to serve as Chairman and Steven Rice to serve as Vice Chairman of the ECC.
