2010 November Town Board Minutes

A Public Hearing was held on November 4, 2010 at 7:00pm at the Town Hall Re: Proposed Budget 2011.

 

PRESENT:

PLEDGE:

 

Supervisor opened the meeting and Robert Christian led the Pledge of Allegiance to the Flag.

 

Supervisor Chipman reviewed the proposed 2011 budget line by line and no questions were asked during the presentation.

 

The tax levy for the Town will have an increase of 0.56%.

 

PUBLIC HEARING CLOSED:

 

A Motion was made by Councilman Spano to close the hearing at 7:50pm.

APPROVAL OF MINUTES:
A Motion was made by Councilman Spano to approve the minutes of the 10/07/2010 Public Hearing; Outdoor Woodstoves, & 10/07/2010 Regular Town Board Meeting, 10/25/2010 Special Meeting, 10/28/2010 Public Hearing; Outdoor Woodstoves & 10/28/2010 Audit Workshop Meeting.

SUPERVISORS REPORT:  filed with the Town Clerk.
CORRESPONDENCE RECEIVED:
Supervisor Chipman stated he received a letter from Sydney Reece one of the bounding owners of GLF Rd.
SUPERVISOR’S UPDATE:
11/16/2010 a resolution for control of the Rail Trail on Kyserike Rd and Lucas Ave. are on the agenda for the Legislature meeting.
Supervisor Chipman stated he attended the grant class on the Rail Trailing funding, but control or ownership of the Trail is required before grants are available.
11/10/2010 the orientation meeting is scheduled for the Boards and Commissions at 7pm at the Town Hall.
11/11/2010 at 1pm is the dedication of the Veteran’s park. Supervisor Chipman thanked Highway Superintendent and his crew for all their work efforts in preparing the park.
LEGAL MATTERS:  
Attorney Christiana stated she hasn’t received an appeal from Mombaccus yet, and no dates are set for the Tax Assessment claims.
LIAISON REPORTS:
Councilwoman Archer: Absent
Councilman Cilenti: Absent
Councilwoman Michailescu:  Youth Commission: basketball~- has 91 youth enrolled. After School Program: Enrollment is over 35 youth attending daily; an additional staff person was hired; there are two volunteers in this program. Marbletown Elementary is now sending TOR youth to our free after school program. Program is offering ART classes every Thurs. and Fri. for 5 weeks. “Eat Smart Program” offered by Cornell Cooperative is every Tuesday for 6 weeks. Haunted Barn & Kids Halloween Party: very successful. Over 70 community residents attended the Halloween Italian luncheon. Rochester Residents Assoc. donated  $350 for Thanksgiving. Tree lighting will be held on November 19, 2010 at 5pm at the Town Hall. HPC: Focus on next steps towards the dedication of the VETERANS’ PARK and planning the Veterans Day ceremony, with specific tasks assigned, discussed procedures for communication between HPC and Planning Board, the need for criteria was stressed.
Dedication of Veterans Park is Nov. 11, 2010 at 1pm.
Councilman Spano: nothing to report
Supervisor Chipman: ReVal update: Information on 1,000 parcels have been collected another 1,000 is projected for the month of November. A traffic study is going to be completed on the intersection of Kyserike Rd and Lucas Ave.

 

NEW BUSINESS:
PROPOSED 2011 BUDGET:

A Motion was made by Councilman Spano to adopt the proposed 2011 Town Budget.

A Motion was made by Councilwoman Michailescu to approve the upcoming schedule for Accord Speedway.

SCHEDULE PUBLIC HEARING FOR DOG LICENSING LAW:

 

Resolution # 119-2010:

 

A Motion was made by Councilwoman Michailescu to schedule the Public Hearing for Proposed Local Law amending Chapter 53 of the code of the Town of Rochester on 12/2/2010 at 7pm at the Town Hall with the Town Clerk advertising the same.

ESTABLISHING FEE FOR OUTDOOR WOODSTOVES:

The Audit/Workshop Meeting was held on November 30, 2010 at 7:00pm at the Rochester 2 Firehouse.

DOG LICENSE LAW:

 

Supervisor Chipman asked The Board to review the proposed Local Law for Dog Licensing, and the Public Hearing is scheduled for 12/2/2010 at 7pm.

 

PROVIDENT SIGNING UPDATE:

 

A Motion was made by Councilman Cilenti to authorize Supervisor Chipman, Deputy Supervisor Cilenti and Councilman Spano to sign Town Bank documents and checks.

RAIL TRAIL UPDATE:

 

Supervisor Chipman stated that the County has granted the rights of the Rail Trail to the Town of Rochester from the portion of Marbletown to Lucas Ave.

 

COLLECTIVE BARGAINING AGREEMENT WITH IBEW LOCAL 363:

 

Supervisor Chipman stated to The Board that the Union ratified agreement had 3 changes made to the contract. In 2011 there will be no salary increase but employees will receive 1-week vacation, and 2012-2013 the employees will receive 2.5% salary increase.

 

GLF ROAD UPDATE:

 

Supervisor Chipman spoke with Attorney Christiana and a letter is being worked on, with ownership of GLF Road.

 

BOARD AND COMMISSION DISCUSSION:

 

Councilwoman Archer stated that a process needs to be put in place on communications between the Town Board and other Boards and Commissions within the Town. Communication needs to be stressed during process issues and when information is referred to outside agencies The Town Board should be notified of these approvals. Councilman Cilenti agreed that the importance of Public Hearings need to stressed as well. The Town Board should be aware of each Board and Commissions monthly agendas. Supervisor Chipman stated a meeting should held between Chair and Vice Chair members of various Boards and Commissions with the Town Attorney, to discuss responsibilities each Board and Commission has by Law.

                        Highway Fund 2010 Abstract 11           $          42,966.92

Supervisor Chipman stated that Highway Abstract 11 included a bill in the amount of  $3,488.00 for Osterhoudt, this was the 5% retention amount held from the Creek Road project and in order to get paid by FEMA this has to be paid.

 

EXECUTIVE SESSION:

 

A Motion was made by Councilwoman Michailescu to go into Executive session to discuss legal matters and a personnel matter.

A Motion was made by Councilman Cilenti to reconvene the meeting at 8:15pm with no action taken nor monies spent.
