2011 December Town Board Minutes

The December Town Board Meeting was held on December 1, 2011 at 7:00 pm at the Town Hall.

APPROVAL OF MINUTES:

 

A Motion was made by Councilman Spano to approve the minutes of the 11/03/2011 Regular Town Board Meeting, the 11/03/2011 Public Hearing on the 2012 Town Budget and the 11/29/2011 Audit Workshop Meeting.

SUPERVISOR’S REPORT:  Filed with the Town Clerk

 

CORRESPONDENCE RECEIVED:

 

Supervisor Chipman read aloud a letter sent by Senator Bonacic in reference to possible closings of the New York State substations. Senator Bonacic’s letter was in support of keeping the Ellenville substation open and the importance it is to our area. It was agreed  if the Ellenville substation was one of the facilities in jeopardy of being closed  our community would suffer severe health and safety risks.

 

Supervisor Chipman thanked the Hazzards, owners of HB Humiston Funeral Home for donating the plaque for Francis Gray in reference to the Veterans Park.

 

Supervisor Chipman thanked all that were involved in making the Thanksgiving Luncheon such a success. He thanked Zali Win head of the Rochester Residents Association for the donation of $ 300.00. He stated approximately 130 dinners were served and approximately 30 food deliveries.

 

LEGAL MATTERS:

 

Attorney Christiana stated that two lawsuits will be discussed in executive session.

 

LIAISON REPORTS:

 

Councilwoman Archer: nothing to report.
Councilman Cilenti: nothing to report.
Councilwoman Michailescu: HPC: The highlight of the November 21 meeting was the presentation made by Amanda Lewkowicz from the Preservation League of New York State. The interesting, very well received presentation –~ “Preservation – A Green Perspective” – was organized by Ward Mintz.
The issue related to the timely communication between the Code Enforcement Officer and HPC was already discussed during the Audit/Workshop meeting of November 29.
There is no HPC meeting in December; the next meeting is on January 23 (because of the holidays on the usual 3rd Monday, meetings are on the 4th Monday in January and February).
YC: The regular monthly meeting was rescheduled for Wednesday, November 30 at 6:30 pm in order to have a special meeting with Epworth to discuss the 2012 Summer Program.
Councilman Spano: Councilman Spano met with the CEO to discuss applications and procedures. Councilman Spano also stated that the CEO doesn’t have a Historical District booklet. After a lengthy discussion the board agreed that Code Enforcement Officer Jerry Davis needs to communicate with the Historic Preservation Commission. Before revising chapter 22 dialog must be met with CEO and HPC to find what proper tools are required to have the process work.

 

Supervisor Chipman read aloud Councilwoman Michailescu’s liaison report. He thanked Manuela for 4 years of dedicated service as Councilwoman. She takes her role serious and has done a great job.

 

NEW BUSINESS:

 

ACCORD SPEEDWAY 2012 RACE TRACK SCHEDULE:

 

Resolution # 85- 2011:

 

A Motion was made by Councilman Cilenti to approve the proposed 2012 Accord Speedway Race Track schedule.

ELECTRONIC’S COLLECTION AGREEMENT:
Resolution # 86-2011:

 

A Motion was made by Councilman Cilenti to approve contract with the change of the Town of Rochester being an additional insurer.

NYS TROOPER BARRACKS CLOSING:

 

Resolution # 87 -2011:

 

A Motion was made by Councilman Cilenti to authorize Supervisor Chipman to write a letter on behalf of the Town of Rochester Town Board opposing to any possible closing of the Ellenville Trooper Barracks.

2012 TRANSFER STATION PERMITS:

 

Resolution # 88-2011:

 

A Motion was made by Councilman Cilenti to authorize the Town Clerks Office to sell the 2012 Transfer Station Permits.

Councilwoman Archer asked Highway Superintendent Wayne Kelder if a report of the Roads and Bridges have been made available from the devastation of Hurricane Irene and Lee? Wayne stated he has yet to meet with FEMA, once that meeting is met a list would be available. After a discussion Highway Superintendent Kelder stated he would meet with the Board to discuss areas of focus.

A Motion was made by Councilman Cilenti to enter into executive session at 8:00pm to discuss pending litigation.

AUTHORIZATION OF LEGAL ACTION:

 

Resolution # 89-2011:

 

A Motion was made by Councilman Cilenti to authorize Attorney Christiana to pursue legal action in response to the Feldman case.

Supervisor Chipman presented flowers to Councilwoman Michailescu and thanked her for her dedication to the Town Board. Councilwoman Michailescu was a big asset to the accomplishments made in the Town of Rochester during her four years on the Town Board. She will be missed dearly.

 

HIGHWAY REPORT:

 

The Town Board met with Highway Superintendent Wayne Kelder to discuss damage incurred by Hurricane Irene and Lee. Highway Superintendent Kelder stated that the Town of Rochester was fortunate in many aspects. The Town was prepared with a disaster plan. He thanked the Board for allowing him to purchase material while it was still available. By doing this, the town got a great start on road, shoulder and bridge repairs. He stated that it was a fairly good fall allowing a large scope of the work to be completed and with weather permitting some fine-tuning is left to be completed. Councilman Cilenti stated that Highway Superintendent Kelder was very proactive and deserves credit for his efforts. Wayne discussed the kick off meeting with FEMA and presented the Town Board with a scope of work report.
