A. Action on Minutes
Recommended Resolution: The Town Board accepts the minutes of the February 4, 2021 Regular Meeting, February 11, 2021 Special Meeting, and February 25, 2021 Workshop meeting

B. Acceptance of a Donation
Recommended Resolution: The Town of Rochester accepts donations of $124.17 from St. Pauly’s Textile, Inc and $100 from Mel and Elaine Tapper.

C. Board and Commissions Reappointment
Recommended Resolution; The Town Board reappoints ¬¬¬¬¬_________ to the respective Boards and Commissions as per their original 2021 appointment terms.

D. Amendment to Speedway Permit – Resolution 248-2020
Recommended Resolution; The Town Board has received request from Accord Speedway for 1 additional racing date and 1 additional rain date and amends a portion of resolution 248-2020 to state:
“The Town Board further accepts the racing schedule as presented for 37 38 actual racing dates and 27 28 potential rain dates. Dates listed as rain dates may be utilized only to replace a rained out approved event date.” so as to allow racing on May 11, 2021 with a rainout date of May 12, 2021.

E. Authorizing Correspondance to the Unified Court System
Recommended Resolution; The Town Board authorize the Town Supervisor to send a copy of the audit of the Justice Court records for the fiscal year ending December 31, 2020 to the State of New York Unified Court System


F. Authorizing the Supervisor to Cast a Ballot
Recommended Resolution; The Town Board authorizes the Town Supervisor to cast the Town of Rochester ballot for Catskill Watershed Corporation, Board of Directors, Ulster County representative for nominee James Sofranko, Town of Olive Supervisor. Mr. Sofranko is unopposed.

G. Authorizing a Contract Renewal
Recommended Resolution; The Town Board authorizes the Town Supervisor to sign the renewal of a contract with Peak Power System, 99 Sprague Ave., Middletown, NY for an annual agreement for generator service maintenance at the Harold Lipton Community Center.

H. Authorizing a Contract Renewal
Recommended Resolution; The Town Board authorizes the Town Supervisor to sign an extension of the shared services contract dated May 3, 2018, between the Kerhonkson Accord First Aid Squad and the Town of Rochester, as presented, effective through December 31, 2021

I. Authorizing a Contract
Recommended Resolution;
WHEREAS, the Town of Rochester Town Board has received recommendation by the Town insurance carrier a fire and smoke alarm system for the Town of Rochester Town Hall is needed and necessary; and
WHEREAS, The Town of Rochester is seeking a fully designed, installed, and continuing monitoring services for a smoke and fire alarm system at 50 Scenic Road, Accord, NY 12404 for the Highway Garage and the Town Hall; and
WHEREAS, The Highway Garage should utilize Rate of Rise sensors and he Town Hall should utilize Smoke and Carbon Monoxide detectors; and
WHEREAS, the project was formally bid in accordance with municipal requirements, and publicly advertised on January 11, 2021 on the NYS Contract Reporter and in the January 14, 2021 Shawangunk Journal newspaper; and
WHEREAS, respondents were to return bid responses no later than Wednesday, February 3, 2021, at 2:00 PM and
WHEREAS, respondents were required to submit a combined priced bid for design of the system, Installation of the system, and monitoring of the system; and
WHEREAS, Six (6) bids were received ranging from a low bid of $16,471.00 to a high bid of $36,141.06; and
WHEREAS, the lowest responsible bidder for services is Alert Alarm and Security, 27 Commercial Dr. West, Johnson, City, NY, in the amount of $15,967.00 for design and installation and $504.00 for annual monitoring; and
WHEREAS, The Town Board resolved to accept the lowest responsible bid on February 25, 2021 with resolution xx-2021; and
THEREFORE, The Town Board authorizes the Supervisor to sign acceptance of the terms of proposal.


J. Local Law 1 of 2021
Amendment to Chapter 17, Ethics
Recommended Resolution: The Town Board resolves to declare Local Law 1 of 2021, Amendment to Chapter 17, Ethics as being an Unlisted Action under SEQRA and to declare a Negative Declaration, having reviewed Part 1 and 2 of the Short Form Environmental Assessment Form and determining that Local Law 1 of 2021 will not result in a significant adverse environmental impact and consequently no EIS will be prepared.

K. Local Law 1 of 2021
Amendment to Chapter 17, Ethics
Recommended Resolution:
Whereas, The Town of Rochester Town Board desires to amend the Code of the Town of Rochester, Chapter 17, Ethics to allow for an alternate member; and
THEREFORE, the Town Board adopts Local Law 1 of 2021, Amendment of Chapter 17, Ethics and requests the Town Clerk file the Local Law with the Department of State.

L. Local Law 3 of 2021 – Setting a Public Hearing
Amendment to Chapter 125, Subdivision
Recommended Resolution:
Whereas, The Town of Rochester Town Board desires to amend the Code of the Town of Rochester, Chapter 125, Subdivision to correct a discrepancy between a definition and code text; and
Whereas, The Supervisor has completed a Part 1 assessment for the action and the Town of Rochester Town Board classifies this action as a Type 1 action with the Town of Rochester being designated lead agency for the purposes of the State Environmental Quality Review Act; and
THEREFORE, the Town Board requests the Town Clerk circulate referral of the Local Law to the Town of Rochester Planning Board and the Ulster County Planning Board and requests the Town Clerk post and advertise legal notice of a public hearing for Local Law 3 of 2021, Amendment of Chapter 125, Subdivision to be held April 8, 2021 at 6:30pm, to be held either in person at the Harold Lipton Community Center or via videoconference in compliance with the Governor’s Executive Order 202.1 and successors.

Recommended Resolution; The Town Board motions to enter into executive session for the discussion of the potential employment of a particular person.

N. Executive Session
Recommended Resolution; The Town Board motions to exit executive session.
