A. Action on Minutes
Recommended Resolution: The Town Board accepts the minutes of the April 1, 2021 Regular Meeting, April 8, 2021 Special Meeting, April 15, 2021 Special Meeting, April 22, 2021 Public Hearing, and April 29, 2021 Workshop meeting

B. Recreation Commission Appointment
Recommended Resolution; The Town Board appoints ¬¬Stephen Lopez to the Recreation Commission for a term ending December 31, 2023 and requests the Town Clerk notify him of the oath of office requirement.

C. Creation of an Employee Position
Recommended Resolution; Upon written notice from the Ulster County Personnel Office dated April 23, 2021 of Order and Determination #11425, approving the Town of Rochester request of change to the Deputy Town Clerk position from Civil Service designation as a 0.250 part-time position to a 1.000 full-time position, the Town Board establishes the position of Deputy Town Clerk, part-time effective May 9, 2021. The position will be compensated at $15.50 per hour. The position will be funded for up to 28 hours per week. Budget Code A14101.01.014.xxx, 3rd Deputy Town Clerk, shall be established and funded in the amount of $15,000. Budget Code A19904.01.000.00, Contingency, shall be reduced by $15,000 to fund the new position.

D. Additional Duties of 3rd Deputy Town Clerk
Recommended Resolution; Pursuant to NYS Town Law, Article 3, Section 30 (10)(a), the Town Board establishes the duties of the 3rd Deputy Town Clerk to include assistance to the Building Department/Code Enforcement Office, as required. The Town Board further delegates the Town Clerk to establish other duties for the position and to determine the employee’s schedule in consultation with the Town Supervisor and the Code Enforcement Officer.

E. Setting Hourly Wage and Hours for an Employee Poistion
Recommended Resolution; The Town Board amends the Wage and Salary Schedule of 2021 to change the position of Confidential Secretary/Bookkeeper to be funded at $20.00 per hour for 40 hours per week. The stipend for “Purchasing” is removed with this employee change..

F. Authorization to Work Additional Hours
Recommended Resolution; The Town Board authorizes Christina Ferrara to work an additional 5 hours per week until May 31, 2021 in addition to normal work hours as 1st deputy clerk to assist the Assessor and will be compensated at the regular rate of pay. The Town Board further authorizes the employee to assist the Assessor on Grievance Day, May 27, 2021.
G. Authorizing Use of Town Highways
Recommended Resolution; The Town of Rochester Town Board authorizes the Town Supervisor to sign the proposed agreement authorizing the use of certain Town roadways for the charity bike ride event “The Ride for Mental Health” to be held June 19, 2021 and June 20, 2021 upon presentation of a Certificate of Liability Insurance certificate naming the Town of Rochester as an additional insured party.

H. 2021-2023 Abrasive Sand Bid
Recommended resolution: The Town Board requests the Town Clerk post advertisement seeking sealed bids for abrasive screened sand for winter road use. Specifications of bids are available at the Town Clerk Office and on www.townofrochester.ny.gov. Bids are due on or before Wednesday June 2, 2021 at 11:00am at the office of the Town of Rochester Clerk, PO Box 65 / 50 Scenic Road, Accord, New York 12404 where they will be opened and read aloud. A non-collusion form and certified testing results shall be included as a part of the bid package. The Town Board has the right to reject any and all bids.

Specifications
1. The sand shall be hard with 100% passing 3/8″ screen, not more than 15% passing #50 mesh and not more than 4% passing #200 mesh and must be readily usable in spreading equipment.
2. Certified testing results shall be submitted as a part of the bid package.
3. Bid prices shall be priced per ton; variations will not be accepted.
4. The bidder’s attention is called to the fact that if scales are not available at plant site, the bidder must state conversion factor-weight per cubic yard on bid conversion sheet.
5. Sand is to be made available for pickup by trucks designated by Town of Rochester authorized entities and operated by authorized personnel.
6. Bids shall be guaranteed valid for a period of 2 years from July 1, 2021 through June 30, 2023.

I. Authorization to Amend the 2021 Flexible Spending Account – FSA (Resolution 221-2020)
Resolution 221-2020
A Motion was made by Councilwoman Enouen that the Town Board makes offer to employees the opportunity to enroll in the MVP Select Care, Inc. Flexible Spending Account Health FSA in an amount up to $2750 per year with a grace period of 2.5 months after the end of the plan year to utilize all funds, effective December 1, 2020 through November 30, 2021, as presented by Marshall and Sterling Group Benefits, and authorizes the Supervisor to sign the agreement.
Second: Councilman Paddock
Recommended Resolution: The Town Board amends resolution 221-2020 due to MVP FSA changes per Consolidated Appropriations Act (CAA)/American Rescue Plan (ARPA) to allow the following
1. Election Changes – Employees shall be allowed to revoke their current FSA elections, make new, increase, or decrease. The enrollment period shall be for a period of May 10, 2021 through June 11, 2021.
2. 12-Month Extended Grace Period – This changes the current 2.5 month grace period to 12 months for the 2021 Medical FSA

J. Setting a Special Workshop Meeting
Recommended Resolution: The Town Board sets a special workshop meeting for Thursday May 13, 2021 at 5:00pm via videoconference for the purposes of the Bard College graduate student presentation of the Climate Smart Communities Gap Analysis project and requests the Town Clerk post legal notice. The Town Board will further invite the members of the Environmental Conservation Commission to attend.

K. Acceptance of a Donation
Recommended Resolution: The Town Board accepts a donation of 3 hanging flower baskets from Sauderskill Farms for display outside the highway garage.

XI. Discussion – Possible Resolutions
L. Acceptance of Used Playground Equipment
Recommended Resolution: The Town Board accepts a donation of “excellent condition” used playground equipment donated by Accord resident Connor Lawrence. Mr. Lawrence is employed by a playground equipment installer and he will coordinate delivery with the Town Supervisor and also consult on the installation and assembly of the equipment.

M. Authorizing Work on Town Property
Recommended Resolution: The Town Board authorizes volunteers Councilman Hewitt, members of the ECC, and members of the public to Identify and remove invasive species including multiflora rose, barberry, and Japanese knotweed, abiding by NYS DEC recommendations, for the Town property located at 6140 US Highway Route 209. There is to be no cost incurred by the Town.

N. Town Highway Section 284 Agreement
Recommended resolution: The Town Board approves the expenditure of $TBD in highway monies for the primary work and general repairs of 111 miles of Town highways, in accordance with Section 284 of the Highway Law, and authorizes signature of the agreement. The expenditures have been verified as being budgeted Highway Fund amounts for 2021 by the Supervisor.

O. Local Law 2-2021, Amendment of Chapter 140 – Short-Term Rental Law
Recommended Resolution: The Town Board sets a continuation of the public hearing for Local Law 2-2021, Amendment to Chapter 140, Zoning, to be held Wednesday May 25, 2021 at 6:00pm by video and teleconference in accordance with the Governor’s Executive Order 202.1 and successors, and requests the Town Clerk post notice of the hearing. The public hearing will be immediately followed by the May Workshop meeting.

P. Local Law 3-2021 , Amending Chapter 132, Vehicles and Traffic
Recommended Resolution: The Town Board sets public hearing for Local Law 3-2021, Amendment to Chapter 132, Vehicles and Traffic, to be held Thursday June 3, 2021 at 6:30pm by video and teleconference in accordance with the Governor’s Executive Order 202.1 and successors, and requests the Town Clerk post notice of the hearing. The public hearing will be immediately followed by the June Regular meeting.

Q. Climat Smart Community Task Force
Recommended Resolution: The Town Board authorizes the Supervisor to solicit letters of interest from residents who wish to be considered for membership on the Climate Smart Community Task Force.
