MINUTES OF May 6, 2009 Special MEETING of the Town of Rochester PLANNING BOARD, held at the Town Hall, Accord, NY.
 
Meeting was called to order at 5:30 PM by Chairman Tapper.

MOTION FOR PUBLIC HEARING
Motion to hold a Public Hearing on the DEC Application for the Consolidation of the Mombaccus Excavating and Rochester Center Mines, DEC #: 3-5144-00083-00001, MLR# (30496) pursuant to Section 140-36I.(2)(c) of the Zoning Ordinance of the Town of Rochester.

 

Chairman Tapper noted that the purpose of this meeting was to motion to schedule a Public Hearing on May 19, 2009. They need the Board to vote to have it. He explained that the DEC sent a Notice of Complete Application for the Consolidation of the Mombaccus Excavating and Rochester Center Mines. The DEC wants a response by May 29, 2009 and this would be the only time to hold the Public Hearing.

 

Mr. Baden noted that this property used to be 3 separate parcels and there are 2 separate mines with 2 separate DEC permits. This Public Hearing would allow the PB to collect public comment and compile the information and send these comments along with PB comments to the DEC. Both of their permits for these mines technically expired in 2007 but the DEC has a policy that as long as the renewals are applied for and are under DEC review they are fine. He’s not sure how the Town’s enforcement should feel about that, but as far as the DEC is concerned they are fine. The DEC documents are available at the PB office to view and they can be brought to the meeting.

 

Chairman Tapper noted that the Public Hearing shouldn’t last very long and he would do his best to limit the comments to the applicable section of the law.

 

Mr. Baden motioned to schedule the Public Hearing for May 19, 2009 in light of the DEC Notice of Complete Application and the authorization to hold such hearing as per Section 140-36I.(2)(c). Seconded by Mr. Rominger. All members present, in favor.

Mr. Baden motioned to adjourn, seconded by Mr. Smith. No discussion. All members present in favor.
