A. Action on Minutes
RECOMMENDED RESOLUTION: The Town Board accepts the minutes of the August 27, 2020 Audit/Workshop, September 1, 2020 Regular, September 8, 2020 Special and September 24, 2020 Audit/Workshop meetings

B. Amending Resolution # 121-2020 – Town Highway Section 284 Agreement
RECOMMENDED RESOLUTION: Upon recommendation of the Highway Superintendent, the Town Board hereby amends resolution 121-2020 as follows

The Town Board approves the expenditure of $182,000 [$238,000] in highway monies for the primary work and general repairs of 111 miles of Town highways, in accordance with section 284 of the Highway Law, and authorizes signature of the agreement. The expenditures have been verified as being budgeted Highway Fund amounts for 2020 by the Supervisor.

C. Ulster County Planning Board Alternate Town Representative
RECOMMENDED RESOLUTION: Upon recommendation of the Town Supervisor, the Town Board authorizes the Town Supervisor to submit the name of Councilwoman Erin Enouen to the Ulster County Planning Board for consideration by the Ulster County Legislature to serve as the Town of Rochester alternate member.

D. Approve Request to Construct Code Enforcement Storage Space
RECOMMENDED RESOLUTION: Upon recommendation of the Code Enforcement Officer and Fire Inspector, the Town Board authorizes the expenditure of up to $8,000 for labor and materials to enclose the porch area in front of the Code Enforcement Office at the Harold Lipton Community Center to be utilized as file storage. Work to be done “inhouse” utilizing town employee personnel who shall be compensated at the rate of $25 per hour for this additional work. Such work shall not apply toward overtime compensation.

E. Authorizing the Supervisor to Purchase IT Equipment
RECOMMENDED RESOLUTION: Upon recommendation of Fisch Solutions, Town IT consultant, the Town Board authorizes the purchase of the following from Fisch Solutions

F. Acceptance of a Donations of Goods
RECOMMENDED RESOLUTION: Upon recommendation of the Town Supervisor, the Town Board authorizes the Town Supervisor to accept a donation of an industrial barbecue grill from the Accord Fire Department Company #1 and the donation of cabbage and bread from Ashley Sweeney, Recreation Director.

G. Acceptance of Cash Donations
RECOMMENDED RESOLUTION: the Town Board authorizes the Town Supervisor to accept a donation of $100 from Elaine and Mel Tapper and $49 in cash donations collected during the St. Patrick’s Day in September drivein luncheon.

H. Setting a Public Hearing
RECOMMENDED RESOLUTION: The Town Board sets a public hearing to hear comments regarding the 2020 Town of Rochester Budget to be held Thursday, November 5, 2020 at 6:30pm, via videoconference in compliance with the Governor’s Executive Order 202.1 and successors.
The November regular meeting will immediately follow the public hearing.
The Town Board requests the Town Clerk post and advertise legal notice of such public hearing.

I. Authorizing the Supervisor to Sign a Contract-Small Employer Benefits Package
RECOMMENDED RESOLUTION: Upon recommendation of the Town Supervisor, the Town Board accepts the Small Employer Benefits Package with enrollment of qualified Town employees/spouses/families in the MVP Liberty Silver 8 Health Plan, effective December 1, 2020 through November 30, 2021, as presented by Marshall and Sterling Group Benefits, and authorizes the Supervisor to sign the agreement.

RECOMMENDED RESOLUTION: Upon recommendation of the Town Supervisor, the Town Board accepts the Small Employer Benefits Package with enrollment of qualified Town employees/spouses/families in the MVP Select Care, Inc. Health Reimbursement Account, effective December 1, 2020 through November 30, 2021, as presented by Marshall and Sterling Group Benefits, and authorizes the Supervisor to sign the agreement.
80% paid by town (split 40% town – 20% employee – 40% town)

K. Authorizing the Supervisor to Establish a Flexible Spending Account Health FSA
RECOMMENDED RESOLUTION: Upon recommendation of the Town Supervisor, the Town Board makes offer to employees the opportunity to enroll in the MVP Select Care, Inc. Flexible Spending Account Health FSA in an amount up to $2750 per year with a grace period of 2.5 months after the end of the plan year to utilize all funds, effective December 1, 2020 through November 30, 2021, as presented by Marshall and Sterling Group Benefits, and authorizes the Supervisor to sign the agreement.

L. Authorizing the Supervisor to Sign a Contract-Retiree Benefits Package
RECOMMENDED RESOLUTION: Upon recommendation of the Town Supervisor, the Town Board accepts the Retiree Benefits Package with enrollment of qualified retired Town employees/spouses in the MVP Health Plan, effective January 1, 2021 through December 31, 2021, as presented by Marshall and Sterling Group Benefits, and authorizes the Supervisor to sign the agreement.

Amendment to the Town of Rochester Comprehensive Plan
RECOMMENDED RESOLUTION:
WHEREAS, the Town of Rochester convened the Comprehensive Plan and Land Use Code Review Committee on February 6, 2020, and

WHEREAS, the committee has met and made written recommendation to the Town Board, and

WHEREAS, the Town Board desires to amend the Comprehensive Plan appendices as follows:
1. to include the Open Space Plan (2015) in its entirety
2. to include the Historic Resources Report (2008) in its entirety
3. to include the Natural Heritage Plan (NHP) pages 1 – 33
4. to include the Natural Heritage Plan (NHP) Appendix A: Conservation Open Area & Critical Environmental Areas Maps (pages 62 – 71)
5. to include the Natural Heritage Plan (NHP) Appendix B: Catskill Shawangunk Greenway Corridor (CSGC) Symposium Summary Report (pages 72 -76)
6. to include the Natural Heritage Plan (NHP) table of figures and details on working groups (pages 77 – 82)
and

WHEREAS, the Town Board has circulated notice and the documents of such amendment to the Ulster County Planning Board, The NYS Office of Parks, Recreation, and Historic Preservation, the NYS Department of Agriculture and Markets, the Town of Rochester Planning Board, the Town of Rochester Environmental Conservation Commission, and the Town of Rochester Historic Preservation Commission with request for comment, and

THEREFORE, pursuant to NYS Town Law, Article 16, Section 272-A, the Town Board requests the Town Clerk circulate and post notice of a public hearing to be held _________, 2020 at ____pm, to be held via videoconference in compliance with the Governor’s Executive Order 202.1 and successors and requests the Town Clerk post and advertise legal notice of such public hearing.
